Pengelolaan zakat berdasarkan hukum positif yang terlampir dalam UU RI NO 41 TAHUN 2004, menerangkan bahwa lembaga wakaf sebagai penata keagamaan yang memiliki potensi dan manfaat ekonomi perlu dikelola secara efektif dan efisien untuk kepentingan ibadah, terciptanya keadilan dan untuk memajukan kesejahteraan umum. salah satu firlantropi yang masih diperbaiki di sektor kebijakan publik dan memperdayakan masyarakat adalah dengan cara memperbaiki disektor wakaf tunai (cash wakaf). wakaf uang (tunai) dalam PMA ini diartikan sebagai perbuatan hukum wakif untuk memisahkan dan atau menyerahkan sebagian uang miliknya untuk dimanfaatkan selamanya atau untuk jangka waktu tertentu sesuai dengan kepentinganya guna keperluan ibadah dan atau kesejahteraan umum menurut syariah.Perbedaan ulama’ tentang boleh atau tidaknya wakaf uang terletak pada illat objek wakaf itu sendiri. Sehingga benda yang hanya diperbolehkan untuk diwakafkan adalah benda yang bersifat abadi. para ulama’ salaf lebih menekankan keabadian mauquf dari eksistensi bendanya, namun menurut ulama’ khalaf dan madzhab hanafiyah lebih menekankan keabadian manfaat, meskipun barangnya dapat berupa uang atau benda yang memiliki manfaat lainnya. Karena tujuan utamanya adalah untuk mendapatkan manfaat yang lebih besar dari asal mauquf itu sendiri. Jenis penelitian ini adalah kualitatif dengan kajian kepustakaan (library research). Library research diartikan sebagai kajian atau penelitian terhadap sumber-sumber kepustakaan serta menggunakan bahan-bahan tertulis dalam bentuk buku-buku yang berkaitan dengan fokus penelitian ini. Which regulates the implementation of the education function, the function of da'wah and the function of community empowerment. With the issuance of this law, it is a breath of fresh air for the role of Islamic boarding schools in providing educational services, building and maintaining the Unitary State of the Republic of Indonesia as a field of da'wah in maintaining the traditions and teachings of Islam rahmatan lil'alamin. Islamic boarding schools under individual policies led by a figure (kyai, Habib, ust and others) organize and formulate education optimally in accordance with the characteristics and peculiarities of the pesantren, not only educating, teaching, preaching, and training students according to Islamic rules. However, Islamic boarding schools are required to be independent, one of the efforts to encourage this independence is through the establishment of the Pesantren Business World. With the existence of this pesantren-owned business, students are prepared to enter the community by bringing religious knowledge and general knowledge, so they are not rigid in entering the world of business, business, culture and others. Humanitarian tragedies in the form of accidents, operations, etc., almost certainly require assistance and the availability of adequate blood. Such events should arouse the feeling and spirit of human solidarity. Unfortunately, information about the benefits of blood donation for humanity and health has not been well communicated. In the polar literature at-Turats found a chapter that specifically discusses the law of donors and blood transfusions. With the various honors of the principle of good deeds to others using the blood donor media, Muslims in general need a more detailed and systematic reconceptualization of the decisions of Syara' law related to the practice and dynamics of the medical world. Therefore, this research will answer the following problem formulations, (1) what are the views of the fuqaha on the law of blood donation?, (2) what are the views of the fuqaha on the law of blood transfusion? And (3) What is the law on buying and selling blood for blood transfusion needs? To answer some of the problem formulations above, the researcher uses a type of research that adopts some qualitative research techniques that are library research, namely reviewing and researching library sources, in the form of fiqh books by contemporary fiqh scholars related to the theme discussion. The data collection technique used by the researcher is documentation technique because this research is library research. After the data is collected, it is analyzed by following the mile and hiberman analysis model and added with content analysis. This study produced three answers as a follow-up to the problem formulation that was made at the beginning of the discussion. First, contemporary fiqh scholars differ on the law of blood donation. In ikhtiyar conditions, the law of blood donation is prohibited. Meanwhile, in an emergency, they agree that it is permissible. Second, blood transfusions are not allowed because blood is an unclean object. However, if you can save human life, then yes.
