Проаналізовано еволюцію наукових підходів до розвитку адміністративного права, виділено кілька етапів становлення адміністративного права як фундаментальної правової науки. Проаналізовано особливості розвитку поліцейського права на території країн Західної Європи загалом та в Україні зокрема як підґрунтя адміністративного права України в сучасному розумінні. Розглянуто об’єктивні та суб’єктивні фактори, що вплинули на історію розвитку адміністративного права. Встановлено, що виникнення та розвиток науки адміністративного права є одним з елементів правової науки та юридичної дійсності. Визначено необхідність забезпечення гарантій захисту прав суб’єктів приватного права у їх взаємовідносинах із суб’єктами владних повноважень.","PeriodicalId":101512,"journal":{"name":"T.H.E. Пандемія COVID-19 унеможливлює дотримання деяких зобов'язань, викладених у Конвенції про працю в морському судноплавстві 2006 р. і є форс-мажорною обставиною. Аналізуються проблеми з яки- ми зіткнулися моряки під час пандемії: безпека та здоров’я, неможливість отримання медичної допомоги у разі хвороби, порушення права на репатріацію, тривалий термін перебування на судні, перевтома моряків, яка впливає на навігаційну безпеку та управління судном, невиплата лікарняних. Визначаються найбільш поширені обмеження з якими стикаються моряки та заходи, які мають проводити держави, які ратифікува- ли Конвенцію про працю в морському судноплавстві 2006 р., а саме: забезпечити доступ на/з судна з метою виконання трудових обов’язків або для репатріації; забезпечити доступ на берег під час перебування судна в порту; надання медичної допомоги в екстрених випадках; сприяння зменшенню терміну понаднормового перебування на судні для виконання трудових обов’язків; пролонгація документів та сертифікатів моряка.","PeriodicalId":101512,"journal":{"name":"T.H.E. Визначено, що саме сім’я є основою для формування та розвитку основних рис характеру дитини. Досліджено, що підлітковий вік є сензитивним та вирішальним для становлення особистості, і саме у підлітковому віці відбувається загострення рис характеру – акцентуація. Узагальнено психолого-педагогічні дослідження щодо впливу типу сімейного виховання та сімейного середовища. Виявлено, що характер формується під впливом зовнішнього середовища, соціуму, виховання. Висвітлено основні несприятливі умови біологічного та соціального походження, що можуть сприяти формуванню патологічних варіантів характеру. Названо групи чинників, які сприяють розвитку патохарактерологічних особливостей. {"title":"PALAEOLITHIC IN D. YA. TELEHIN’S RESEARCH","authors":"V. Stepanchuk","doi":"10.37445/ADIU.2020.04.02","DOIUrl":"https://doi.org/10.37445/ADIU.2020.04.02","url":null,"abstract":"The article is devoted to the coverage of a little-known aspect of D. Ya. Telehin’s scientific activity, namely his research related to Palaeolithic sites and Palaeolithic issues. Although this was clearly not the main area of the scientist’s concern, his interest for Palaeolithic studies has accompanied him throughout his scientific life. \u0000In the early 1950s, D. Ya. Telehin participated in the works of I. F. Levytskyi at the site Mynivskyi Yar at Seversky Donets, in eastern Ukraine. The lower layer of the site belongs to the period 18—13 thousand years ago. In fact, at the time of excavations, it was the only Upper Palaeolithic site in the region that was investigated on a relatively large area. \u0000In the mid-twentieth century, a cascade of new hydroelectric power plants and reservoirs was being built on the Dnieper. During the field seasons of 1953 and 1957, D. Ya. Telehin’s explorations in the area of construction of the Kakhovskaya hydroelectric power plant and the Kakhovskoye reservoir discovered, in addition to numerous sites from later periods, the first upper Palaeolithic locations of the Lower Dnieper, namely: Shyroka, Valivalska and Merzlyakova gullies. \u0000In 1975 together with N. I. Tarasenko, D. Ya. Telegin conducts excavations at the Rogalyk farm. According to modern interpretation, the remains of three new stratified sites were discovered during these works. The authors have identified the materials as early Mesolithic; they are now attributed to the final Palaeolithic. \u0000In 1976 D. Ya. Telehin researches the Upper Palaeolithic site of Zbranky near the eponymous village in the Ovruch loess area. The materials found once again, after the works of I. F. Levytskyi and V. A. Mesyats, confirmed that this region was actively exploited by the Palaeolithic man at the end of the Pleistocene. \u0000A number of new, mostly