This research aimed to investigate the initial occurrence of this resistance in society, the contributing factors to the resistance, and the implications of the resistance. To date, most studies on resistance focused on social perspectives, but this research probed into the discourse of resistance during COVID-19 from the perspective of legal transformation, especially in Islamic law or fiqh. This study employed a qualitative approach supported by data obtained from printed and electronic media, and informants. The analysis revealed that public resistance to the burial which complied to health protocols was not only embodied in rhetorics or values but made apparent in their attitude. This study concludes that public resistance sucessfully reformed the law by bringing about the new fiqh regarding the burial practice. Since the community might not readily understand and accept this neq fiqh, we advised the government and related institutions to take intensive approaches to introduce this transformation to public. This research was conducted using empirical research methods with a qualitative-descriptive approach. The data collection technique used was interviewing key information, namely Muhammadiyah cadres and literature studies in the form of writing related to the discussion. Studying radicalism among youth is essential to understand their thoughts on societal problems often associated with radicalism issues. There is a view that youth is the target of changes in understanding and religious and social behavior from groups that claim to be radicalized. Therefore, the understanding and perspective of youth will be beneficial to see the issue of social-religious movements in Aceh. This study is based on an ethnographic study in which the author conducted several interviews in Banda Aceh and several areas in Aceh province. In addition to conducting a bibliographical study, the authors conducted in-depth interviews to understand the informants' backgrounds. To find out their views on the issues in the radicalism movement, the author conducted an FGD with several youths. This study found three youth groups in the study of Islamic movements in Aceh: A first group is an underground group, which is not so visible among the younger generation of Muslims, but among activists of Islamic organizations and specific figures who continue to make upgrades. A second group is a group that prioritizes the power of social media and always carries out a process of religious discussion and responds to any current issues related to \"threats to Islam.\" Third, those who have good relationships with various religious and community leaders. The phenomenon of alcoholic beverages is faced with cultural connotations and local wisdom. From this view, this study will look at the influence of local wisdom and Islamic legal views so that they can influence local regulatory policies. Furthermore, the other hand, it will also discuss law enforcement from alcoholic beverages that have a terrible impact on the community. The research method used is a normative legal research method. The study uses a statutory approach and the analysis of legislation theory. The study results indicate that the traditions strongly influence the North Toraja area's formation of regional regulations in its community. One view can be drawn that the link between the traditions of a region will follow the existing regulations in that area. This is in line with the basis for the formation of regional regulations. There are three principal foundations: the philosophical, the juridical, and the sociological. The majority of the population in every Indonesian region is Muslim, which also affects the norm value of local government regulation. This can be seen in the Province of Aceh, which strongly opposes the existence of alcoholic beverages in the area. For the Province of South-Sulawesi alone in Takalar Regency, the same thing applies by strictly prohibiting the drinking, producing, and trading of alcoholic beverages, even though these include traditional drinks. Therefore, this research shows that strong Islamic values greatly influence the local community. Law enforcement is closely related to the implementation of sanctions from existing regulations. Penalty application is so religious in every area. Some impose sanctions regarding production and trade permits, and some apply criminal sanctions, and so on. The history of the development of Islam and Tionghoa in Banjarmasin has an affiliation. This study aims to determine how the distribution of Tionghoa ethnic Muslim heritage in Banjarmasin. The method used is empirical legal research/field research, and the approach used in the sociology of law approach. The results of this study indicate the existence of legal integration. The pattern of behavior in the distribution of inheritance of Tionghoa descendants who are Muslim in Banjarmasin basically contains three main divisions of inheritance, namely through traditional heir deliberation, not dividing the inheritance, and dividing through the provisions of Islamic inheritance law. The use of inheritance law for Tionghoa Muslims in Banjarmasin is not fully subject to Islamic inheritance law, even though the inheritance law that applies to them is Islamic inheritance law. The study aimed to investigate the underlying reasons behind filing a divorce to religious courts, the women’s position in the trial process, and the women’s access to justice, as well as the women’s acceptance of the decisions of domestic violence cases. This case study collected the primary data through documents and interviews. The documents were court decisions concerning domestic violence, and the interviewees consisted of judges and domestic violence victims. The findings of the study found that resolving domestic violence through a judicial divorce in a religious court has been more practical and less complicated, which only involves limited parties, with an aim to preserve the family’s reputation (marwah) and children’s psychology. Further, women have the same legal standing as their husbands during the trial process, but this does not guarantee post-divorce justice because the husbands rarely attend court hearings (i.e., verstek decision). Women, the victims of domestic violence who resolve the violence through a divorce, accept the decision of the panel of judges even though the judges only grant the primary lawsuit to terminate the marriage bond. For these women, the decision is seen as a solution that can break the chain of violence and tyrannical behavior