Recently, however, programs of city development and migration policy are suggesting that German cities should give up their policies of desegregation and start to view migrant districts as productive sites of “diversity” featuring resources for the “local economy” and “civil society”. The paper argues that the effects of this shift in policies may be twofold: on the one hand, neoliberal forms of governance result in the delegetimization of national-social (i.e. ethno-centric) conceptions of urban order and thereby of a systematic notion of urban state-racism in Germany. On the other hand the details of the new strategies show how the conceptions of “ethnicity”, migrant “networks” or “economies” are to be managed as orders of resources and risks. It scrutinizes and criticizes the patriarchal homology between political and private father figures (Filmer vs. Locke), casts light on the political bearings of sympathetic rela- tions which are modeled based on maternal love (Adam Smith and Condorcet), and examines the revolutionary ideal of fraternity (Friedrich Schiller). The author distinguishes symbolic (paternal), synergetic (fraternal) and sympathetic relations and analyzes their bearings for modern democracies. He takes issue with the liberal separation between the private and the political, as it tends to lose sight of the marked correspondences between these spheres. He also questions the conservative idea of a family compensating for the discontent in the public realm. Theory is dominated by liberalism and its insistence on interests, reason, rights, individualism, and the social contract. Movies - and the social imaginations of the political they mirror - turn out to be completely different: Instead of interests, we find love, instead of the contract, we find sacrifice, and instead of the individual, we find the family. According to Luhmann, each subsystem of society possesses a specific mode of relating to past and future events. Law has a specific temporality that is characterized by its orientation to the past: it deals with deeds done in light of laws already set in place. Luhmann suggests that considerations of future risks are at odds with the temporality of law. Following this idea, it will be argued that future orientated measures such as preventive detention and the doctrine of preemptive warfare introduce the legal exception into law itself. Both cases exhibit different rationalities of relating to an uncertain, potentially threatening futures that collide with law’s proper temporality. Whereas preventive detention relies on the 19th century idea of the probable crime as incorporated into a ‘dangerous individual’, the preemptive strike thrives on the post-probabilistic anticipation of the unexpected. Both measures indicate the erosion of law’s capacity to sustain an indifferent attitude towards the future. Consequently, both measures thwart law’s retroactivity, albeit in different ways. Emerging systems of governmental control gain an irrefutable persuasiveness by coupling the necessity of safeguarding private spheres with public security demands and by referring to a mentality of personal civic responsibility and charity. In contrast to political romanticism (Adam Muller and others), Buchholz orients himself not toward the English system of representation, but toward the French model, to combine revolutionary popular sovereignty with representative government. Using the example of English public debt in the 18th century, he develops the political dialectic of materialist necessity and arbitrary contingency. Whereas sovereignty without representation in the maintenance of public credit inevitably leads to Jacobin Terror, parliamentarian representation without sovereignty leads to, in the English model, a general state of war. A brief case study on recovery planning in New Orleans in the aftermath of hurricane Katrina has shown how, in a situation of destruction, disorientation and uncertainty, recovery planning was intended to create the impression of a reliable framing for individual decision making on return and reconstruction. Here, planning appeared as pro-active design, with flood prevention as a necessary and centrally assessable element. However, in the course of time and within a number of successive planning processes, it was precisely the attempt to model New Orleans’ future on a centralized, expertise- driven approach of reconstruction that provoked strong criticism. Snatched advice and rare texts suggested an open-ended approach rather than limited hypothesis. The anthropologist's first weeks of chronological narrative without selection of relevance, vindicate a holistic perspective. Details reveal themes prophetically to emerge as central. There are glimpses of individuals who were to play continuing or passing, dramatic roles in the years to come. Fieldnotes both reveal and conceal. Entwined with experience and analysis, they are later transformed as texts. Fieldwork reveals embedded systems inaccessible through the quantifiable. The Leipzig Forum Tsiganologische Forschung has collected data which can be explained by a paradigm of order and para-order, two systems of thinking and doing closely connected and interdependent, but in an asymmetric way. comparable with the relation of mother and daughter.
