{"title":"Pacas Choquenzá: una experiencia poscapitalista sobre la producción de lo común","authors":"Sara Otalora Estrada","doi":"10.53010/elhn7073","DOIUrl":"https://doi.org/10.53010/elhn7073","url":null,"abstract":"The Paca Digestora Silva [a composting technique], a system for using organic waste, arrived in 2019 in the Niza Antigua neighborhood in the Córdoba wetland, northwest of Bogotá (Colombia). Since then, the pacas (composting piles) have become a way of transforming pre-existing neighborhood dynamics and fostering the care of the common land, despite certain logics of fragmentation based on the defense of one’s own well-being. The Paca Digestora Silva is proposed here as a post-capitalist alternative that goes beyond the human-nature structural rupture so that the race for capital accumulation, reflected in landfills, can be overcome with the resignification of waste. The paper is constructed from the intersectional perspective of feminist political ecology and relates the process of pacas to the production of communality and the commons. This lens allows the analysis of care through two intertwined routes since the commons propitiate the care of a common good, and, in this care, which is reproduced in the doing in common, a community that watches over its protection and subsistence is strengthened or consolidated. This article documents community experiences with pacas and provides an alternative reading of this system, which transcends the dimension of waste utilization and demonstrates the possibility of building an ethic of care based on collective action.","PeriodicalId":508731,"journal":{"name":"Naturaleza y Sociedad. Given that these damages may deprive certain persons of the use or enjoyment of the values that the ecosystems they inhabit provide them, this research aims to answer the question of what is the ideal way to order the reparation of harm attributable to the State, of the individual facet of the constitutional right to a healthy environment. For this purpose, the methodology of the jurisprudential line proposed by López Medina (2006) is applied to those cases where direct consequential environmental damage is attributable to the State, arguing that the ideal way to compensate for this type of damage is reparation in kind. It is suggested that disregard for the individual facet of the right to a healthy environment in the contentious administrative jurisdiction implies that the reparation of environmental damage is partial; therefore, the study proposes as a solution a sentence in which the Council of State unifies its jurisprudence recognizing the individual facet of this right.","PeriodicalId":508731,"journal":{"name":"Naturaleza y Sociedad. It details the accompaniment of the community and how these new technologies were integrated into traditional practices. However, the extent to, and manner in which, constitutional law (with its elevated status) has been instrumental in the conferral of these ‘riverine rights’ is still not well-understood. In this article, we consider the constitutional relevance of the recognition of rivers as legal persons or subjects in Aotearoa New Zealand, Colombia and India. We argue that in these three countries riverine rights are constitutional experiments: as small-scale, ad hoc and ultimately incomplete attempts to transcend seemingly ineffective regulatory frameworks for rivers. After its declaration as a reserve, new environmental management systems were established, and the local population had to incorporate new institutions and, with this, new permitted and prohibited actions. The methodological strategy consisted of a mixed study that included surveys in eight municipalities with a convenience sample of 400 people and key informant interviews. The results reveal that, although the initial configuration by decree was top-down, the information that all inhabitants needed to recognize the institutions responsible for the new policies was not disseminated. Therefore, after almost 24 years, the need for an integrated and participatory management that actively includes the local community and the various entities involved is still pending.","PeriodicalId":508731,"journal":{"name":"Naturaleza y Sociedad.
