Siegel","doi":"10.1080/08997225.2006.10556338","DOIUrl":"https://doi.org/10.1080/08997225.2006.10556338","url":null,"abstract":"We don’t usually spend much time in this annual essay on non-decisions, such as denials of certiorari, or applications for a stay of a lower court decision to individual justices. But Justice Ginsburg’s refusal to vacate an order by the Ninth Circuit in Doe v. Gonzales 1 is at least worthy of mention. At issue was that part of the Patriot Act providing that when the FBI issues a “national security letter” to an individual or group (here, to “a member of the American Library Association”), the recipient is not permitted to tell anyone of the FBI’s visit. Thus the executive director of the Connecticut-based library group was risking his freedom when he consulted the American Civil Liberties Union, and the Connecticut ACLU affiliate’s legal director had to speak only in the vaguest terms when she, as per the affiliate’s guidelines, sought permission of the Board (on which I sit) to take the case. As became apparent during the litigation, the gag order seemed more a function of the administration’s desire to prevent the librarian and similar NSL recipients from testifying in Congress, which was then considering extension of key Patriot Act provisions. Also deserving of comment, though not extended discussion, is the Court’s per curiam opinion in Federal Election Commission v. Wisconsin Right to Life, Inc. Here the Court, which had recently upheld against facial challenge portions of the McCain Feingold Act prohibiting certain kinds of “electioneering communications” close to Election Day, was asked to consider whether an “asapplied” challenge could be brought. The Court sends the case back to a special 3-judge federal district court for further fact finding. More detailed examination of the case will appear in our review of the 2006-2007 term, in which the case returned to the Court, resulting in a 5-4 decision finding that the Act could not be constitutionally applied to the ads run by the non-profit group. As to First Amendment cases in which the Court did reach the merits, the 2005-6 term included a campaign financing decision from Vermont, a decision finding against the claimed associational and “right not to speak” claims of law schools seeking to apply to the military their requirement that all employers wishing to participate in on-campus job fairs sign a non-discrimination pledge (which could not be signed, given the continuing application of the military’s “don’t ask, don’t tell” policy against gays), a decision upholding strict restrictions on certain prisoners’ reading materials, and a broad ruling to the effect that public employees’ speech that is a part of their job duties generally will not enjoy First Amendment protection. We now examine those four cases in turn.","PeriodicalId":439135,"journal":{"name":"Free Speech Yearbook","volume":"73 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2006-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"129728771","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

As the private right of the individual, freedom of expression is an end in itself, but it is not the only end of man as an individual… Any theory of freedom of expression must therefore take into account other values, such as public order, justice, equality and moral progress, and the need for substantive measures designed to promote those ideals. Hence there is a real problem of reconciling freedom with the other values and objectives sought by the good society (Emerson, 880).","PeriodicalId":439135,"journal":{"name":"Free Speech Yearbook","volume":"19 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2006-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"125196345","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
