Types of traffic accidents provided by the statistics of the Department of Patrol Police of Ukraine are analyzed. A number of road accidents with victims committed in conditions of the road and settlements streets unsatisfactory state is defined. \u0000 \u0000More and more judicial and investigative bodies turn to forensic science institutes, in particular to KhRIFE, in order to determine whether the improper design of the road network affected the occurrence of an accident. In other words, the questions not only on the establishment of improper design of the road section where the accident occurred, but also on the existence of cause and effect relationship between the identified discrepancies and the accident are advanced for examination. The study of the above issues belongs to the forensic specialty 10.16 Road and Pavement Forensic Investigation. The demand for forensic research of improper design of the road network and the causes of accidents are constantly growing. At the same time, the practice of conducting road and pavement forensic investigation, namely the analysis of the materials provided for the study, shows that most criminal proceedings are investigated both while pre-trial investigation and in court for violation of traffic safety rules or transport operation by persons who drive vehicles. {"title":"ON THE ISSUE OF EVALUATING THE FORENSIC STRUCTURAL ENGINEERING RESULTS IN CRIMINAL PROCEEDINGS","authors":"D. Taking into account the relevance of this type of forensic examination both for the investigation of criminal proceedings and for other types of court proceedings, main provisions concerning evaluation of a forensic report in the field of forensic structural engineering are considered. \u0000Relevant norms of the Criminal Procedure Code of Ukraine and of some foreign countries have been studied. It is concluded that, in fact, the approaches to the preparation of forensic report content are similar to the corresponding norms of the Ukrainian criminal procedure law. Certain discrepancies relate to the content of the report examination part – in some countries it does not contain a detailed description of the research course. In addition, according to Art. 242 of the Criminal Procedure Code of Ukraine, a defense can independently engage a forensic expert, therefore, Art. 102 needs improvement. And since the defense party is not endowed with the right to warn a forensic expert about responsibility for a knowingly false report and refusal without valid reasons to fulfill duties assigned to him, then the indicated norm must be supplemented for such cases – in the aspect of the forensic expert awareness on such responsibility. \u0000It is specified that the body (person) that appoints the forensic structural engineering examination does not always ask a forensic expert questions within the framework of the subject of proof. Admissibility of evidence is primarily determined by its receipt based on compliance with law. It is substantiated that tactical means of squatting and illegal construction investigation are the optimal set of linked by a common goal nonprocedural actions (measures), tactical methods, combinations, operations, recommendations, which are related to determining the action course of investigation entities and solving tactical tasks of a particular type of crime. It is proved that a prerequisite for the active development and implementation of means into investigative practice is that the realities of socio-economic transformations in Ukraine have led to the emergence of criminal activity new types and to advanced ways of its implementation. It seems that the development and use of means as a specific “toolkit” of forensic tactics in the activities of criminal proceedings professional participants (investigators, detectives), is one of the priorities of criminalistics at the present stage and the urgent need for practice. \u0000It is noted that investigation tactical means of squatting and illegal construction provide professional participants in criminal proceedings with specialized toolkit that ensures the effective solution of tactical tasks that arise in the investigation of a crime. It is substantiated that the investigated criminal offense has a fairly high level of public danger, since it encroaches upon the subjective rights and legitimate interests of citizens, state or local community represented by relevant authorities, therefore it requires prompt response from the entities of pre-trial investigation. Scientific approaches to understanding forensic tactics means and investigation tactical means of squatting and illegal construction are considered. The procedure for carrying out these works has been characterized, attention has been paid to building regulations and rules regarding the execution and acceptance of works on finishing coatings. The mandatory requirements for their quality are given and described. \u0000The process of forensic structural engineering conduct has been determined and the main problems and issues that arise while establishing the quality of work performed has been outlined. The main technical characteristics of the construction work on the implementation of the finishing coating, their characteristics are provided. A list of needed documents that are properly executed when ordering the execution of a finishing coating is discussed. \u0000Since in practice while conducting forensic structural engineering to determine the quality of finishing works, as well as during surveys, difficulties arise in their production. After all, quality control in construction includes obtaining factual data and comparing them with the established