The COSP is part of an established tradition whose principal aim is to keep the Convention alive by stimulating actions, collaborations, enforcement, capacity building, and others. The enforcement powers of the COSP are severely limited, if any, and should not therefore be compared to those enjoyed by entities with enforcement powers, such as the UN Security Council or the Council of the European Union. Although the powers and functions of the COSP could be achieved outside the legal person of the COSP on the basis of joint action by CRPD member states, the formal collectivization of member states ensures annual discussions on important and emerging issues affecting disability rights and contributes towards a consistency among a group of equal partners undertaking the same obligations.","PeriodicalId":57507,"journal":{"name":"残疾人发展理论研究","volume":"21 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2018-10-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"81588942","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Reservations are a common feature of multilateral treaties, although there are calls to reduce their frequency or volume in human rights or treaties of a humanitarian nature. The legal effect of a reservation is to exclude or modify the binding nature of a treaty provision for the reserving state. In the context of a universal human rights treaty this entails several dangers. For one thing, since the CRPD claims not to create new rights but instead relies on existing ones, any reservation thereto will automatically constitute a regression on entrenched rights, something that is unacceptable. In equal manner, since the vast majority of the ‘existing’ rights in the CRPD are also part of customary international law, reservations thereto will negate customary obligations, which is again unacceptable.","PeriodicalId":57507,"journal":{"name":"残疾人发展理论研究","volume":"28 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2018-10-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"82331482","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It explores how a provision on statistics and research data found its way into a human rights treaty for the first time in the history of international human rights law. It explores the provision’s link with Article 32 on international cooperation and Article 33 on national implementation and monitoring. The chapter also takes a look at the current deficits in statistics and research data on disability, and describes the initiatives taken to set out more robust statistical and research data on disability issues suitable for international comparison. Finally, it highlights some of the initiatives taken and describes best practices on using data as a tool to assess how human rights are lived and experienced by persons with disabilities, with a view to considering how statistics and research data can be used to monitor the implementation of the CRPD.","PeriodicalId":57507,"journal":{"name":"残疾人发展理论研究","volume":"54 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2018-10-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"88399989","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

These languages are all official languages of the United Nations and it is standard practice for all of these to be designated as equally authentic in treaties adopted under its aegis. That all six languages are authentic entails that all texts are authoritative when determining the meaning of any provision in the CRPD. Consequently, it is crucial that the language in all texts is precise and the terminology corresponds to the greatest possible degree in all languages.","PeriodicalId":57507,"journal":{"name":"残疾人发展理论研究","volume":"1 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2018-10-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"82858010","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In accordance with article 76(1) of the Vienna Convention on the Law of Treaties, the designation of the depositary of a treaty may be made by the negotiating states, either in the treaty itself or in some other manner. Practice, as is the case with Article 41 CRPD, suggests that depositories are designated in the body of the treaty. The depositary is expected to undertake certain functions and assume several powers under customary international law, none of which are explained in the depositary provisions of multilateral treaties. The functions and powers of the depositary should be distinguished from other functions and powers entrusted to the same entity under other provisions of the same treaty.","PeriodicalId":57507,"journal":{"name":"残疾人发展理论研究","volume":"57 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2018-10-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"80740188","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The article sets out the general obligations under the CRPD with a view to encouraging national legal and policy reform and guiding domestic implementation of the Convention. The content of Article 4 is of cross-cutting application, since it contains overarching principles that permeate the text of the Convention as a whole. The obligations contained in the article thus seek to contextualize the interpretation of the substantive provisions of the Convention. Article 4 enumerates both general obligations and specific obligations. This distinguishes it from similar provisions in other human rights treaties, which are more in the nature of general obligations of compliance.","PeriodicalId":57507,"journal":{"name":"残疾人发展理论研究","volume":"27 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2018-10-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"87325860","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Unlike the past, recent practice within the UN has effectively abolished most barriers that prevented human rights treaty bodies from openly and officially communicating with external actors, at least in respect of country reports and general interaction in issues of common interest. In some cases, treaty bodies have proceeded to initiate a confidential inquiry on the basis of information received by non-governmental organizations (NGOs). Article 38 not only allows the Committee to receive information, expert advice, and reports from other UN bodies, national human rights institutions, NGOs, but also renders such representation by specialized agencies and UN organs an entitlement.","PeriodicalId":57507,"journal":{"name":"残疾人发展理论研究","volume":"1 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2018-10-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"89233801","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
