The Moscow school stood for the revival of natural law and the religious-idealist defense of liberalism. Novgorodtsev was a professor of law at Moscow University and the Moscow Higher Commercial Institute. He was a prominent figure in Russian liberal politics, first in the Union of Liberation, then in the Constitutional Democratic (Kadet) Party. In 1906, he was elected to the First State Duma. After the Bolshevik revolution he settled in Prague, where he was instrumental in creating the Russian Law Faculty at Charles University. Novgorodtsev’s chief works form a three-part series collectively titled Introduction to the Philosophy of Law. The first part consists of two essays on the revival of natural law: “Ethical Idealism in the Philosophy of Law,” which appeared in Problems of Idealism (1902), a seminal collection edited by Novgorodtsev; and “The State and Law” (1904), which takes up the defense of constitutional guarantees of human rights. The second and third parts are The Crisis of Modern Legal Consciousness (1909) and On the Social Ideal (1917). Although he was not a jurist, Soloviev helped to inspire the religious-idealist philosophy of law that emerged in Russia at the turn of the twentieth century. He elaborated a vision of the good society as a community that orders its economic activity, law, government, and religious life in such a way as to respect the integrity of each of the spheres while promoting their symphonic interaction. Assigning a central place to juridical values in his philosophy, Soloviev criticized Slavophiles, Tolstoyans, and other Russian antilegalists of his day. This chapter describes Soloviev’s first sketch of a philosophy of law in The Critique of Abstract Principles (1880) and goes on to explicate the more mature formulation in The Justification of the Good (1897, 2nd ed. 1899). The chapter places Soloviev’s understanding of law in the context of his overarching religious vision. Soloviev did not view the rule-of-law state as the highest form of community. Following fifteen years of administrative work and research on Russian legal history, he taught civil law at Moscow University. In the 1870s, Pobedonostsev severely criticized the Judicial Reform of 1864, which, ironically, he had helped to craft. As chief procurator of the Holy Synod from 1880 to 1905, he ranked as the senior lay official in the governing body of the Russian Orthodox Church. Pobedonostsev had little faith in law as a means of human progress. He regarded law mainly as an instrument of state power, necessary to contain the human proclivity toward evil. In his assessment of the Orthodox Church’s contribution to Russian society, Pobedonostsev pinned his hopes on ordinary believers rather than the clergy, whom he generally distrusted. One of his main projects in his later years was a revised translation of the New Testament designed to integrate the Russian version more closely with the Church Slavonic text used in Orthodox religious services.
