No longer constrained by the relative size of their server network or budget limitations, businesses are taking advantage of cloud computing’s promise to access previously unimaginable computing resources. The film industry in particular has taken advantage of the increased capabilities offered by cloud computing. This recognition has begun a transformation that has spread from major Hollywood studios to smaller independent production companies. Major studios are turning to cloud providers for the creation of Computer Generated Image (CGI) blockbusters, while independent filmmakers are taking advantage of cloud computing’s low costs to create and distribute their films. I argue that the act is constitutional and that if society believes the collection of DNA from arrestees violates an individual’s privacy, it should seek legislative resolution and not seek the protection of the Fourth Amendment of the Constitution. Throughout my analysis, I demonstrate why DNA collection is constitutional and how it is necessary. Part I of this article examines the history of DNA sampling, case law establishing an arrestee’s expectation of privacy, and the applicable Fourth Amendment tests. Part II examines the arguments for and against DNA sampling by considering case law at the state and federal level, and explores the significance of junk DNA and the treatment of abandoned DNA. Part III is the personal analysis section, which argues that the totality of circumstances test is the proper test. I apply the test to determine that there is minimal intrusion of an arrestee’s expectation of privacy through DNA sampling, a legitimate governmental interest, and that warrants are unnecessary. Further, the section demonstrates why DNA sampling is a natural progression from fingerprint collection, and the section analyzes abandoned DNA and DNA sampling. Senthe","doi":"10.5195/TLP.2012.106","DOIUrl":"https://doi.org/10.5195/TLP.2012.106","url":null,"abstract":"Considered a lifeline, and a convenience, a mobile phone has now acquired another transformative dimension within the microfinance context.  As a result of the proliferation of mobile banking in emerging markets and developing countries, microfinance institutions (“MFIs”) have adopted similar technological enhancements to deliver microfinance products.  This paper will explore how emerging technology advances has altered the contours of microfinance, specifically mobile banking (also known as “m-banking”) which is utilized to facilitate efficient financial services to a vast number of people without access to the formal banking  system and financial services, otherwise known as the “unbanked”.  This discussion offers a snapshot of the current state of mobile banking, and examines the kaleidoscopic approach used by microfinance institutions through several auxiliary considerations.  Part I examines the underlying rationale in employing a cashless banking paradigm and illustrates how mobile banking is administered institutionally.  Part II seeks to highlight the regulatory considerations intractable within the mobile banking discourse, and is intended to provide a survey of the current regulatory landscape, and finally, Part III focuses on uncovering the consumer perspective, and calls for a conceptual refinement in the interconnection of the social context within mobile banking. {"title":"THE \"LEGAL EPIDEMIOLOGY\" OF THE TEEN SEXTING EPIDEMIC: HOW THE MEDIA INFLUENCED A LEGISLATIVE OUTBREAK","authors":"Kimberlianne Podlas","doi":"10.5195/TLP.2012.91","DOIUrl":"https://doi.org/10.5195/TLP.2012.91","url":null,"abstract":"This article considers the media‟s impact on the “legal epidemiology” of the teen sexting epidemic.  Here, “teen sexting epidemic” refers to two things: (1) the belief that sext messaging by teens is rampant and spreading, hence, is an epidemic; and (2) the process by which a piece of information spreads like a virus, came to be understood as a pathogen infecting teens, resulted in a rash of child pornography prosecutions, and erupted into an outbreak of sexting legislation, hence, the epidemiology of the legal issue.  This article argues that the media was both a carrier of this virus, in that it communicated the information and conceptual frameworks that formed the public‟s knowledge base of sexting and its legal implications, and a host environment in which forces interacted and transformed.  To better understand the media‟s role, this article includes an empirical analysis of the past five years of media coverage of teen sexting, and identifying both its temporal and topical trends.  With this quantitative and qualitative base, the article then analyzes the relationship between coverage and the progression of the teen sexting epidemic from a social issue to a legal issue and, ultimately, to an outbreak of “curative” legislation.  In doing so, it focuses on the child pornography prosecutions of teen sexters, the media‟s criticism of that course of action, the reincarnated stories of sext-related suicides, and the nation‟s recent sext-related legislation.","PeriodicalId":185385,"journal":{"name":"Pittsburgh Journal of Technology Law & Policy","volume":"109 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2012-04-13","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"123149228","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It also compares two earlier articles on the same topic, and argues that the intellectually pure conclusion is that every transaction in virtual worlds creates a taxable event. While the article concludes that the events are taxable, it argues that similar to frequent flier miles, the income from a virtual transaction should not be taxed until it is converted to real world currency. The IRS has implemented Section 6050W designed to require companies like PayPal to report the transactions of their biggest customers.
