However, it might entail concerns from the perspective of third states and Public International Law (PIL). Such concerns might be aggravated by the broadening of delicate foreign relations elements and protections for investors woven into international economic agreements. In the absence of clear PIL rules for conflicts arising from overlapping jurisdictional claims, such jurisdictional issues are subject to the discretion of the domestic court. A tendency to adjudicate such claims is strongly demonstrated in the caselaw of the EU Court of Justice (CJEU). The CJEU’s jurisdictional attitude towards competing IDSMs is examined in the context of the recent CJEU caselaw on disputes under bilateral and multilateral investment treaties involving non-EU states and investors, where the parties have committed to arbitration. The analysis then focuses on CJEU judgments on disputed EU trade agreements with non-EU states controlling Disputed Territories (DTs), in particular, trade with Israeli controlled DTs, where the parties have agreed on an IDSM. These judgements present substantial competing jurisdictional issues, that were scarcely dealt with in the literature. Consequently, the CJEU’s jurisdictional policy provides an excellent basis on which normative conclusions can be drawn regarding the profound effect it may have on third states, foreign investors and on the development of rules for the resolution of international economic conflicts.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"22 4 1","pages":"15 - 61"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"79265029","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Attention market differs from conventional market in several aspects and becomes a new challenge for antitrust. The article therefore analyses attention markets from competition point of view. Starting with economic background it discusses different approches to the relevant market analysis and the tools used for relevant market assessment (SSNIP, SSNIC and SSNDQ test). It explores also changes in identification of market power and new forms of anticompetitive behaviour in these prevalently zero-price markets. Attention is drawn also to the benefits of functioning competition. Outcomes of analysis are summed up in the conclusion.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"6 1","pages":"234 - 242"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"75827353","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In the context of the growing influence of such key political figures as, for example, the USA and China, which have dominant influence on the digital economy, the issue of proper ensuring the digital sovereignty of the EU in the field of global data governance comes to the fore. This is due to the fact that it is the digital sovereignty that should guarantee the strategic autonomy of the EU in the digital world in the context of the EU’s increasing dependence on foreign technologies and services and a shortage of investments in the digital sector. In this research, the authors focus on the need to develop and use a model of multilateral participation in the field of data governance and protection in the digital world, which, in turn, implies prevention of weakening the role of the state in regulating the digital market, since it is the states (including the EU) that are the primary guarantors of human rights protection in the digital world.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"2 1","pages":"110 - 132"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"79701796","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Also with the European Union situation, given by the existence of the Directive 2008/52/EC of the European Parliament and of the Council of 21 May 2008 on certain aspects of mediation in civil and commercial matters. EU States haven’t signed the Singapore Convention on Mediation. This paper is trying to analyse the two instruments, the Directive as a harmonisation instrument, maybe opening the field of the possible usage of the convention and not existing Regulation unifying the legal ground in the EU. The Singapore Convention on Mediation enters into force six months after deposit of the third instrument of ratification, acceptance, approval, or accession. EU is now in the position, where a decision about new Directive, or maybe the acceptance of the convention must be decided with accordance to all the dilemmas of the Singapore Convention.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"24 1","pages":"243 - 264"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"77203721","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Criminal groups may become more interested in electronic payments and virtual currencies because of increased traffic in these areas. When comparing the second half of the 2019 to the first half of the 2020, the number of fraudulent card transactions increased by 11.4%. New developments in virtual currency trading regulations, including the digital finance package, which includes, among other things, a draught regulation from the European Parliament and an amended act to combat money laundering and terrorist financing, among others. For the reasons stated above, these regulations may lead to a virtual currency market collapse and the withdrawal of investors and the siphoning of money into Asian markets as a result. The current regulations are a manifestation of total regulation and do not encourage technological advancement.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"1 1","pages":"213 - 233"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"73300215","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The background of this paper is related to the recent appointment of a new Governor of the Czech National Bank, which has raised many questions among experts, but also instability in the financial markets. Within this starting point, the paper then poses the primary hypothesis of whether the Czech process of appointing the Governor of the Czech central bank is unusual among EU mMember States. An analysis of the process of appointing the governor in all other EU countries was conducted to answer this hypothesis. The results of this analysis were systematically arranged to identify which procedures prevail. Based on this analysis, it was concluded that the governor appointment process in the Czech Republic is unique.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"25 1","pages":"283 - 297"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"82859432","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In the age of modernism, both concepts were defined as a condition for society’s loyalty to the political framework, but this long-established format changed with the new technologic developments. The digital revolution requires a postmodern – heterogeneous and fluid – idea of identity, as well as a post-modern idea of sovereignty, which is non-territorial, neither hierarchical. Therefore, the postmodern idea of sovereignty and the concept of identity are significant for the development of the concepts of digital sovereignty and European digital identity.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"49 1","pages":"80 - 109"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"79794105","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The author analyses key threats to the fundamental values held by the majority of democratic society and the human rights guaranteed by international human rights treaties, such as the European Convention on Human Rights. Emphasis is placed, in particular, on the risk of restricting patients’ autonomy due to an insufficient regulation of the use of clinical decision-support systems, a lack of humanistic care due to excessive use of care robots, a decline in human skills in specific fields of medicine, such as radiology, and the violation of privacy by extensive surveillance of social media. The article provides an overview of the benefits of artificial intelligence for healthcare, but also warns of the downsides, with the aim to encourage a debate that would lead to reasonable legal regulation.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"53 1","pages":"181 - 196"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"83096102","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In addition, the effect of the rapid pace of technological development on humanity has made the inherent limitations of its rules and other social arrangements manifest, as the use of technology is growingly used for human enhancement. The advocacy seeking to expand the catalogue of human rights and to cover transhumanism has started to bear fruit, but more conceptual developments are needed to lay the foundations for a more systemic regulatory development. This reflection paper focuses on the use of microchip implants, from among the augmentation practices that have recently flown under the radar of legal scientific research. These electronic devices re-shape the experience of being human and their various applications suggest that the penetration levels of capacity enhancing technologies will continue to be on the rise. It will discuss and clarify whether and to which extent transhumanism, personal rights and private autonomy are connected, and the former sufficiently covered by the right to bodily integrity (RBI). The reflection will rely on a comparative and interpretative approach based on the extant literature, national and European Union (EU) regulatory initiatives, and recent doctrinal developments found in case law.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"66 2 1","pages":"133 - 154"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"88463080","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Implementing urgent measures, in particular for the sectors that are mostly affected by the economic shock and unpredicted limitations pushed them to increase their resilience to be more stable for emergencies. In order to ensure the EU internal market is not fragmented and the level of playing field stays intact, as well as to avoid harmful subsidy races to the detriment of cohesion within the Union, the use of State Aid proved its necessity in various diversified forms of aid. The article discusses State Aid in the context of the global pandemic and tries to find out raised questions.","PeriodicalId":81228,"journal":{"name":"European studies review","volume":"41 1","pages":"265 - 282"},"PeriodicalIF":0.0,"publicationDate":"2022-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"87369212","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
