Sørensen","doi":"10.1558/ijsll.19649","DOIUrl":"https://doi.org/10.1558/ijsll.19649","url":null,"abstract":"According to a widespread norm among legal representatives, legal interpreters should translate verbatim, or at least as close to the source utterance as possible. Yet, sociolinguists have shown repeatedly that the absence of verbatim translation is not inherently problematic. Differences between source utterances and their translations may in fact facilitate understanding. On the basis of a corpus of audio-recordings from a court in Denmark, we analyse differences between a request presented by legal representatives and then the interpreters’ versions. We focus on a routinised and procedural request, usually presented by the prosecutor and addressed to the judge, and very often conveyed in a highly implicit manner. We demonstrate that the interpreters tend to elaborate and add particular types of information in their translation. We argue that the additions facilitate understanding for the accused, as many inferences, based on institutional insight, are needed in order to understand what the prosecutor means. We also point to the paradox that, although interpreters are tasked with creating understanding, it is almost impossible to assess whether they succeed and what insight the accused obtains. This is due to the institutional organisation of the type of court hearing analysed.","PeriodicalId":43843,"journal":{"name":"International Journal of Speech Language and the Law","volume":" ","pages":""},"PeriodicalIF":0.4,"publicationDate":"2021-10-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"43626810","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":4,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Policies like lockdowns can negatively impact citizens’ wellbeing (e.g. Rossi et al. 2020), including professionals working with sensitive data and in legal settings (e.g. Barros et al. 2020). For the first time, this article addresses how this general crisis may have affected forensic linguistics caseworkers’ practices and wellbeing. In November 2020, a fixed-response questionnaire was circulated among the forensic linguistics online community. Results show that the most consequential changes in the caseworkers’ professional practices brought about by the pandemic have to do with their working environment and schedule. Following the discussion of the results, some recommendations regarding caseworkers’ self-care are outlined and discussed. Given the constant changes in policies and the evolution of the pandemic, further surveys and a general discussion concerning practitioners’ wellbeing would benefit this professional community.","PeriodicalId":43843,"journal":{"name":"International Journal of Speech Language and the Law","volume":"27 1","pages":"233-254"},"PeriodicalIF":0.4,"publicationDate":"2021-05-21","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"41348263","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":4,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Few examine how judges actually sentence.  This article provides an insight into the empirical reality of judges’ sentencing practices  by examining how judges use counter to frame their judgement of offenders  and their behaviour in six sentencing remarks. The six sentencing remarks were  selected to ensure that variations in sentencing decisions of the six cases were, at  least to a large extent, subject to judicial discretion. It finds that the statutory point  exercises a binding effect on judicial sentencing despite judges having the discretion  to disregard the starting point. The finding leads to the further inference that judges  might possibly perceive the Court of Appeal and the public as two important audiences  for their sentencing remarks.","PeriodicalId":43843,"journal":{"name":"International Journal of Speech Language and the Law","volume":"27 1","pages":"209-231"},"PeriodicalIF":0.4,"publicationDate":"2021-05-21","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"45205390","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":4,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

However, indirect reported speech and narrative reports of speech (Leech and Short 1981[2007]; Chafe 1994) have not received such attention in veracity assessment research. The current study investigates whether these types of reported speech (along with speaker identities and the use/non-use of quotation marks) act as indicators of veracity in a corpus of truthful and deceptive negative online hotel reviews developed by Ott, Choi, Cardie and Hancock (2011). Logistic regression modelling found that type of reported speech and speaker identity were significant, with deceptive reviews more often using indirect reported speech and truthful reviews featuring speaker identities other than the reviewer or hotel staff. This article contributes to our understanding of deception detection by considering theoretically meaningful classes of indicators (Burgoon 2018) and connecting previous approaches from multiple fields and perspectives.","PeriodicalId":43843,"journal":{"name":"International Journal of Speech Language and the Law","volume":" ","pages":""},"PeriodicalIF":0.4,"publicationDate":"2021-05-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"45034441","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":4,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
