Green contract disputes are on the rise as the industry embraces more sustainable practices and attempts to align itself with higher environmental values. This paper aims to highlight the underlying limitations of sustainability and its current degree of implementation and acceptance within the industry to fully capture the factors that give rise to contract disputes in sustainable construction. The research method used in this paper is a comprehensive review and analysis of key findings and knowledge gaps in academic literature. Identified risks include the potential loss of tax incentives for failure to secure certification under recognized standards such as Leadership in Energy and Environmental Design (LEED). Other risks include ambiguous contract language, lack of contract clauses or provisions related to the project’s sustainability goals, and finally limitations on insurance coverage in sustainable project contracts.
