{"title":"Crypto risks and mitigation opportunities in Russia","authors":"L. Historically, the development of the crypto market has proved that fears seem to be well founded. Both internationally and nationally, there are mainly four types of risks associated with the use of cryptocurrencies: risks of violation of consumer rights; risks of money laundering and terrorist financing; environmental risks; risks to financial stability. Despite the risks being objective in nature and recognised by all financial regulators in the world, when forming a national legal regulation, each country should assess these risks based on its ability to manage them. The study showed that the risks of public costs in the circulation and use of cryptocurrencies are not destructive for the Russian financial market.Russia needs to adhere more strictly to a risk-based approach to regulating the crypto asset market. To manage risks, it is necessary to legalise the crypto asset market in Russia and create an appropriate market infrastructure. Digital technologies change people’s life content while current legislation often fails to adequately respond to the challenges of new technologies and relevant social relations in a timely manner\u0000This article discusses possible directions of legislative innovation and digital adoption practices required to stay up-to-date with the ongoing digitalization of social processes. The author analyses fundamental approaches, existing legal regulation and current digitalization practices. The process of mass digitalization can be launched only supported by the current law. The article explores theoretical provisions, conceptual methods and developments of digital technologies in business across various sectors at the present stage of economic development. The author underlines that technology may allow new ways to organize production processes, financial services and logistics, which in turn will benefit the business community and general population. The article examines the terms of digital, information and analog technologies. The author notes that the term “digital technologies” is not explicitly defined in the legislation of the Russian Federation. The article draws special attention to the emergence of new tools of the digital economy, key technologies such as assistive technologies, autopilot systems, drones, and digital platforms. At the same time, the study described in the article focused on two aspects: the legal definition of digital currency, and the concept formulated by the author. In particular, a legal conflict in Russian legislation was disclosed in the form of two mutually contradictory norms: the rule on the possibility of using digital currency as a means of payment and (or) investment, and the rule of prohibition of the issuance and circulation of money substitutes on the territory of the Russian Federation. Different available solutions were considered and their shortcomings were highlighted. The purpose of this research is to evaluate the current metadata processing methods in order to provide a robust base to build a metadata indexing system for a distributed documents exchange system. Different projects and researches were considered: Luster, WekaFS, Ceph, Gluster, IPFS, HDFS, Spyglass, Smartstore, and Distributed Metadata Search for the Cloud research. It was concluded that all the considered solutions don't fit the requirements of processing documents metadata. The tokenisation equity opens up new opportunities for companies to attract investment. As a result, many traditional companies are interested in converting traditional securities into security tokens. Countries aspiring to lead the blockchain industry are seeking to establish a legal framework for security tokens and a blockchain-based registration system for them. The use of blockchain brings with it not only the digital transformation of companies, but also the emergence of a new type of organization - decentralized autonomous organization (DAO). Existing legal forms are not appropriate for the DAO, which requires the creation of a new type of legal entity. The Sustainable Finance Strategy represents one of the central points of the European agenda, and Fintech offers important opportunities in this field. However, some “valuable” Fintech instruments seem to not have been adequately considered. The reference is to Bitcoin and to the “crypto-industry”. The most common public belief about Bitcoin and sustainability is that Bitcoin is polluting the ecosystem. Immediately, the concept is extended to Distributed Ledger Technologies (DLTs), to blockchain and to all related innovations. Notwithstanding this, some research shows that there is still some uncertainty on the precise amount of energy used by Bitcoin-related activities and on how to calculate it. The scope of this paper is to make give some clarity on this uncertainly in order to show, on the one hand that DLT is not “polluting”, but that pollutions come from the way each miner decides to conduct their businesses.
