In this context, it is therefore important to determine whether a conceptual category such as ‘climate law’ can indeed be distinguished in EU legislation and, if so, what is the meaning of this notion? To this end, the notion of ‘European climate law’ is analysed. The dogmatic-legal method is primarily used as the research method in this study. A theoretical-legal method is also used to highlight certain themes related to legal institutions. The research is narrowed down to selected normative acts that are part of the EU legislation – the provisions of normative acts related to the functioning of the EU are analysed. The main conclusions in the paper focus on the application of the term ‘climate law’ in the selected EU regulations. This is juxtaposed with the category of the legal system sensu stricto and sensu largo. Zgodnie z założeniami mediacja miała usprawnić postępowanie, ułatwiając rozwiązywanie kwestii spornych ujawniających się w sprawie będącej przedmiotem kontroli sądu administracyjnego. Mediacja nie znalazła jednak szerszego zastosowania. Celem artykułu jest próba ustalenia przyczyn ograniczonej skali korzystania z tej instytucji, w tym spadku liczby mediacji prowadzonych przed wojewódzkimi sądami administracyjnymi. Badania obejmują lata 2004–2017, a więc okres, w którym mediację prowadzili sędziowie lub referendarze sądowi. Materiałem źródłowym dla rozważań przedstawionych w artykule są nowe dane pochodzące z wywiadów z sędziami i referendarzami sądowymi. W artykule zaprezentowano ich opinie na temat przyczyn konsekwentnego spadku liczby spraw kierowanych do mediacji. Autorzy opierają się również na danych statystycznych Naczelnego Sądu Administracyjnego. Analiza prowadzona jest z perspektywy socjologiczno-prawnej. Z zaprezentowanych w artykule badań wynika, że przyczyny spadku liczby spraw kierowanych do mediacji w latach 2004–2017 mogą być wyjaśnione na gruncie teorii roli społecznej oraz teorii racjonalnego wyboru. {"title":"Factors affecting the conclusion of an arrangement in restructuring proceedings: evidence from Poland","authors":"Błażej Prusak, Ulyana Zaremba, Paweł Galiński","doi":"10.14746/rpeis.2023.85.3.14","DOIUrl":"https://doi.org/10.14746/rpeis.2023.85.3.14","url":null,"abstract":"The EU Restructuring Directive (2019/1023) requires Member States to provide a preventive restructuring framework for financially distressed entities that remain viable or are likely to readily restore economic viability. The first step to a successful restructuring is the approval of an arrangement between the debtor and creditors. The main research objective of the article is to identify factors affecting the conclusion of an arrangement in restructuring proceedings. In the process of filtering companies initiating a restructuring procedure, these factors are seen as increasing the probability of concluding an arrangement between debtor and creditors. Moreover, an additional research objective is to construct a turnaround prediction model aimed at assessing the probability of a conclusion of an arrangement in restructuring proceedings. The study covered the companies in Poland for which restructuring proceedings opened between 2016 and 2021 ended with the approval of an arrangement, and a similar number of companies that failed to restructure successfully. Binary logistic regression was applied to achieve the aims of this study. The results show that two financial variables affected companies in terms of their chances to conclude the arrangement: the current ratio and return on assets were among the statistically significant indicators and they are characterized by higher values for debtors reaching the arrangement with their creditors. A direct positive relationship was also identified between the company’s lifespan and the outcome of the proceedings. The probability of the conclusion of the arrangement was also affected by the type of industry. The thematic scope of this problem is broad; thus it is impossible to cover all its complexity in one study. Hence, attention is focused on selected aspects of the issues raised: on issues related to growth and development as well as economic inequalities, the economic foundations of growth, and the issue of substituting natural capital by human capital. A critical diagnosis and postulates for the future, with regard to measures of well-being in the context of the idea of sustainable development, are also considered as well as including the issue of sustainable development in development economics. The article ends with concluding remarks highlighting the thesis that economic growth should now be acceptable only when it does not excessively exploit natural capital and does contribute to deteriorating the quality of life. In July 2021, the European Commission renewed its sustainable finance strategy, pointing out that in the current decade, Europe will need additional investments to achieve its climate targets, expecting, in connection with their implementation, an increase in private sector expenditure. Financial institutions, including banks, joined this process. The article presents the results of a questionnaire survey conducted among representatives of the largest commercial banks in Poland, aimed at identifying the importance of greening their loan portfolios. The main aim of the paper is the exegesis of bank risk, taking into account the escalation