{"title":"Jak badać libertariańską teorię sprawiedliwości? Uwagi metodologiczne na temat struktury, problemów i metod badania teorii dedukcyjnej","authors":"Łukasz Dominiak","doi":"10.12775/DP.2018.008","DOIUrl":"https://doi.org/10.12775/DP.2018.008","url":null,"abstract":"In the present essay we share our ideas concerning methods by which the libertarian theory of justice should, in our opinion, be investigated. First of all, we classify libertarianism as a deductive theory that derives all its statements from the first principles of justice: the self-ownership principle, the homestead principle and the principle of voluntariness in transfer. We distinguish two modes of inquiry that should be employed with regard to the libertarian theory: conceptual and substantive investigations. In the first area the Hohfeldian analysis of the fundamental jural conceptions proves to be highly illuminating. {"title":"Porównanie anarchistycznej etyki argumentacji Hoppego z demokratyczną isegorią grecką","authors":"Paweł F. Nowakowski","doi":"10.12775/DP.2018.006","DOIUrl":"https://doi.org/10.12775/DP.2018.006","url":null,"abstract":"The paper confronts the argumentation ethics developed by Hans-Hermann Hoppe, a libertarian and anarcho-capitalist thinker, with basic assumptions of the ancient democracy (originally called isegoria , that is, “an equal right to speak”), both of which are rooted in the phenomenon of discourse. Based on an analytical comparison the paper argues that possible similarities are superficial and deceptive. Indeed, despite some similarities prima facie , the theories in question have different nature and aims. The ethics of argumentation is a philosophical theory and as such has a different ambition than isegoria , which was a political system, even if it had some sound philosophical justification. {"title":"A Critique of the Pure Natural Law Approach to Loan Maturity Mismatching and Fractional Reserve Banking","authors":"Esteban Medina, P. Block and Barnett (2011) as well as Evans (2014) have regarded the distinction between loans and deposits as unclear, especially regarding the contracts’ maturities. Davidson (2015) applying the a priori Title Transfer Theory cannot solve the continuum conundrum satisfactorily. We show how a free legal system by rule finding judges can settle the continuum problem and other problems relating to banking contracts in practice. The very same rule finding offers a new solution in the case of on-demand deposits with a withdrawal notice. {"title":"Freedom and Property Rights – Avoiding Circularity","authors":"I. They either resort to a descriptive notion of freedom of some sort in saying that any infringement on the owner’s property rights would diminish her freedom or they use a moralized definition of freedom positing that the exclusion (be it factual or normative) of non-owners from owners’ properties cannot contribute to any unfreedoms on the part of the former since they are merely prevented from doing something they do not have a right to do in the first place. On the positive note, I will suggest a purely descriptive (and therefore neutral) notion of freedom that would allow for making synthetic (as opposed to analytical) statements concerning freedoms (or unfreedoms for that matter) and property rights. In the first point I introduct to my topic. I am describing some general and common standpoints on mentioned issues and explaining the problem. Next I am trying to solve the linguistic and logical problems of defining omniscience in some linguistic and logical ways. Then I take up the subject of Austrian praxeology and its epistemological implications.
