It provides a closer look at the obligations associated with the travelling with the pet animals between the Member States or between the Member State and the third countries. It is focused on non-commercial transportation of pets, as vacation, trip, etc. Contribution by the means of synthesis, analysis and comparison offers an overview of the fundamental EU legislative acts in the fi eld in question. It also addresses the issue of pet passports, the most important identifi cation document, required for pet animals at the EU territory. Defi nitions of the frequently used terminology are listed. Abstrakt Prispevok sa zaobera otazkou, ktoru často riešia majitelia spoločenskych zvierat vo všetkych členskych štatoch EU. Poskytuje bližši pohľad na povinnosti spojene s cestovanim so zvieraťom medzi členskymi štatmi, alebo medzi členskym štatom a treťou - nečlenskou krajinou. Zameriava sa na nekomerčnu prepravu, ako je napriklad dovolenka, vylet a podobne. Praca prostrednictvom syntezy, analyzy a porovnania ponuka prehľad zakladnych legislativnych aktov v predmetnej oblasti. Venuje sa tiež otazke tzv. pet pasu, najdoležitejšieho identifikačneho dokladu, vyžadovaneho pre spoločenske zvierata na uzemi EU. The Directive introduces the common admission standards with simplifi ed entry procedures and the prospect of returning in a subsequent season in the sectors which are identifi ed seasonal - most notably agriculture, horticulture and tourism - where work undertaken mostly by third country nationals. As safeguards against economic and social exploitation the Directive also establishes a common set of rights to which third country seasonal workers are entitled during their stay, which, at the same time, also protects EU citizens who are seasonal workers from unfair competition. Today, Hungary is not a target country for seasonal employment. The Directive not only gives an obligation to the Member States but also gives a good chance to make their country more attractive for temporary migration Abstrakt Smernica tykajuca sa sezonnej prace tvori sučasť sektorovej imigračnej politiky EU, nakoľko po nekvalifi kovanej pracovnej sile v ramci EU jestvuje permanenty dopyt. Smernica zavadza spoločne normy so zjednodušenymi postupmi pre vstup a lepšie vyhliadky na navrat v nasledujucej sezone v odvetviach, ktore su označene ako sezonne - v najvačšej miere je to poľnohospodarstvo, zahradnictvo a cestovny ruch - kde sa vo veľkej miere uplatňuju štatni prislušnici tretich krajin. Ako ochranu proti hospodarskemu a socialnemu vykorisťovaniu, smernica zavadza prava, na ktore maju narok sezonni pracovnici z tretich krajin počas ich pobytu, a ktore pred nekalou suťažou chrania tiež občanov EU pracujucih sezonne. V sučasnosti Maďarsko nie je cieľovou krajinou pre sezonne prace. Logical foundation of the approach is based on 7 key features, which should be horizontally presented throughout the whole delivery mechanism. That is why the presented paper is oriented on answering the research question: to what extent was delivery mechanism of LEADER (at the level of managing authority and local action groups) during the programming period 2007-2013 supporting the implementation of 7 features of LEADER approach. In order to fulfi l the stated objective there must be individual steps of delivery mechanism defi ned at both levels, consequently all the features of LEADER approach were described and the criteria of success - benchmarks were determined. Mutual linking of these steps resulted in creation of an implementation matrix what represents a visual outcome of the study. Abstrakt Pristup LEADER je jednym zo zakladnych pilierov sučasnej politiky rozvoja vidieka realizovanej na europskej urovni. Logicky zaklad pristupu LEADER je postaveny na 7 kľučovych znakoch, ktore by mali byť pritomne prierezovo v ramci celeho implementačneho procesu. Preto cieľom prispevku bolo zodpovedanie vyskumnej otazky: do akej miery implementačny mechanizmus programu LEADER (na urovni riadiaceho organu aj miestnych akčnych skupin) v programovom obdobi 2007-2013 podporoval dodržiavanie siedmych zakladnych znakov programu?“ Pre naplnenie cieľa prispevku bolo nevyhnutne určiť jednotlive kroky implementačneho procesu na oboch urovniach, nasledne popisať jednotlive znaky a definovať kriteria uspechu - benchmarky. According to this law the owner of the agricultural land in Slovakia may, without further restrictions, transfer the agricultural land only to (a) a buyer who has been active in the food business or exercises agricultural activity („Farmer“) in the municipality where the agricultural land is situated for at least three years prior to the transfer; (b) the existing co-owner of the agricultural land; or (c) persons related to the owner, in the event that the owner is a natural person Abstrakt Príspevok analyzuje vývoj právnej úpravy devízového zákona vo vzťahu k nadobúdaniu pôdy cudzincami vrátane nového zákona č. 140/2014 Z.z. o nadobúdaní vlastníctva poľnohospodárskeho pozemku a o zmene a doplnení niektorých zákonov, ktorý vstúpil do platnosti 1. Júna 2014. Tento zákon neobmedzuje len nadobúdanie pôdy cudzincami, ale aj občanmi Slovenska. {"title":"Rights to Designaton Focusing on Protected Designations and Geographical Indications of Agricultural Products and Foodstuffs","authors":"Zuzana Ilková","doi":"10.2478/eual-2014-0008","DOIUrl":"https://doi.org/10.2478/eual-2014-0008","url":null,"abstract":"Abstract The paper deals with the issue covered by the field of industrial property, it deals with the right to designation, especially with characteristics of legal regulation of labeling of products with regard to their geographical origin at the Slovak, communitarian and international levels. Individual objects of the industrial property may be the result of intellectual creative activity of its creator/creators (e.g. inventions, utility models, designs) or they are not the result of creative activity of a particular natural person and are considered as industrial property rights to designation. The group of rights to designation includes: business names, trademarks, designation of origin for products and geographical indications for products. The rights to designation, inter alia, shall ensure uniqueness and competitive advantage for entrepreneurs and easy identification on the market of goods and services for the consumers. The paper closely analyzes the harmonized legal regulation of designations of origin and geographical indications of agricultural products, foodstuffs, spirit drinks, and wines. Based on the results of the analysis we found out that structure of land tenure in Uzbekistan before 1917 was different. After the implementation of the agrarian reforms in December 1925 by Soviet government, the land was nationalized in Uzbekistan. However, during transition period the structure of land tenure after the establishment of new land reforms was significantly diversified in Uzbekistan. Success of the land reforms is very important for Uzbekistan in providing stable growth in the country. Effective regulatory approximation in the SPS field was critical to anchoring the reform process in Ukraine and to fostering further progress in EU’s relations with this Eastern Partnership (EaP) country. This paper highlights three major problems in Ukraine that were hindering reform in the SPS field: inconsistency between Ukrainian and EU food safety legislation, lack of uniformity between animal health law regimes, absence of a single SPS regulator. Legal implementation of approximated legislation still remains as key challenge. The intellectual property law is regulated outside the Civil Code, in special codes and laws. The intellectual property law is one of them. The intellectual property law provides legal protection to various intangible assets which are the results of the creative intellectual activities of individuals.
