Humanitarian intervention and use of force both are highly controversial yet widely accepted. This paper will evaluate whether humanitarian intervention is legitimate under international law. Humanitarian intervention contradicts the United Nations Charter but state practice developments since the Second World War have made it legitimate under a number of circumstances. Those who have argued for its legitimacy cite international norms and state practice to support the assertion that the provision for military aggression is no longer what is enshrined in the UN Charter. It explores the ability of interpretive theories to capture the conceptual characteristics of the normativity of law. The normative guidance the law provides is characterised in terms of normative claims. Normative claims are construed as being based upon linking up expectations with practical reasons. The analysis lays out the conditions of providing normative guidance with the help of drawing a distinction between the success and efficacy of normative claims. The success of normative claims is explained in terms of their substantive justificatory background and the competence of those making them. Mazza","doi":"10.1556/AJUR.54.2013.2.2","DOIUrl":"https://doi.org/10.1556/AJUR.54.2013.2.2","url":null,"abstract":"The article examines the new trends of Hungarian constitutionalism, which have been realized in the new Fundamental Law and that raises some questions with regard to, among other things, the hierarchy of sources of law. Especially the cardinal laws have been the subject of criticisms both within the Hungarian doctrine that by experts in constitutional law and international organizations in the Western world. From the point of view of comparative constitutional law, it should be noted that reinforced laws are provided in many constitutions, in both Western and Eastern Europe. In order to better understand the role of cardinal laws is useful to consider, first of all and in addition to the new Fundamental Law, the system of pre-existing organic laws of Hungary. The decrease of the security deficit by the control of immigration flow consists of three endeavours: the common border control policy, the common visa policy and the common asylum policy. The aim of this paper is to analyse and evaluate the development of the operational management of large-scale IT systems in the area of freedom, security and justice. The development process of these systems is not more than their integration into the so-called IT Agency. This new regulatory agency was established in January 2012. Thus, legal scholarship has formulate alternative conceptual schemes to frame the fragmentation of the new global legal order. In the paper, I focus on the two typically antithetical approaches of legal pluralism and global constitutionalism. Legal pluralism emphasizes the diversity and the multiplicity of the global legal realm, while global constitutionalism is traditionally related to concepts of unity and hierarchy, whose paradigmatic reference is the state. The aim of the inquiry is to establish a theoretical basis and provide the conceptual tools to reconcile the two opposite approaches, first describing the main traits of each model, and then hypothesizing a hybrid model of plural constitutionalism. It offers an account and a comparative analysis of the three appointment models: the split, the collaborative and the parliamentary model, discussing their practical application and shortcomings. In particular, the paper deals with the question of how to avoid standstills in the different appointment procedures and with the publicity of these procedures. Firstly, it gives a short introduction to the biological background of cloning, where special emphasis is laid upon the method of “somatic cell nuclear transfer” in connection with the existing forms of assisted reproductive technologies. The essay analyses the legal regulation in Hungary, Germany, England and the United States, and argues that the statutory prohibition of reproductive cloning often does not correspond to the biological facts, and this terminological ambiguity may lead to legal obscurity. We wish to find an answer to the question whether the right of reply constitutes a limitation to the freedom of the press or if it is to be understood as a means of exercising freedom of opinion (or both, perhaps). We shall also try to identify the common foundations of the regulation of the right of reply and its general, or at least, most common, manifestations in Europe. According to our preliminary hypothesis, the right of reply is a legal instrument serving both the person whose (personality) rights have been violated (the applicant in the legal procedure) and the public wishing to access a wide variety of information via the media. This essay aims to give a definition of the judicial independence principle in the People’s Republic of China. To this end the author describes the general understanding of the principle within the Western legal tradition, stressing the importance of different guarantees embraced within given societies. Due consideration is given to judicial tenure and the appointment and salaries of judges.After an historical introduction this understanding is used as a yardstick to gauge the Chinese system.