of their husbands. Differences in using naqli arguments and scientific, medical, and even political arguments make the discourse on family planning still hotly debated. This research will identify how Betawi Ulama's response in the XXI century to the law on the use of contraceptives and birth control through population control, along with the arguments and legal methods, they used to analyze the factors behind it and collect theoretical and empirical data related to social impacts/implications, from the Betawi Ulama's response to enacting the law on contraception and population control. The conclusion of this study will explain the positions, thoughts, and religious perspectives of Betawi Ulama in understanding various problems of Islamic law. Tend to think that is exclusive, inclusive, or moderate, especially in addressing the controversies of family planning law? This study took the capital city of DKI Jakarta as the sampling location, considering that the densest population in the country is in Jakarta, and it is very heterogeneous in terms of diversity and community characteristics. Population census data in 2010 shows that the capital city of DKI Jakarta is the largest city with the most populous population in Indonesia, around 9.6 million people. This research uses logical thinking, analysis with logic, induction, deduction, analogy, comparison and the like. The information abundancy falling this generation, including legal norms and legal culture in the borderless world, rises a question: is the perception of Muslims Generation Z in Banjarmasin in common with Generation Z in other cities in other countries? To answer this question, a survey method was used to explore the perception of Muslims Generation Z in Banjarmasin on prenuptial agreement. This research finds that the perception of Muslims Generation Z in Banjarmasin tends to be the same as Generation Z in America and England. They know and understand the function and purpose of the prenuptial agreement. They also opine that this agreement is to be carried out for the benefit of their marriage (in the future). In addition, this research also finds that the perception of Muslim Generation Z in Banjarmasin towards prenuptial agreements is substantively different from the perception of the previous generation in Indonesia, who consider a prenuptial agreement as a kind of taboo.[Artikel ini berfokus pada perjanjian pranikah dari sudut pandang Generasi Z Muslim di Kota Banjarmasin. Berlimpah-ruahnya informasi yang menghujani generasi ini, termasuk norma hukum dan budaya hukum di dunia internasional, menimbulkan pertanyaan: apakah persepsi Generasi Z Muslim di Banjarmasin sama dengan Generasi Z di kota lain di negara lain? Untuk menjawab pertanyaan tersebut, digunakan metode survei untuk menggali persepsi Generasi Z Muslim di Banjarmasin terhadap perjanjian pranikah. Penelitian ini menemukan bahwa persepsi Generasi Z Muslim di Banjarmasin cenderung sama dengan Generasi Z di Amerika dan Inggris. Mereka mengetahui dan memahami fungsi dan tujuan dari perjanjian pranikah. Mereka juga berpendapat bahwa perjanjian ini dilakukan untuk kepentingan pernikahan mereka (kelak). Article 41, paragraph C, of that regulation, does not specify how judges should assess the financial strength of a husband who intends to engage in a polygamous marriage. Likewise, the Bantul Religious Court judges (who granted the most polygamy permits in Yogyakarta of 2021) have a different perspective on the requirements for financial ability in polygamy. In this context, this study examines how Bantul Religious Court judges deal with this legal ambiguity in their decisions. This study examines 14 polygamy verdicts. This research finds that the concept of financial ability in the polygamy case is the judge's way of measuring the justice of the husband. Justice primarily refers to the husband's capability to provide an adequate financial portion of the fair share to their wife (in the future). To know the husband's financial ability, judges apply a holistic approach that rests on a sociological lens.[Substansi hukum dalam Peraturan Pemerintah tentang Pelaksanaan Undang-Undang Perkawinan, khususnya tentang persyaratan keuangan untuk poligami, memungkinkan munculnya penafsiran ganda bagi hakim. Pasal 41 huruf C peraturan itu tidak mengatur bagaimana seharusnya hakim menilai kekuatan keuangan seorang suami yang hendak melakukan perkawinan poligami. Begitu pula dengan Hakim Pengadilan Agama Bantul (yang paling banyak memberikan izin poligami di DIY tahun 2021) memiliki pandangan yang berbeda tentang syarat kemampuan finansial dalam poligami. Dalam konteks tersebut, penelitian ini mengkaji bagaimana Hakim Pengadilan Agama Bantul menyikapi ambiguitas hukum tersebut dalam putusannya. Studi ini mengkaji 14 vonis poligami. Cutting konde is usually held at the wedding reception. Data were collected through observation and interviews. Based on empirical research, it can be stated that cutting the konde for the bride among the people of Gunung Meriah Aceh is part of the customary law on marriage. Physically, cutting konde aims to beautify the bride's hair and eyebrows. Besides that, the ceremony is also meant to foresee the future of the household that will be experienced by the bride and her children. If the forecast results in an unexpected outcome, the community will conduct collective prayer. In Islamic law, this practice has no theological justification. Even though they are aware that this practice is not part of Islamic teachings, the Muslims of Gunung Meriah Aceh continue to practice it because they believe that, by doing so, they will be aware that bad luck can happen and that, in the future, they will not be surprised.[Artikel ini membahas tentang makna potong konde bagi pengantin wanita di kalangan umat Islam Gunung Meriah Aceh. Pemotongan konde biasanya dilakukan pada acara resepsi pernikahan (walimat al-'ursy). Data dikumpulkan melalui observasi dan wawancara. Berdasarkan penelitian empiris dapat disimpulkan bahwa pemotongan konde untuk mempelai wanita di kalangan masyarakat muslim Gunung Meriah merupakan bagian dari hukum adat perkawinan setempat. Secara fisik, pemotongan konde bertujuan untuk memperindah rambut dan alis pengantin. Selain itu, upacara tersebut juga dimaksudkan untuk meramalkan masa depan rumah tangga yang akan dialami oleh mempelai dan keturunannya. Jika ramalan tersebut menghasilkan sesuatu yang tidak diharapkan, maka masyarakat akan melakukan doa secara berjamaah. Dalam hukum Islam, praktik ini tidak memiliki pembenaran teologis.
