Tác giả bài viết phân tích vai trò của tổ chức thi hành pháp luật, đề xuất ba trong số các giải pháp về hiệu quả tổ chức thi hành pháp luật của các cơ quan hành chính nhà nước đảm bảo quyền lợi ích và phát huy vai trò trung tâm, chủ thể của nhân dân ở Việt Nam hiện nay. Điều này dẫn tới sự cạnh tranh gay gắt của ngành công nghiệp ô tô giữa các quốc gia có liên quan cũng như sự xuất hiện của các tranh chấp về ô tô trong khuôn khổ WTO. Việc nghiên cứu các tranh chấp về ô tô trong WTO là cần thiết, đặc biệt trong bối cảnh Việt Nam đứng trước nguy cơ bị kiện ra WTO khi dành nhiều chính sách ưu đãi cho ngành ô tô nội địa. Khi đó, vấn đề bồi thường của Nhà nước đối với nhà đầu tư trước khi tiếp nhận công trình dự án là một vấn đề cần được dự liệu trước. Bài viết sẽ tập trung phân tích một số khía cạnh liên quan đến vấn đề này, bao gồm những vi phạm của nhà đầu tư dẫn đến chấm dứt hợp đồng PPP, việc bồi thường của Nhà nước đối với nhà đầu tư và những cân nhắc của Nhà nước khi quyết định chấm dứt hợp đồng. This demonstrates efforts of the parties to enhance trust, prevent conflicts, and create a favorable environment for dispute settlement. The conclusion of bilateral and regional agreements, however, also raises concerns over possible implications for the compulsory dispute settlement mechanisms under the 1982 United Nations Convention on the Law of the Sea (UNCLOS) as UNCLOS contains provisions that enable bilateral and regional agreements to preclude its compulsory procedures. This paper will look into the compulsory nature of UNCLOS dispute settlements mechanisms. It will then examine the conditions for bilateral and regional agreements to preclude UNCLOS compulsory dispute settlement mechanisms. China is facing a serious water pollution situation. In order to reduce water pollution, China has implemented a wide range of policies to reduce and control water pollution. Vietnam is a country with remarkable similarities with China in terms of political institutions as well as economic development. Notably, two major river systems of Vietnam, the Red River and the Mekong River both originate from China and directly affect the water environment in Vietnam. The theory of planned behaviour was applied in this research to find out the influences of three factors on the criminal decisionmaking process and situational factors that influence that process. This has imbalanced the interests of both parties in the transaction to a certain extent, as well as seriously affected equality and social justice. This article studies the impact of information exchange, disclosure and transmission in the case of information asymmetry from the perspective of economic efficiency of the transaction on the basis of classification of productive information and functional wealth distribution. Viet Nam’s land law has been significantly improved since its economic reform starting in 1986, and made a great contribution to the enhancement of the security of farmers’ land-use rights. However, in a transition to a modern economy as emerging in Viet Nam, there remain challenges to the security of farmers’ land-use rights such as limitation of arable landholding ceiling, unnecessary procedural provisions of renewals, and no clear-cut transition to modern thinking of law-makers for land use management.
