When the Islamic party of Malaysia (PAS) won Terengganu in the 1999 general elections, the Hudud and Qisas bill 2002 was introduced in the second of the 13 states of Malaysia. The Penal Code 1976 does not legislate on ḥudūd but instead provides that the code serves to regulate crimes and punishments in the taʿzīr category only. The overall effect of this is that most of the ḥudūd penalties are converted into prison sentences. Then it discusses juristic discourse on how Muslim scholars understood and interpreted the source data on ḥirābah and the impact of repentance on its punishment thereon. Since ḥirābah is the nearest shariah concept to contemporary terrorism, the chapter also examines contemporary global terrorism and its manifestations, such as suicide bombing, and how Muslim thinkers have responded to these developments.
