The actors of this French subsidiary of an US group are subject to several regulations and standards at national level, but also at a supra national level, especially European. They must implement them in a particular socio-technical context that requires adaptations. These adjustments are often the subject of various negotiations between the actors of the factory under consideration, with the actors of the group (corporate) and the national control authorities. These actors have indeed to deal with the process safety management regulation developed in the US at the federal level and translated into production and safety standards (procedures, tools, etc.) to regulate process safety in an increasingly homogeneous manner in the various sites around the world. Intrinsically linked, these two approaches are however regularly put in opposition by different actors in the field. This contribution explores the relationship between the logics of prevention and compensation in the French legislation. Presented as antagonistic, they are no less complementary. {"title":"Le mode de financement de la CNESST comme vecteur de la prévention des accidents du travail et des maladies professionnelles : qu’en est-il réellement ?","authors":"Maxine Visotzky-Charlebois","doi":"10.7202/1098910ar","DOIUrl":"https://doi.org/10.7202/1098910ar","url":null,"abstract":"This text aims to analyze the concept of prevention and its link to the funding of the CNESST, and particularly in connection with the use of experience rating. Based on a review of the literature and a historical analysis of legislation and parliamentary debates, it provides an overview of the evolution of the financing of the occupational health and safety system in Quebec. I will look at the concept of prevention in order to see how it was mobilized to justify the transformations of the regime and more particularly those that took place at the turn of the 1990s. I will then discuss the issues that are currently raised by the use of experience rating. The effectiveness of experience rating as an incentive to prevention is subject of only moderate proof, and this despite the fact that it has been broadened and mobilized in order to justify the tangent taken by governments concerning the financing of the regime. After having drawn up a critique of the managerialist normativity that dominates prevention approaches, we will define the links that unite normativity, health and work based on a theorization of work activity. Then, we will propose a definition of \"health work\" arising from a health construction process grappling with living conditions, work requirements, contextual elements, leeway. This construction presupposes complex trade-offs between productive and constructive objectives and often requires regulations being played out both inside and outside the work environment. Today, another development is strongly emerging in occupational health and safety management resulting from the emergence of a standardisation process generated by private bodies which are thus creating an increasingly influential extra-legal standard. The aim of this contribution is to study their scope and nature, but also whether there is a link with legal occupational health and safety standards and since the development of standardisation now seems ineluctable. Disabled workers have acquired increased protection through laws, regulations, and policies for the purpose of obtaining or keeping a job. Requests for recognition are now widely encouraged by all public and private stakeholders in the field of disability. We are therefore witnessing, in France, the plebiscite of a real employment standard, that of \"disabled worker\", to govern the work situation of people with disabilities. However, in Québec and Canada, the concept of DV as a dimension of occupational health and safety (OHS) is relatively recent. Few studies on DV and work focus on interventions, and even fewer on those of a preventive nature. This study contributes to filling this gap. It presents the results of a series of interviews with key informants in different Canadian jurisdictions where OHS legislation addresses DV. The study suggests that, for legislation to achieve its goal, awareness of DV in workplaces is an essential element. The IARC of the WHO then declared glyphosate and glyphosate-based herbicides to be genotoxic and probably carcinogenic. In the United States, 125,000 American victims of NHL attributed to Bayer-Monsanto's Roundup have filed lawsuits against the company, while 2.5 million pages of declassified internal documents, the Monsanto Papers, illustrated the incredible manipulations to conceal Roundup’s dangers and to subvert the evaluation and regulatory systems. After three costly convictions, Bayer-Monsanto signed a partial out-of-court settlement of $11 billion and withdrew Roundup from the U.S. domestic market.
