Se discutió el alcance del reconocimiento al estudiar las dos teorías que justifican la protección animal, y los criterios esbozados por la Corte respecto a derecho animal. De esta forma, los resultados sugieren que la teoría animalista es la idónea para crear un régimen jurídico de protección animal, ya que individualiza y otorga valor intrínseco a los animales, a diferencia de la teoría ecologista adoptada por la Corte. Además, el cambio de estatus a favor de los animales silvestres excluyó a la fauna urbana, por lo que la decisión limitó su ámbito de protección.\u0000\u0000Abstract:\u0000\u0000This commentary is an analysis of the Ecuadorian constitutional jurisprudence on the recognition of wild animals as subjects of rights. The scope of the recognition was discussed by studying the two theories that justify the protection of animals and the criteria established by the Court regarding animal law. In this way, the results suggest that the animalist theory is the ideal one to create a legal regime for animal protection, since it individualizes animals and gives them intrinsic value, unlike the environmentalist theory adopted by the Court. {"title":"El Nuevo Pacto por la Naturaleza de la UE. Esta estrategia difiere en varios aspectos de los catálogos de buenas intenciones que la precedieron. La Comisión propone ahora seguir un enfoque ecosistémico holístico, que ya no se limita únicamente a la protección de las zonas protegidas. Sin embargo, el éxito de esta reforma depende de complejos procesos normativos en los que directivas y reglamentos se entrecruzan para formar una noria de políticas públicas, sujetas a competencias de geometría variable, en las que participan instituciones con intereses divergentes, cuando no antagónicos. El artículo ofrece una actualización de los avances de esta reforma, complementaria de la transición energética que debe permitir a la UE alcanzar la neutralidad climática en 2050.\u0000\u0000Abstract:\u0000\u0000The European Commission’s Biodiversity Strategy was adopted in 2020 as an extension of the Green Deal. This strategy differs in several respects from previous communications. The Commission now proposes to endorse a holistic ecosystem approach, which is no longer limited solely to the protection of protected areas. However, the success of this reform depends on complex regulatory processes in which directives and regulations, subject to competences of variable geometry, involving institutions and authorities with divergent, if not antagonistic, interests. In this scenario, the energy community, as a new legal entity, driven by European regulations, can be considered an effective tool to fight against climate change, accelerating the energy transition and guaranteeing a fair and inclusive energy system so necessary in our country. At the national level, the legal framework that regulates energy communities is insufficient. Thus, is it necesary a legal, technical and financial development to promote the constitution of such entities. In this paper, we study their legal nature, proposing, within the framework of Social Economy organisations, the associations and cooperatives as suitable legal formula. {"title":"La exigencia de una gestión eficiente de los residuos municipales en el contexto de la estrategia de economía circular","authors":"María Soledad Soriano Amores","doi":"10.56398/ajacieda.00278","DOIUrl":"https://doi.org/10.56398/ajacieda.00278","url":null,"abstract":"Resumen:\u0000El marco normativo diseñado por la estrategia de economía circular en materia de gestión de residuos obliga a las entidades locales a replantear buena parte de las tradicionales actuaciones llevadas a cabo en este ámbito competencial, especialmente por la regulación de distintos elementos reglados relativos a su vertiente económica. En este trabajo nos centramos en dos aspectos. El primero se sitúa en la redefinición de las competencias locales, en particular, la expresa delimitación del clásico servicio obligatorio de recogida, transporte y tratamiento de residuos a los definidos como domésticos y la complementariedad necesaria en la actual estrategia de las funciones relacionadas con la planificación o programación y la gestión de la información relativa a los residuos municipales. El segundo se dirige a la regulación dada de la vertiente económica en la gestión de los residuos municipales exigida a los distintos implicados y manifestada en la expresa imposición de gestionarlos con base en los fundamentos del principio de eficiencia (en su triple vertiente: medioambiental, económica y social), con especial relevancia de los denominados por la norma estatal como costes necesarios en la renovada regulación de la responsabilidad ampliada del productor.\u0000Abstract:\u0000The regulatory framework designed by the circular economy strategy in the field of waste management forces local authorities to rethink many of the traditional actions carried out in this area of competence, especially for the regulation of various regulated elements related to its economic aspect. In this paper we focus on two aspects. The first is the redefinition of local competences, in particular, the express delimitation of the classic obligatory service of collection, transport and treatment of waste to those defined as domestic and the necessary complementarity in the current strategy of the functions related to the planning or programming and the management of information related to municipal waste. MPAs are vital for the preservation of biodiversity and, if managed appropriately, are an efficient means of safeguarding maritime ecosystems.\u0000\u0000There are currently 25 MPAs in Peninsular India and 104 MPAs in the Islands of India, but for the preservation and conservation of these areas, there is no specific and effective legislation. Even though India, a member of the Convention on Biological Diversity, emphasises a “higher level of protection for marine and coastal biodiversity” compared to other forms, the reality is distant from this.\u0000\u0000Therefore, managing MPAs in India is a challenging task.
