International law offers no general rules about such regulatory effects. In practice, however, the U.S. and EU rulemaking processes are increasingly open to foreigners. In both jurisdictions regulators are obliged under domestic law to highlight certain proposed rules that have international impacts, and foreigners may in turn participate in notice and comment procedures. In addition, certain regulatory impact assessments take impacts on foreigners into account. These practices pose a puzzle: why would states willingly constrain their policy choices? Why do they seek to learn the preferences of actors outside their polity? I argue that the main rationale behind these practices is their enlightened self-interest in improving market-openness. After reviewing decisions of international administrative tribunals dealing with the notion of fairness, it shows that tribunals rely on the concept of fairness to limit discretion of decision-makers, to fill gaps in law and to override written law to ensure fairness. The article makes suggestions as to how to reconcile the different visions and roles of fairness in international administrative law. In recent decades the need for coordination has increased due to the fragmentation caused by NPM reforms, decentralisation processes, the proliferation of the cross-cutting issues, as well as increased globalisation, Europeanisation, and professionalization. The coordination problem in Croatian administration, similarly to other transition countries, is critically important but understudied. This paper is based on a preliminary research on coordination in Croatian public administration with regard to policy formulation and implementation of three policies – regional development policy, anticorruption policy and e-government policy, based on the interviews conducted with higher civil servants and public officials. A special emphasis is given to the role which various actors play in coordination, as well as the structures Government employs in order to coordinate. Para lograr este cometido se reviso el diseno institucional que inspiro la reforma a la Constitucion de 1991, que suprimio el caracter constitucional que ostentaban en Colombia tanto el servicio publico de television como el organo encargado de su regulacion. Luego, se estudio el alcance de las normas legales que se expidieron en desarrollo de lo consagrado en la reforma constitucional de 2011, disposiciones que distribuyen las competencias de la extinta Comision Nacional de Television en diferentes organos, como es el caso de la recien creada Autoridad Nacional de Television (ANTV).English Abstract: This article seeks to determine whether Colombia’s National Television Authority is a state agency that is independent from the central government and whether it possesses the institutional guarantees to independently perform its functions. To accomplish this objective, this work looks at the institutional design that spurred the 1991 Constitution, which removed television as a public service as well as the state authority in charge of its regulation. This has happened in quite a few cases handled by High Courts in the past, and in at least one recent administrative decision, even when the Supreme Court of India appears to have laid down clear principles segregating debarment and judicial proceedings as early as in 1975. Meanwhile, there has been a lot of discussion regarding the need to balance the benefits that these agreements bring. Such benefits include, efficiency through economies of scale (as one procedure can subsequently be used to award several contacts), and administrative efficiency. It is also vital to consider the risk that is associated with framework agreements, such as the significant risk for competition and lack of transparency in the award process. The latter will be the focus of this paper. It addresses the question which rules in the new Public Contract Directive (Directive 2014/24/EU) may also apply to a coordinated award of concessions or authorisations. To this end, it examines whether these rules in the Public Contract Directive on joint procurement can be considered direct consequences of general principles of EU law, thereby justifying their application outside the scope of the Public Contract Directive.