due to factors that have destabilized banks’ lending activity in recent years, including the growing ESG (Environmental, Social and Governance) risk. The following research methods were used: survey research, a literature review, observation method, synthesis method and cause-and-effect analysis – all of which enabled the adoption of the main research hypothesis (H1), which assumes that the constantly growing interest and involvement of domestic banks in green loans increases the regulatory mix of bank risk, becoming a serious challenge for the banking compliance function. The research results presented in the article indicate that banking institutions in Poland are increasing their involvement in the implementation of sustainable finance assumptions, and green investments have better chances of financing in commercial banks in Poland. {"title":"Disqualification of en employee of a public administration authority in the European Union Member States","authors":"Z. Kmiecik","doi":"10.14746/rpeis.2023.85.2.09","DOIUrl":"https://doi.org/10.14746/rpeis.2023.85.2.09","url":null,"abstract":"One of the rules contained in the Code of Good Administrative Behavior adopted in 2001 by the European Parliament is the principle of impartiality and independence (Article 8). The presence of this rule, despite its non-binding nature, prompted the author to examine – using the method of comparative law analysis – whether the EU Member States have regulated this issue in their legal systems – and if so, to what extent and how. The basic institution serving the implementation of this principle is the disqualification of an employee of the authority from participation in the proceedings in situations where their impartiality seems to be at risk. Not all EU countries explicitly provide for such an institution. Among the legal systems that contain it, only some regulate the entirety of issues related to it: the grounds for disqualification, the procedure for disqualification and the consequences of it, as well as the appealability of orders taken in this matter and the consequences of violating the provisions on disqualification. Regulations of individual issues differ in the degree of detail. This applies primarily to the reasons for the disqualification of an employee of the authority. The most important reason for the disqualification of employees (except when they or their spouse are a party to the proceedings) is the consanguinity or affinity between them and the party. However, the ranges of such ties resulting in automatic disqualification of an employee, adopted in EU member states, differ significantly. The second area of significant difference is the consequences of the potentially biased employee’s participation in the proceedings. Jednak mimo jego popularności oraz faktu, że podejście to wykorzystuje pojęcia i metody badawcze zapożyczone z socjologii i innych nauk społecznych, zaskakująco mało uwagi poświęca się mu w refleksji socjologicznej. Celem tego artykułu jest uzupełnienie tej luki nie tylko przez omówienie głównych założeń podejścia design thinking, ale przede wszystkim przez dokonanie jego socjologicznej krytyki oraz przedstawienie możliwych wariantów reakcji socjologii jako dyscypliny na popularność tego podejścia. Artykuł ma charakter dyskusyjny i jest inspirowany badaniami z zakresu studiów nad nauką i technologią (STS), podejściem krytycznym w socjologii oraz koncepcją pola instytucjonalnego Pierre’a Bourdieu. Wyniki przedstawionej analizy pokazują, w jakim sensie design thinking może być atrakcyjne dla socjologii jako dyscypliny – nie tylko jako pewien zbiór narzędzi, ale jako odmienna, a przy tym inspirująca perspektywa poznawcza (akceptująca prowizoryczność i pragmatyzm), realizująca w pewnym stopniu program socjologii syntetycznej. Podstawową przesłanką podjęcia badań była istotna rola transportu zbiorowego z uwagi na aktualny problem kryzysu klimatycznego, konieczność ograniczenia emisji CO2 oraz działań Unii Europejskiej wspierających jego rozwój. Celem prowadzonych przez autorów badań była identyfikacja trudności związanych ze stosowaniem gałęziowych rozporządzeń dotyczących praw pasażera w multimodalnych przewozach pasażerskich. Autorzy poddali analizie prawa pasażerów, które w obecnym stanie prawnym zawarte są w osobnych dla każdej gałęzi transportu regulacjach, zwracając jednocześnie uwagę na praktyczny problem potrzeby unifikacji tych praw w sytuacji korzystania z kilku gałęzi transportu w czasie jednej podróży. Obecny stan prawny powoduje trudności w identyfikacji i realizacji poszczególnych praw pasażerów oraz jest istotną przeszkodą w rozwoju multimodalnych przewozów pasażerskich. Zastosowaną metodą badawczą jest metoda dogmatycznoprawna. Autorzy dokonują przeglądu nienormatywnych aktów wydawanych przez organy i instytucje, raportów oraz literatury dotyczącej przedmiotu artykułu. W artykule dokonano oceny modeli regulacji zaprezentowanych przez Komisję Europejską, przedstawiono możliwe rozwiązania zwiększające ochronę praw pasażerów w tego rodzaju przewozach. Zwrócono również uwagę na trudności związane ze stosowaniem obowiązujących obecnie gałęziowych rozporządzeń dotyczących praw pasażera w multimodalnych przewozach pasażerskich. W podsumowaniu przedstawiono propozycje regulacji de lege ferenda w formie nowego rozporządzenia w zakresie praw pasażerów w przewozach multimodalnych.