characteristics. \u0000The problem of checking the work performed is also considered. Attention is paid to the problem of conducting surveys on such works in order to correctly diagnose and identify technical characteristics of the works being carried out. \u0000The principles of conformity assessment are presented, for instance, the functional approach includes such processes as: selection, determination, review and type approval. \u0000The main approaches while examining conducted works are revealed. {"title":"THE PROBLEM OF SUBCLASS CHARACTERISTICS WHILE EXAMINATION OF REDESIGNED FLARE GUNS","authors":"P. Common characteristics are typical for a certain construction/model of firearms and are used for identifying the cartridge case group affiliation. Individual characteristics are random and are used for determining identity. Subclass characteristics appear at the stage of mechanical processing of the firearms’ parts. Therefore, the same marks can be observed on a few parts, which were consequently processed by the same tool. Lack of knowledge on the differences between individual and subclass characteristics may result in wrong conclusions as to identity. \u0000The article purpose is to acquaint ballistic forensic experts with the problem of subclass characteristics, mechanism of their occurrence and the ways for their determination. \u0000The mechanism of subclass characteristics occurrence and the characteristics on the basis of which we can determine that the examined characteristic is individual or subclass are discussed. The main examples of subclass characteristics, such as lands and grooves, arches, circles for which the width, depth and relative position of each element coincide, were given. The peculiarities of scene which allow to determine the individual characteristics among subclass characteristics are presented. The current legislation of Ukraine, which regulates the application scope of examination with the use of a polygraph, its problems and prospects for development is analyzed. \u0000The article purpose is to analyze the essence of polygraph (lie detector) psychophysiological examination, establish the principles of its application, the basic requirements for persons in respect of whom a polygrtaph is used, identify the role of psychophysiological examination in the investigation of murders involving domestic violence. \u0000When conducting scientific research, the dialectical method was used, that is all the phenomena connected with the use of a polygraph in their interconnection, interdependence and the device historical development were analyzed. The operation of the device with the help of which a polygraph psychophysiological examination is carried out were described using the methods of analysis and synthesis. Besides, the methods of modeling, deduction, observation, etc. Were used in the preparation of scientific paper content. \u0000Having analyzed the practice of using a polygraph in the world in many countries, we can admit that polygraph psychophysiological examination is regulated by a specific law, or by specific legal norms or regulatory legal acts, is appointed and conducted in case of inconsistencies while criminal offenses investigation, namely: \u0000 \u0000when there are direct contradictions between the testimony of the investigation participants; \u0000when there is a contradiction between the testimony of the interrogated persons and other evidence in the criminal case; \u0000when there is no evidence in the case. \u0000 \u0000Ukraine is only at the stage of legalizing the use of polygraphs during criminal offenses investigation. This is evidenced by the bills, in particular: \u0000 \u00003611 dated 10.12.2015 “On supplementing the Criminal Procedural Code of Ukraine with provisions on the use of a polygraph (lie detector)” \u00004094 dated 17.02.2016 “On protection of the persons rights undergoing polygraph test (examination)” \u00004094-1 dated 04.03.2016 “On polygraph activity” \u0000 \u0000The use of a polygraph while psychophysiological examination in the activities of Ukrainian law enforcement agencies is not actively applied. This situation arises due to subjective and objective reasons, one of which is gaps in the legislation; but we are on the way to regulating such relations. The application fields of biological traits regarding human voice and oral speech in the modern world are considered, namely: in medicine (diagnosis of many diseases), law enforcement agencies (identification of criminals, crime prevention, etc.), in customer service banking, etc. \u0000The article outlines the possibilities of voice and speech forensic diagnostics in a modern technological society in order to determine the basic socio-biological traits of a person, since one of the most common means of communication between people is still oral speech. As a special kind of human communication, oral speech is based on the psycho-physiological functions of the individual organism and personality consciousness in the framework of a particular society. The main features of forensic innovations are considered: innovativeness (novelty), objectivism, subjectivism, purposefulness, demand, practical applicability, efficiency. It is substantiated that innovation should be understood as developed, implemented and applied in practice the latest technical-, tactical-, methodicalforensic means that are the result of research or development activities, embodied in the form of a new product (production), technology, service, solutions, used by special qualified entities in practice and aimed at effectively solving forensic tasks and ensuring optimization, improving the quality and effectiveness of law