Dado que, en la actualidad, los «sistemas expertos» desarrollados para este fin utilizan los precedentes jurisprudenciales como base de conocimiento, se argumenta que tales algoritmos, en un Estado de derecho, no pueden funcionar sobre la base de la regla puramente estadística de «más probable que no», sino que deben programarse sobre la base de la regla políticamente correcta de «más allá de toda duda razonable», que debe extenderse también a la duda sobre la interpretación de la ley. {"title":"Límites y garantías constitucionales frente a la identificación biométrica","authors":"Pere Simón Castellano, Xavi Dorado Ferrer","doi":"10.7238/idp.v0i35.392324","DOIUrl":"https://doi.org/10.7238/idp.v0i35.392324","url":null,"abstract":"El presente artículo examina los límites y garantías constitucionales frente al uso de técnicas de identificación biométrica a la luz del procedimiento sancionador PS/00120/2021 instruido por la AEPD y resuelto en la primavera de 2021. Los datos biométricos, siguiendo el RGPD, son aquellos datos personales obtenidos a partir de un tratamiento técnico específico, relativos a las características de una persona física, que permiten confirmar la identificación única o unívoca de esta, como patrones biométricos faciales en el supuesto que nos ocupa. Al respecto, existe mucha confusión, y la propia AEPD ha reconocido que se han extendido una serie de equívocos con relación a esta tecnología (huellas dactilares o mediciones faciales) para fines de identificación y autenticación. En este trabajo se analiza el concepto jurídico indeterminado de «interés público esencial», de acuerdo con la jurisprudencia, como excepción a la prohibición general de tratamiento de datos biométricos ex artículo 9.2.g) RGPD. No obstante, es y ha sido de suma importancia para la intervención social el estudio de modelos explicativos de dicho comportamiento, tanto por la elaboración de estrategias preventivas como por la intervención psicoeducativa con estos. El modelo de triple riesgo delictivo pretende explicar la etiología de estos comportamientos antisociales y delictivos, precisamente, para conseguir dichos fines y partiendo de diferentes modelos y teorías integradoras. Este trabajo pretende explicar este modelo en la práctica profesional con estos menores, y concluye con la aparición de las tres fuentes de riesgo: riesgos individuales, carencias prosociales y oportunidades delictivas en estos. A diferencia de la mayoría de las empresas en las que invertir, las criptomonedas carecen de una entidad legal específica a cargo de la protección del consumidor. El carácter virtual y descentralizado de esta tecnología imposibilita la aplicación de los marcos legales tradicionales. Además, la ausencia de una entidad legal específica hace que la aplicación de cualquier nuevo marco legal sea poco confiable. Por estas dos razones, con independencia de su naturaleza, el estado regulatorio actual de las criptomonedas genera muchas dudas. Este artículo pretende una descripción analítica de los diferentes enfoques que han adoptado las entidades legislativas en las principales economías (Unión Europea, Estados Unidos y Japón) para hacer frente a los desafíos que suponen las criptomonedas. The latter is especially relevant in terms of the liability of online intermediaries for digital services, taking into account the rapid transformation of the digital architecture and the emergence of new major digital platforms for sales and services. Firstly, basic notions of autonomous vehicles are analyzed, and a legal framework is introduced. The essence of the system is data flow in connected vehicles, and the issue represents one of the heavily discussed themes in legal doctrine. It is beyond doubt that reliable artificial intelligence (AI) can bring many benefits at the European level, such as better health care, safer and cleaner transport, more efficient manufacturing, and sustainable energy. But regulating the unknown requires considerable effort on how to attract investors using clear rules while keeping human control over the algorithms as a priority. In April 2021, the EU Commission published a holistic proposal to regulate the use of AI, which promises to put trust first and ensure that facial recognition and big data operators will never abuse fundamental human rights. Although the proposal is likely to be amended during EU-wide discussions, the new approach to AI will clearly give citizens the reassurance to adopt these technologies while encouraging companies to develop them. Alongside with the diffusion of information and communication technologies and the deepening (as well as widening) of the European Union, the initial narrow and sectoral data security policies have expanded into a comprehensive cybersecurity framework addressing issues from resilient infrastructure and technological sovereignty, through tackling cybercrime, to cyber defence capabilities and responsible state behaviour in cyberspace. In this complex web of interrelated policies a relative newcomer at the European Union (EU) level is cyber diplomacy. Sometimes also called public diplomacy 2.0, it factors into the cross-border connectivity of cyberspace and reflects a shift in international relations where the lines between external and internal policies, military and civilian domains are blurred. However, the term cyber diplomacy is fluid and it is not well understood which topics should be under its “umbrella”, in particular in relation to cybersecurity, where it seems to be linked the most. This article aims to map existing and proposed instruments that make up the EU’s arsenal in this broad context to answer the following questions: what is cyber diplomacy and how is it related to the EU cybersecurity?
