Yet a different outcome at that trial might have forced higher courts to consider to what degree the fine arts enjoy protection under the first amendment, an issue that has been curiously neglected in the evolution of freedom of expression. First amendment protection of artistic expression and several related questions affecting both free expression generally and academic freedom in particular deserve more attention than they have received. Such institutions therefore play a crucial, central role in the nation's cultural and economic life, for it is in them that the nation's future is born. To the extent to which they do not welcome new ideas, their threefold purposes cannot be well accomplished, and the future that grows out of them is stunted. As the AAUP's later 1940 Statement of Principles on Academic Freedom and Tenure put the point, in brief: \"Institutions of higher education are conducted for the common good [,which] depends upon the free search for truth and its free exposition.\" 3 But on some views, institutions of higher education are failing to serve as intellectual experiment stations: they are charged with behaving like homes of orthodoxy, reaction, and conventionality. Feminists complain that institutions of higher education are dominated by male-inspired conceptions of what constitutes good scholarly work, and that the content of teaching makes women's lives and women's work at best invisible. Feminists are joined by scholars in Afro-American Studies in complaining that the literary canon these institutions place before their students is at best arbitrarily restricted to the products of white males-I say \"at best arbitrarily,\" since on some views the canon is a product merely of white male bigotry. In this bibliography, I have concentrated on articles about academic freedom at a post-secondary level. There are some articles concerning the academic freedom of universities, but most deal with professors. Because this issue celebrates the fiftieth anniversary of the 1940 Statement of Principles on Academic Freedom and Tenure, I have examined publications only from 1940 to the present. The books included are those that focus mainly on academic freedom, rather than those with only a small section on that topic. The articles deal with the legal aspects of academic freedom, and almost all are from legal periodicals.' All materials are in English and concern academic freedom issues in the United States. Within the criteria stated above, I have tried to be comprehensive in my search for materials. I have searched both through the legal journal indexes and through the footnotes of the articles themselves. Omitted entirely are articles about specific challenges to academic freedom reported on in the journal of the American Association of University Professors, at different times called Academe and the AA UP Bulletin.
