Hamdi, Xavier Nugraha, Gioliano Putra","doi":"10.31328/wy.v6i2.4255","DOIUrl":"https://doi.org/10.31328/wy.v6i2.4255","url":null,"abstract":"In the light of this background, the focus of this article is on 3 (three) issues namely: the MPR's authority to interpret the constitution, the construction of ius constitutum providing statements by the MPR in reviewing laws in the Constitutional Court, and the reconstruction of the ius constituendum model of providing information on requests for review of laws law in the Constitutional Court. This article is a legal research with a reform-oriented research type with statutory, case, and conceptual approaches. Based on this research, several things were found, namely: (1) the People’s Consultative Assembly has the authority to interpret the constitution based on Article 3 paragraph (1) of the 1945 Constitution of the Republic of Indonesia; (2) the construction of the ius constitutum position of the People’s Consultative Assembly in the petition for review of a law at the Constitutional Court is derogated by the exclusion of the MPR as giving explanation in Constitutional Court Law Number 6 Year 2005; (3) at the ius constituendum level, the involvement of the People’s Consultative Assembly in carrying out originalism interpretation of the constitution can be realized through the provision of explanation in a tripartite manner, namely the Government and/or the DPR as legislators and the People’s Consultative Assembly as the framers of the constitution. This act is against the law and can be subject to criminal penalties as regulated in Law Number 22 of 2001 concerning Oil and Gas. This type of research is empirical law using primary data obtained directly from the field through interviews with related parties, while secondary data obtained through library data in the form of primary legal materials, namely binding regulations, secondary and tertiary materials. Research results show, law enforcement against the illegal distribution of subsidized fuel oil (BBM) has never been carried out by the Central Aceh Resort Police, due to the absence of reports from the public. The efforts of police investigators in overcoming the crime of distributing subsidized fuel oil (BBM) in Central Aceh Regency, First. Supervise the distribution of subsidized fuel in cooperation with local governments, as well as coordinate with owners of Public Fuel Filling Stations (SPBU). This is done because the functions of supervision, guidance and prosecution are not optimal for traders who sell counterfeit goods. This study aims to determine the factors that hinder the implementation of legal protection for Nike trademark holders on counterfeit shoes in the Klithikan Pakuncen market in Yogyakarta. This research was normative-empirical research using primary data and secondary data. The results of the study show that there are three inhibiting factors for the implementation of legal protection, namely the Law Factor, the Government Factor, and the Community Factor. First, Law no. 20 of 2016 concerning Marks and Geographical Indications does not explicitly regulate the Mark Holder but regulates the goods of the brand. Second, the Department of Industry and Commerce and the Ministry of Law and Human Rights are still lacking in personnel or expert staff in the field of trademarks within the Department of Industry and Commerce recognized as an obstacle in the process of fostering or socializing business actors who cheat in the trading process which is considered not only detrimental to the Trademark Rights Holder but also including the consumers in it.