surface, Upper Palaeolithic sites were discovered by the «Dnieper-Donbas» and «Slavutych» expeditions led by D. Ya. Telehin in 1970—74 and 1980—83 on the territory of the Middle Dnieper Basin (Chernyavshchyna, Pereschepyno, Khizhnyakivka, etc.) and the middle reaches of Southern Buh (Apolyanka, Berezyno). \u0000During the 1980s, D. Ya. Telehin investigated the area of the left bank of the Dnieper River near the mouth of the Sula River. This work resulted in the discovery of a new concentration of Upper Palaeolithic sites. The features of lithic assemblages make it possible to identify groups of later and earlier sites in the preliminary view, including the so-called archaic Upper Palaeolithic. \u0000In 1984, D. Ya. Telehin investigated the location of Semenivka 1 in Baryshevsky district of Kiev region in the valley of Trubizh river. The peculiarities of the stone tools allowed to see the nearest analogies to the findings in the materials of the sites of Epigravettian mammoth hunters. Запропоновано впроваджувати ефективну соціальну політику, щоб покращувати процес формування персоналу бюджетної установи. Рекомендується удосконалювати системи оплати праці, а також державне керування ними. Розглянуто вигоди від заходів щодо підвищення рівня охорони праці та техніки безпеки. Одним з найважливіших елементів управління стає мотивація, що визначає спонукальний вибір працівниками бюджетних установ і організацій різних типів поведінки. Щоб раціонально використовувати трудові ресурси, треба впроваджувати метод моделювання компетенцій. Для створення інформаційної бази, необхідної для розроблення ефективної стратегії формування персоналу бюджетної установи, доцільно постійно проводити опитування працівників. У дос-лідженні виведено основні групи ризику захворюваності на інфекційний ендо-кардит, вивчено основні преморбідні стани, що призводять до розвитку захворювання. Узагальнено та систематизовано новітні знання з питань діагностики захворювання, особливу увагу приділено мікробіологічній діагностиці з акцентуванням уваги на випадки негативних результатів посівів, також ультразвуковій діагностиці, а саме застосуванню стандартної ехокардіографії та її варіантів – трансторакальної та черезстравохідної. Також приділено немалу частку дослідження лікуванню патології. Проаналізовано основні клінічні настанови з питань антибіотикотерапії інфекційного ендокардиту, застосування комбінованих схем та особливості використання певних препаратів, в залежності від збудника. На додаток до розглянутого авторами раніше опису моделі введено формалізований опис угрупування, який включає до себе безліч технічних об'єктів угрупування; нормативні параметри витрачання та поповнення ресурсу об'єктів і поточний стан угрупування. Стан угрупування значною мірою визначається станом ресурсу об’єктів, що входять до нього. Ресурс окремого об'єкта визначається трьома параметрами: власним ресурсом (залишкове напрацювання), залишковим терміном служби і залишковою кількістю планових ремонтів, які повинні бути виконані на даному об'єкті до його списання. Введена класифікація станів ресурсу угрупування, що визначає три класи станів: «новий», «врівноважений» і «старий». Наведені приклади результатів моделювання ПВПР, що наочно ілюструють можливості застосування розробленої моделі. На прикладах продемонстровано доцільність прагнення при організації експлуатації об'єктів угруповання до урівноваженого стану її ресурсу.","PeriodicalId":101512,"journal":{"name":"T.H.E. Data is quite unequal throughout Europe, as exemplified by the middle Prut and Dniestr area, which have remained little investigated so far, despite the presence of different sites related to Late Aurignacian and Early Gravettian. Some of these sites consist of secure sequences with high-resolution climatic context and abundant archaeology, such as Molodova V (Ukraine) or Mitoc-Malu Galben (Romania). Rich in lithic artefacts, these collections have rarely been examined else than typologically. In order to highlight this phenomenon in the concerned area, we have studied and confronted the bladelet production patterns from Mitoc-Malu Galben’s Late Aurignacian to Molodova V’s Early Gravettian. Preliminary results emphasize the technological individuality of both technocomplexes, but further investigations on materials and contextual data are necessary to confirm any population dynamics model.","PeriodicalId":101512,"journal":{"name":"T.H.E. Yanevich","doi":"10.37445/ADIU.2020.04.03","DOIUrl":"https://doi.org/10.37445/ADIU.2020.04.03","url":null,"abstract":"Late Mesolithic Laspi 7 site is situated