Apabila jangka waktu tersebut diabaikan maka akan menimbulkan beberapa akibat hukum terhadap akta peralihan tersebut.Maka untuk lebih terjaganya ketertiban dalam proses pendaftaran peralihan hak atas tanah di Kantor Pertanahan Kota Banjarmasin dan juga agar pihak-pihak yang bersangkutan tidak di rugikan harus adanya sanksi tegas agar PPAT di Kota Banjarmasin tidak melakukan lagi pelanggaran tersebut, karena didalam peraturan itu sendiri sudah mengatakan bahwa hal tersebut adalah “wajib” bagi PPAT. The research method that is used is a normative juridical approach which analyzed based on the jurisprudence. Based on Indonesian positive law, the citizen who in the transnational marriage without prenuptial agreement, the rights status of his/her land in the form of property acquired jointly be equalized to his/her partner is only the rights to use. Meskipun bersifat  final tetapi masih dapat diajukan permohonan pembatalan ke Pengadilan Negeri Maupun Mahkamah Agung. Dalam Undang-Undang Nomor 30 tahun 1999 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa. Makna teleologis Pasal 60 UU No 30 Tahun 1999 menyebutkan putusan arbitrase yang sifatnya final, berkekuatan hukum tetap dan mengikat dapat diterima oleh para pihak yang bersengketa tanpa adanya upaya permohonan pembatalan di kemudian hari. Sementara itu Pasal 70 memberikan kesempatan untuk mengajukan permohonan pembatalan ke Pengadilan Negeri maupun ke Mahkamah Agung. Meskipun putusan arbitrase dapat diajukan permohonan pembatalan, hal ini tidak menghilangkan sifat mengikat dan berkekuatan hukum tetap terhadap putusan arbitrase, tetapi belum final karena masih dapat diajukan permohonan pembatalan. Kesimpulan, pengaturan hukum arbitrase yang seharusnya sesuai dengan tujuan dan fungsi dasar hukum yaitu putusan arbitrase yang menciptakan kepastian hukum, keadilan hukum, dan kemanfaatan hukum, dan tujuan arbitrase menciptakan prinsip benefit solution akan tercapai dengan baik. This research uses doctrinal law research done or aimed at a concept that will be studied which is the concept or principle of fast, simple and low cost trial in relation with the authority of Honorary Notary Assembly to the checking of Notary in criminal justice process. The basic rationale of the existence of this NHA is the effort to enforce the obligation to deny or deny notary rights (the obligation to conceal the contents of the deed). Thus, the NHA’s approval as a opening “key” to the obligation of Notaries public when facing the complicated legal process. Legal protection of notary as regulated in Article 66 paragraph (1) law of the Repulic of Indonesia concerning Position of Notary (LPN) is a legal protection to notary public as a public official who is performing its task and obligation in carrying out government authority to keep the state documents in the form of authentic deed. The request for approval from NHA is not only done by the investigator at the stage of investigation, but will also be requested again by the prosecutor for the prosecution and by the judge for the court hearing not in accordance with one of the principles in the criminal justice process that is fast, simple and low cost court principle. For the seizure of the copy of the minuta deed and the summon to the Notaries must first the investigator, the prosecutor and the judge send the application for approval to NHA. Anggota tubuh manusia seperti wajah, hidung, lidah, pita suara, paha, payudara,pantat, atau anggota tubuh manusia lain bagi kalangan artis, atlit, atau pemusik merupakan hal yang perlu dijaga, dirawat, dan dipelihara demi penampilan dalam pertunjukan atau berlaga. Beberapa perusahaan asuransi di Indonesia mulai menawarkan asuransi anggota tubuh manusia ini dengan premi yang termahal. Untuk itu perlu ditelaah keberadaannya asuransi anggota tubuh manusia berdasarkan asas indemnitas dalam peraturan perundang-undangan perasuransian di Indonesia. Demikian pula menelaah nilai uang pertanggungan dan ganti rugi yang diberikan kepada tertanggung dalam asuransi tubuh manusia tersebut. Peraturan perundang-undangan perasuransian di Indonesia belum mengatur secara eksplisit aturan perjanjian asuransi bagian tubuh manusia. Keberadaan perjanjian asuransi bagian tubuh manusia ini selain merujuk pada asas kebebasan berkontrak, juga merujuk pada ketentuan Kitab Undang-undang Hukum Dagang dan Undang-Undang Nomor 40 Tahun 2014 tentang Asuransi. Dengan ketidakterpaduan pengaturan perizinan tersebut, maka masing-masing sektor memiliki kewenangan sendiri untuk mengatur persyaratan, prosedur, waktu dan biaya pengurusan perizinan. Melalui pendekatan perudang-undangan dan konseptual, peneliti mengkaji p roblematika perizinan dalam kegiatan pertambangan yang memberikan celah terjadinya tindak pidana korupsi tersebut . Ketidakterpaduan membuat proses penerbitan izin pertambangan yang panjang dan rumit. Pengadaan barang modal memerlukan dana yang besar. Langkah yang biasa diambil oleh perusahaan untuk memenuhi kebutuhan barang modal adalah dengan menyewa kepada perusahaan pembiayaan seperti leasing. Dalam perjanjian leasing, kepemilikan atas barang modal berada pada Lessor (perusahaan pembiayaan), lantas apa perlunya Lessor mengikat Lessee dengan jaminan fidusia. Tujuan penelitian ini adalah untuk mengetahui karakteristik dari perjanjian leasing dan untuk apa obyek leasing diikat dengan jaminan fidusia. Metoda yang digunakan adalah jenis penelitian hukum normatif yaitu penelitian yang mengacu pada norma - norma yang terdapat dalam peraturan perundang-undangan dan dokumen kontrak leasing yang banyak digunakan di perusahaan leasing. Hasil penelitian menunjukkan bahwa perjanjian leasing memiliki karakteristik khusus karena didalamnya mengandung 3 (tiga) jenis perjanjian yaitu perjanjian jual beli, perjanjian sewa menyewa dan perjanjian sewa beli. Irawan","doi":"10.32801/LAMLAJ.V3I1.64","DOIUrl":"https://doi.org/10.32801/LAMLAJ.V3I1.64","url":null,"abstract":"The aims of this research are to analyze the consept of ownership of the land right ownership which constitutes marital property based on the legal regulation on the certificate which mentions the name of the party, and to analyze the legal consequence of the ownership of the land right which contitutes marital property in case in the Land certificate it is stipulated then names of both parties. Government Regulation Number 24 of 1997 concerning Land Registration states that land right can be possessed individually or jointly. It can be owned by more than one person, it can be under the name of a family, two persons not from one descent, and by marriage tie. Land ownership in a marriage tie is called marital property, regulated in article 35, article 36, and article 37 of Act Number 1 of 1974. It can be in a form of a property owned by one of the party and then marged into the marital property as well as the property obtained during the periode of the mariage. To sell such land the husband or the wife must get approval form the spouse. Article 92 of Islamic Law Compilation ( KHI ) stipulates that the husband or wife is not permitted to sell the marital property without the approval of the other party. The problem which often araises with regard to the marital property in a form of land is the fact that the land is registered under the name of the husband or the wife. As long as the couple still live in harmony there will no problem. But when they are divorced, the land is dominated by the party whose name is regitered in the certificate. This problem will not happen if the marital land is registered under the name of the husband and the wife jointly.