enforcement practice. \u0000It’s noted that in modern realities an important course for improving the conceptual apparatus of forensic innovation is the clarification and unification of terms. The main categories of the studied theory are the concepts of “innovative forensic product” and “forensic innovation”. The analysis of the essence of these concepts gives grounds to assert that the innovative forensic product and forensic innovation are separate types of means of forensic innovation. The methodological basis for the development and implementation of forensic innovations into law enforcement are activity-based, system-structural and technological approaches, the use of which is promising for the formation of a separate forensic theory − forensic innovation. It’s substantiated that the complex approach in the development and formation of forensic innovation basic concepts is a methodological foundation for further research on this issue. It’s noted that in current realities criminalistics and each of its sections face important problems intending to study and take into consideration modern innovative achievements of science and technology, which can be effectively used while combating crime and successfully ensure urgent needs with forensic innovations in practice. The study of such records is one of the most difficult when conducting handwriting examination. This is due to the nature of this object, which is often subjected to changes due to insufficient written practice, influence of age-related changes in the body or conditions common for the elderly people and senile, frequent execution of short handwritten records in unusual conditions, and sometimes with the help of other people, limitations in the studied graphic material. The article attempts to substantiate and systematize theoretical knowledge on the study of short handwritten records executed by elderly and senile people through analyzing the literature and forensic practice on the study of this type of objects, establishing individual patterns of handwriting, explaining the nature of diagnostic signs occurrence, determining the structure of the process for solving the mentioned tasks. Cases from practice and related problematic aspects of solving identification and diagnostic tasks are considered. The main characteristics of impaired ability (sensory, amnestic and motor aphasia) to write are given. Literature sources are analyzed, which consider the physiological mechanisms of the formation of writing skills and the features of their changes due to various conditions in elderly and senile people. Handwriting can undergo changes owing to aging of the body. Disorder of hand-eye coordination, conditions of the musculoskeletal system, nervous system, circulatory disorders, inherent for elderly and senile people, affect the stability of handwriting features. Testaments, contracts of sale and donation, bank documents are often signed by people of elderly and senile age shortly before death resulting from a serious long illness after experiencing such conditions as stroke or myocardial infarction. It is the aging of the body that is accompanied by deterioration in the state of health, impaired vision, muscle weakness, depletion of the nervous system, decreased mobility of the musculoskeletal system and impaired blood circulation. Features of writing motor skill functioning in the elderly and senile people lead to a slowdown in the tempo of movement, decrease in their amplitude and speed, decrease in the plasticity of movements. The correct ratio of such signs as proficiency and coordination of movements is of great importance. In addition, short handwritten records executed by the elderly and senile people contain a limited amount of graphic material. At the moment of executing a short recording, even under normal conditions, the performer needs a certain adaptation to a situation, which can not be performed while rare or occasional execution of a single short record. Brendel","doi":"10.32353/khrife.1.2020_24","DOIUrl":"https://doi.org/10.32353/khrife.1.2020_24","url":null,"abstract":"A problematic issue that frequently arises in the examination of video and audio recordings, namely the question of visual and auditory perception of oral speech – the establishment of the content of a conversation based on its image (lip reading) – is considered. \u0000The article purpose is to analyze the possibility and feasibility of examining the visual-auditory perception of oral speech in the framework of the examination of video and sound recordings, considering the peculiarities of such research; the ability to use visual information either as an independent object of examination (lip reading), or as a supplementary, additional to auditory analysis of a particular message. The main components of the process of lip reading, the possibility of visual examination of visual and auditory information in order to establish the content of a conversation are considered. Attention is paid to the features of visual and auditory perception of oral speech, and the factors that contribute enormously to the informative nature of the overall picture of oral speech perception by an image are analyzed. \u0000The influence of the visual image on the speech perception by an image is considered, such as active articulation, facial expressions, head movement, position of teeth, gestures, etc. In addition to the quality of the image, the duration of the speech fragment also affects the perception of oral speech by the image: a fully uttered expression is usually read better than its individual parts. The article also draws attention to the ambiguity of articulatory images of sounds.