in Ukraine, in the West part of the South Coast of Crimea, in the Laspi Bay, Black Sea coast (44°24’48.5”N 33°42’41.3”E). It was investigated under the direction of prof. Dmytro Telegin in the second half of 1970s. The site was destroyed by Russian occupation power. \u0000There were 7 cultural layers of the site, which had the thickness near 2 m. There was Kokkenmedding — clay sediment with crushed stone and with unusual great number of the Helix albescens shells, ash and charcoal. Any structures of the cultural layer are not traced. \u0000Archaeological materials of Laspi 7 are represented by numerous flint collection (2347 eks.), bone tools assemblage (13 eks.), ocher, faunistic materials etc. Flint complexes from all cultural layers generally are similar. Most of the cores are pyramidal. Prismatic and pencil-shaped cores are single. Microlithic assemblage consists of geomethric miсroliths (asymmetrical and symmetrical trapezoids); single backed microliths and truncated blades. Scrapers are mostly semicircular on the flakes, single end scrapers are on the blades. Most of the burins are on the flakes, they are angle and, in smaller quantities, lateral. There are some «Kukrek type» burins with numerous worked parts. Angle burins on the blades are not numerous. Unusual big quantity of encoches is amazing. There is one Kukrek insert. Bone tools are very different (13 eks.): base part of the harpoon, fragment of the point with the grooves, different points, the borers, partly worked boar tusks, fragment of the antler socket. The age of Laspi 7 is 8600—7000 ВР. The most true 14C dates are 8625 ± 40 BP (GrA-35704) and 8620 ± 40 BP (GrA-35703). \u0000Laspi 7 flint assemblage is typical for the Late Mesolithic Murzak-Koba culture of Mountain Crimea. \u0000Laspi 7 is a shining example of the «revolution of the wide range» in Crimea. Inhabitants of the site used very different food resources: ungulates (red deer, boar, roe deer), birds (above all bustard), fish (catfish and pike perch), Helix albescens snails. Numerous ornito-, ihtio- and malakofauna dates evidences about the occupation of the site in autumn, winter, and spring time. {"title":"IMPORT OR IMITATION: CHARACTERISING THE BUDZHAK CULTURE OF THE NORTH-WEST PONTIC REGION","authors":"S. BC is manifested by relations of its population with a foreign cultural environment. This concerns, first and foremost, the Budzhak culture that is a component of the Pit-Grave (Yamna) cultural-historical region. The Budzhak culture represents connections with the Carpathian and Danube, the Corded Ware and the Globular Amphora cultures. The contacts were reflected in two aspects: imports, imitations and parallels in the Budzhak pottery and the occurrence of the Yamna burials found in other territories. Some forms of pottery and elements of its dйcor are rather surprisingly similar to central European groups of the Corded Ware culture. The analysis of the mainland culture of the Budzhak population enables us to assume the existence of contacts with the Corded Ware culture circle as early as in the first half of the 3rd mill. BC. \u0000The current state of research on the movement of Yamna cultural aspect towards west is also discussed in the paper. The recent genetic analysis results the link of Yamna and Corded Ware populations. They were treated as the evidence of direct massive migration of Steppe people into Central Europe. Archaeological data supporting this concept are few if any. The westernmost enclaves of Yamna culture rather indicate limited intrusion of specialized groups aimed at control of exchange routs and raw material extraction places. It is suggested that formation of Balkan-Carpathian variant of Yamna cultural-historical community is connected to the expansion of the tribes of the Budzhak culture of the North-West Pontic region. The western group of Yamna-Budzhac culture is distinctively different from «core» Yamna by typology of pottery while both aspects share the similar burial rites. \u0000The information obtained as a result of many years of excavations of barrows of the North-Western Pontic Region allow defining the Budzhak culture not only as a unique structural entity within the Yamna cultural-historical area but also as a mobile community opened to «cultural dialogue» and capable of long-distance migrations. Indications of that include imports, imitations, derivatives in the material complex, as well as the population’s westward movement to the Central European and Balkan-Carpathian Region.","PeriodicalId":101512,"journal":{"name":"T.H.E.
