{"title":"European Union’s Approach to Crypto-Assets and Distributed Ledger Technologies","authors":"Hasret Ozan Sevim","doi":"10.15290/sup.2022.06.10","DOIUrl":"https://doi.org/10.15290/sup.2022.06.10","url":null,"abstract":"Goal – to analyse the different and comprehensive aspects of the European Union’s approach to distributed ledger technologies and crypto-assets with a teleological interpretation then finally foresee what kind of policy is going to be adopted by the European Union regarding distributed ledgers. Research metodology – the article includes an analysis of the current and upcoming legal acts and regulations of the European Union regarding distributed ledger technologies and crypto-assets. A multi-disciplinary approach is adapted to understand the financial and technological reasons of European Union’s policy. Score/results – many regulations and directives have been legislated by the European Union and more regulations are in the final phase of the legislation process. Since the global hubs of the distributed ledgers (especially the United States and the Republic of China) have put negative pressures on the crypto-assets and their underlying technologies, the European Union is a candidate to be a new global hub with its ongoing technology-agnostic approach. The article aims to evaluate the adequacy of the introduced legal changes to the needs of the Polish labour market. The assumed hypothesis was that the legal regulations on the employment of foreigners in Poland are adjusted to the changes in the economic reality. Research methodology – the article includes an analysis of the available literature and the current legal acts that regulate the studied problem. Moreover, observations con cerning the adaptation of Polish legal regulations to the constantly growing interest of foreigners in the Polish labour market were made in the article. Score/results – the conducted analysis allowed us to verify the research hypothesis positively. It has been acknowledged that the provisions of Polish law in the field of employment of foreigners have been adapted to the changing economic conditions, al though the procedure for obtaining work permits for foreigners remains complicated. Originality/value – the article shows a cross-section of changes that have taken place in Polish labour law in the field of employment of foreigners in recent years.Changes in the Polish labour law have been presented chronologically, which helps to organize the knowledge on the topic. {"title":"Innovativeness of Small and Medium Enterprises in Central and Eastern Europe","authors":"A. Wierzbicka, Magdalena Owczarczuk","doi":"10.15290/sup.2022.06.16","DOIUrl":"https://doi.org/10.15290/sup.2022.06.16","url":null,"abstract":"Goal – the sector of small and medium enterprises (SMEs) is considered a driving force for economic development. The literature on the subject increasingly emphasises that it is SMEs that initiate transformation of an economy as they play a crucial role in implementing innovations that make it possible to enhance its competitive success. The purpose of the article is to assess the level of innovativeness (innovative activity) of small and medium enterprises in CEE countries. Research methodology – the article contains an analysis of innovation measures and indicators, including (among others) the share of enterprises classified as innovative, the level of outlays on research and development, the number of research workers, and the number of innovations implemented by companies. The authors verified two research hypotheses: H1: The SME sector in CEE is becoming increasingly more innovative; H2: CEE countries significantly differ in terms of the level of innovativeness in their SMEs. In order to achieve our purpose and verify the research hypotheses, we use publicly available data and indicators published by Eurostat or the European Commission. The study covers EU member states located in Central and Eastern Europe: the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Slovakia, and Slovenia. Score/result – the presented statistical data indicate that the innovativeness of small and medium enterprises in CEE countries is growing. An increasing number of SMEs can be classified as innovating companies. The firms’ own expenditure on R&D (BERD) and non-R&D innovation has also been rising. A marked increase can be observed in the number of employed scientists and R&D personnel in small and medium enterprises in CEE countries. It should be emphasised, however, that these countries vary significantly in terms of their levels of innovation in the SMEs sector. Originality/value – the review of the literature on the subject and the conducted analysis have highlighted serious problems with measuring innovation and the availability of data, particularly that regarding SMEs. On the other hand, the obtained results make it possible to identify areas of interest for future research projects. Particular attention is focused on the contemporary state of affairs, referring to today’s trends in thought, philosophy and the contemporary way of explaining reality by societies that are carriers of the law. The purpose is to showcase that the today’s changing world is faced with many problems that are completely new to humanity as a whole, and that those problems have the power to affect the legal sphere as well. It proves that despite the belief in the stabilizing function of the law, it itself begins to be questioned, and its iron foundations begin to waver in principle, resulting in spectacular changes in the way we view such non‑negotiable issues as justice, power, order, and the meaning of being. Research methodology – through an analysis of the literature on the subject and by compiling the most important paradigmatic frameworks, a cross‑section of attitudes relevant to understanding the presented issue is made. Score/result – as a result, an observation is made regarding the current state of paradigms operating in the legal sphere. In line with the conclusion, it is stated that in the present world paradigms have mostly lost or are losing their power. They will lose it completely or undergo a transformation. There is also an exhaustion of the power of all grand narratives that must necessarily be taken into account when making any considerations about the embeddedness of law and its validity. Originality/value – the content of the text refers to well‑known paradigms of law that seem to be unshakable elements of Western legal culture. Score/results – the authors indicated a number of problems hindering the implementation of past multiannual EU strategies that were not solved in the current one. However, potential success factors of the European Green Deal implementation were also identified. Originality/value – value of the analysis lays in contextual reference to development and growth programmes of the EU. Conclusions are based on the comparative approach.
