It unpacks the ‘Countering Violent Extremism’ frame-work from a freedom of expression standpoint and analyses court decisions related to glorification of terrorism and incitement to hatred with a particular focus on France and the United States as well as Russia, and Scandinavia. It shows the determination of governments to tackle the non-violent “ideological” bases of “terrorism”, and to treat religion as largely a public order issue. It describes, and draws lessons from, the 19th century blasphemy case against the British Freethinker newspaper, whose “technique of offense” was similar to that of Charlie Hebdo. It engages questions on the meaning and history of cartoons, as well as freedom of expression, to find a new pathway beyond the parameters of the current debate. In particular, it asks why the protection of freedom of expression on Europe became contingent on drawing cartoons of the Prophet Mohammad. Rather than assigning a role for law in preventing such cartoons, or for freedom of expression in protecting them, it argues that desisting from drawing them would have no discernible impact. It highlights other means by which cartoons and comics can advance the human rights discourse, including pioneering comic’s authors in this regard. Strand","doi":"10.1163/18710328-12341285","DOIUrl":"https://doi.org/10.1163/18710328-12341285","url":null,"abstract":"The reasoning and conclusions reached by the European Court of Human Rights in cases against some Member States that involve prohibitions against the wearing of religious clothes and symbols in public educational institutions have led scholars to argue that introduction of similar prohibitions in other Member States will be in conformity with the Convention. By broadening the spectrum of relevant case-law, this article will argue that the wide margin of appreciation often referred to, conceals that the strictness of review may vary considerably depending on the circumstances of each case. The principle of equal treatment of religious manifestations is introduced as a norm that influences the strictness of review. Recognizing for the first time that private companies are (legal) “persons” exercising religion, the Court declared that the Mandate violates their religious freedom and exempted them from covering contraceptives. The article argues that the restrictive interpretation of the Religious Freedom Restoration Act (rfra) here proposed, by granting strong protection to corporations’ religious claims over their employees’ interest in equal access to health care, may lead to the proliferation of religious accommodations far beyond this controversy. Eweida and Others v. the United Kingdom is scrutinised and it is argued that this suggests three possible ways of dealing with cases where an employee refuses to carry out certain parts of their job because of their religion or belief: using the “free to resign” rule; imposing a duty of reasonable accommodation on employers; and, providing for a conscientious objection exemption. These will be analysed with particular attention for their restrictions and limitations.
