Celem artykułu jest ustalenie, czy obecne unormowanie w prawie polskim miarkowania kary umownej (art. 484 § 2 Kodeksu Cywilnego) jest dostoswane do standardów, które można wywieść z ponadnarodowych regulacji prawnych, tj. Rezolucji (78) 3 Rady Europy o karach umownych w prawie cywilnym, Zasad Międzynarodowych Kontraktów Handlowych UNIDROIT, Zasad Europejskiego Prawa Umów PECL, Projektu Wspólnej Ramy Odniesienia DCFR i Zasada TransLex, a także sformułowanie wniosków de lege ferenda. W artykule używana jest metoda logiczno-językowa i prawnoporównawcza. Na początku przedstawiona została regulacja prawna miarkowania kary umownej w prawie polskim. Następnie, przedstawione zostało miarkowanie kary umownej w ponadnarodowych regulacja soft law wymienionych powyżej. W końcu została sformułowane wnioski płynące z przeprowadzonej analizy. Pomimo pewnych mankamentów, regulacja miarkowania kary umownej w prawie polskim wydaje się odpowiadać rozwiązaniom zawartym w wyżej wskazanych regulacjach o charakterze ponadnarodowym. Asłanowicz","doi":"10.31743/recl.15823","DOIUrl":"https://doi.org/10.31743/recl.15823","url":null,"abstract":"While some issues (e.g. the principles of service, the expedited procedure for resolving cases and the admissibility of securing a claim before initiating proceedings) are regulated in a manner that satisfies the requirements of 2023, other issues (e.g. the rules of holding remote hearings or the consequences of failing to meet deadlines in arbitration, in particular the deadlines for issuing an award) would require a numer of modifications and improvements. Tvaronavičienė","doi":"10.31743/recl.15707","DOIUrl":"https://doi.org/10.31743/recl.15707","url":null,"abstract":"The Mediation Directive (2008) obliged the Member States of the European Union to promote the use of mediation through their own means. A decade later, the results of several studies revealed that national efforts to foster mediation were not as effective as planned in most cases. Despite some scholars’ concerns about restricting mediation voluntariness as means for increasing its application, Italy introduced a mandatory mediation scheme which proved that forcing parties to mediate results in high numbers of mediation procedures with favorable success rates. This led other Member States to reconsider the role of the State in fostering mediation. This article tackles the prevalence of mandatory mediation in family disputes, as an area widely recognized as most suitable for it. The co-authors raised the research question of whether the introduction of mandatory mediation in family disputes is an emerging trend in the European Union. A short overview of the mandatory mediation concept and the existing doctrinal models was presented as a theoretical background of this research. Based on the review of the scientific literature, four prevailing models were identified and briefly described. Secondly, the map of mandatory mediation within the European Union was updated with the latest data collected from the most recent legislative amendments and testimonies of the corresponding national mediation experts. Thirdly, a brief examination of the current mandatory mediation models in the Member States was conducted. The in-depth analysis of the obtained results shows that introducing mandatory mediation in family disputes is a prevailing trend in fostering mediation in the European Union. Główna teza Sądu dotyczyła możliwości pracownika do dozwolonej, publicznej krytyki przełożonego tj. prawa do whistleblowingu, czyli ujawnienia nieprawidłowości w funkcjonowaniu zakładu pracy polegających na różnego rodzaju aktach nierzetelności, nieuczciwości z udziałem pracodawcy lub jego przedstawicieli, gdy nie prowadzi to do naruszenia jego obowiązków pracowniczych polegających w szczególności na dbaniu o dobro zakładu pracy i zachowaniu w tajemnicy informacji, których ujawnienie mogłoby narazić pracodawcę na szkodę (obowiązek lojalności; nienaruszania interesów pracodawcy - art. 100 § 1 pkt 4 k.p. Brak konsekwencji Sądu Najwyższego w orzeczeniu pomiędzy poinformowaniem opinii publicznej o nieprawidłowościach w miejscu pracy, a obowiązkiem lojalności pracowniczej powoduje powstanie jeszcze większych wątpliwości po stronie pracowników, chcących ujawnić nieprawidłowości. Zdaniem Autora stanowisko zajęte w sprawie nie wyjaśnia kiedy lojalność jest wiążąca dla pracownika. This has already been a subject of interest and promotion of both the EU and the Council of Europe, as European standards of democracy provide for the state’s cooperation with citizens/individuals. The question of standardization of national terminology, as well as inter- and intra-linguistic harmonization and unification of migration units is raised and substantiated. It is noted that changes in English terminology cause difficulties in national terminology due to, on the one hand, the need to find the most accurate and correct equivalent of the unit of the source language, and on the other – differences in the semantic volume of units of different languages. The article considers English terms for migrants: illegal migrant, irregular migrant, undocumented migrant. Analysis of international normative and advisory documents, as well as data from lexicographic sources of English and Ukrainian languages allow the authors to provide recommendations for the use of the Ukrainian equivalent to these terms – мігрант із неврегульованим статусом. It constitutes an appropriate foundation for the construction and functioning of the system of public economic law. It is a starting point for actions of the state and its bodies and defines the range of influence on the economy, as well as directs state activity in the economy. The premises for the participation and influence of the state on the economy which, according to the assumptions, should be both market-oriented and responsive to social needs, result from the principle of a social market economy. The objective so outlined should be pursued through the rules of public economic law and the legal constructions and institutions introduced in this normative area.
