Khiyar al-majlis refers to an option for both contracting parties either to revoke or to continue with the contract before departing from the contracting session. This option is made lawful in Islamic law to ensure the absolute consent of the parties to the agreement and to give them adequate time to think carefully about the conclusion of the contract. However, the Hanafi and Maliki Schools do not advocate khiyar al-majlis, they advocate khiyar al-qabul (option of acceptance) instead. This study prefers the validity of khiyar al-majlis and discusses its applications. This is a qualitative study and classical references of the prominent Schools of Islamic law have been employed as the primary sources of the study. The study posits that in the case of a face to face contract khiyar al-majlis might be practical. But, in the case of online or distant contracts it is not practical because it would be difficult to determine whether the parties are continuing the session or not. Thus, in online contracts khiyar al-qabul is more practical and hence after making an offer and acceptance the contract is concluded, though the contracting session is prolonged.","PeriodicalId":53787,"journal":{"name":"Turkish Journal of Islamic Economics-TUJISE","volume":"36 1","pages":"37-50"},"PeriodicalIF":0.3,"publicationDate":"2017-08-10","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"85108720","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The effect of retail loans, in which mortgage and consumer loans have a great share, in the profitability of banks has not been analyzed in detail so far. The main items of retail loans, like mortgage and consumer loans, contribute greatly to the risk management of banks with their characteristics like having regular cash flow in banks. Due to the structure of the guarantee and mortgage loans, which provides low risk weight, it is important to determine the capital needs of banks. However, due to relatively long maturity structure, mortgage loans also feed the maturity mismatch risk, which is the basic problem of banking system. Such loans, with which low costs are provided in favor of the clients, play a considerable role in the profitability of banks. Consumer loans, on the other hand, are provided to the clients in shorter maturity periods and with costs that are more in favor of banks. In the scope of this study, the effects of retail loans on conventional banks and participation banks, which are active in Turkey, have been investigated for mortgage and consumer loans. The findings of the study show that retail loan types have strong negative effects on Net Interest Margin (NIM), which has been selected as the profitability indicator for conventional banks in the scope of the study. For Participation Banks, on the other hand, unlike conventional banks, retail loan types have stronger and more positive influences on Net Profit Share Margin (NPSM). The findings of the present study are important for further studies that will be conducted on retail banking and for comparative studies on performance assessment.","PeriodicalId":53787,"journal":{"name":"Turkish Journal of Islamic Economics-TUJISE","volume":"3 1","pages":"19-34"},"PeriodicalIF":0.3,"publicationDate":"2017-08-05","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"75559007","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It employs the econometric methods of unit root, co-integration, and Granger causality in a VECM framework; and the results, which are robust to all measures of Islamic finance development, show a unidirectional short and long run causality from Islamic finance development to economic growth. The issue behind the low savings is the increase in food prices, taxes, and interest rates for the borrowers. In response to these problems, the Malaysian government provides cash transfer BRIM as one of redistributive measures. However, it is still not enough as many of the bottom 40 percent are neglected to avail the facility. In such circumstances, the role of community-based cash and credit transfer schemes such as cash waqf can be more fruitful. However due to inefficiency of the awqaf institutions regarding financial management, the system cannot contribute effectively. Therefore, the main aim of the paper is to provide an efficient mechanism which can ensure effectiveness in terms of transparency, collection and distribution of cash endowments and its benefits. Hence, by means of library research, we have proposed a conceptual framework. It is suggested that collection and distribution of cash waqf through crowdfunding platform would solve both transparency, collection and distribution issues. This study would provide a ground for those researchers and practitioners who are working on finding the right approach to implement waqf in more efficient way. Therefore, the paper examines and gauges the level of understanding of Nigerian sharī‘ah scholars (the custodians of sharī‘ah rules in the country) and their perceptions of the Islamic banking and its rules particularly interest ( ribā ). Survey method involving the use of purposive sampling was adopted to administer 1,040 copies of a questionnaire on the Nigerian Sharī‘ah scholars though some key people were also interviewed. The questionnaire which contains 19 items was designed to elicit information from them on issues such as their understanding of ribā , its uses in the Qur’an, Islamic banking products, collateral security and promotion (promos). Our findings revealed that the respondents (917) who considered usury to be forbidden were more than those who considered (871) interest to be forbidden. A large number of Sharī‘ah scholars (93.6%) confused interest with usury which suggests that both interest and usury refer to ribā. Some believed that only usury refers to ribā (48.6%) while most of the respondents (74.1%) opined that all forms of interest are prohibited. About 73.7%, 86.3% and 27.6% of the respondents believed r ahn (collateral security), innovating interest-free financial products and patronising conventional banks respectively were allowed. banking and finance. This paper elaborates the contribution of selected waqaf entities in Turkey and Malaysia in improving the socio-economic conditions of the society. The waqaf entities involved in this study include two corporate waqaf institutions from Malaysia, namely Al-Bukhary Foundation and Kumpulan Waqaf An-Nur Berhad;  and four waqaf entities in Turkey, namely, IHH Foundation, Diyanet Foundation, Hakyol Foundation, and TIMAV. This study discusses the projects and programs undertaken by these selected waqf entities to achieve their respective objectives.  Such a comparison is important considering the diverse experiences of these selected waqaf entities in view of the differences in their endowments and different corporate management models.
