The land dispute resolution process can be carried out by litigation or non-litigation. In the context of the implementation of land dispute resolution conducted at the Sambas BPN office, it is carried out through a mediation process (non-litigation). Based on the facts in the field in 2018 and 2019, there were many land disputes that were not resolved through mediation. This research focuses on what factors are causing the failure of mediation conducted at the Sambas BPN Office and how the legal consequences of resolving land disputes are resolved through mediation. The research uses empirical methods, and is analytical descriptive. To obtain primary data observation and unstructured interviews were conducted with respondents and sampling using purposive sampling. The results showed that: first, the factors causing the failure of mediation were the factors of the parties, the completion time factor, and supporting data factors. This legal research uses juridical normative legal research which is descriptive analytical with a conceptual approach and an invited approach. Legal materials techniques use library research (library research) and are analyzed using qualitative analysis. Based on the results of the research, it shows that the enforcement violates the corporate veil, to protect the rights of shareholders for actions carried out by company organs such as Directors and commissioners who act not in accordance with company objectives. In carrying out their duties, the Board of Directors and commissioners must be based on good faith, caution and a sense of full responsibility towards the company. If the Board of Directors and Commissioners are negligent in carrying out their duties, resulting in the bankruptcy of the company. Directors and Commissioners may be subject to the principle of penetrating the corporate veil, namely personal liability to the personal assets of the Directors and Commissioners for losses incurred by the company and shareholders. This study is a juridical empirical using qualitative analysis quantitative of data and facts in the field and supported by the approach of the legislation. The results of the study showed that the impact of a pandemic Covid-19 to the tourism sector is very visible and extraordinary, the impact negatif what happened to the tourism sector in the pandemic Covid-19, one of which is a decrease in revenue from the tourism sector this impact suffered by the offender or the Government of Kabupaten Magetan because the tourism sector is one of the post in order to increase revenue, in addition clear intensity of tourists drastically reduced. Menggunakan penelitian hukum normatif yaitu penelitian hukum yang menitik beratkan pada telaah hukum positif. Penelitian ini menawarkan penjelasan bentuk penerapan prinsip piercing the corporate veil berdasarkan Undang undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas (UUPT) terkait pertanggungjawaban pemegang saham atas kerugian perseroan. Pada perkembangan hukum bisnis di Indonesia, prinsip pertanggungjawaban terbatas para pemegang saham perseroan tetap kuat tidak tergoyahkan. perseroan sebagai suatu badan hukum tidak berbeda dengan manusia. Perseroan sebagai sebuah badan hukum merupakan suatu subyek hukum yang secara hukum memegang hak dan kewajiban. Berdasarkan perspektif subyek hukum badan usaha diketahui bahwa perseroan merupakan subyek hukum yang dapat diproses oleh hukum yang berlaku. UUPT sebagai peraturan hukum nasional Indonesia dapat dijadikan sebagai payung hukum bagi perseroan. Penggunaan sebagai payung hukum ini disesesuaikan dengan tingkat, derajat, dan peraturan hukum itu sendiri terkait daya ikat terhadap materi-materi yang dimuat dalam peraturan hukum tersebut. Perihal ini disebut sebagai konsep keadilan dan legalitas. The research questions are: 1. How is the legal protection of handmade batik implemented in Kota Kediri? 2. What are the efforts of the City Government of Kediri in helping batik artisans to obtain batik art copyright certificates in Kediri City? 3. What are the inhibiting factors for batik copyright registration in Kediri City ?. This study uses juridical empirical methods by interviewing informants and field observations. Penulis mengkaji dan menganalisis bergabagi literature, peraturan perundang-undangan dan penulisan ini bersifat deskiriptif kualitatif. This study uses empirical legal research methods, namely a legal research method that seeks to see the law in a real sense or, examine how the law works in society. Research location in Ngawi Regency.The results of the study show that why people do land pawning because some people need money in an easy and uncomplicated way due to economic needs, capital requirements for businesses, hospital expenses, education costs, marriage costs and other needs . Land pawning is carried out according to customary law based on mutual trust and enthusiasm to help between relatives, neighbors and the community. The concept of legal construction as an effort to resolve land pawn disputes can be carried out in two ways, namely non-ligation, namely through deliberation and consensus through negotiations between the parties or involving mediators namely Village Heads or community leaders who are considered capable of resolving. By using the method of normative legal research, it can be concluded that: 1. In the event of the power and value of the evidence, the evidence provided for in Article 184 Criminal Procedure Code, which is the strength of evidence of electronic evidence is free (volledig bewijskracht) and is not binding or specify ( beslissende bewijskracht). Probative value of all evidence based on the judge's assessment. Setting electronic evidence in UU ITE regulated in Chapter III of Information, Document and Electronic Signature, as well as Article 44 of Law ITE.
