También se examinan y se proponen algunas medidas preventivas destinadas a acelerar los procedimientos y a corregir los retrasos de los tribunales, así como otras de carácter reparatorio.The paper analyzes the doctrine established by the European Court of Human Rights on the violation of the right to be tried within a reasonable time of art. 6.1 of the European Convention of Human Rights and its application to the Spanish State in the condemnatory judgments that until now have been pronounced. {"title":"La influencia de la CEDH y la jurisprudencia del TEDH en el ordenamiento constitucional italiano","authors":"Roberto Romboli","doi":"10.5944/TRC.42.2018.23638","DOIUrl":"https://doi.org/10.5944/TRC.42.2018.23638","url":null,"abstract":"El ensayo examina la influencia del CEDH y de la jurisprudencia del TEDH en el ordenamiento constitucional italiano, señalando la considerable importancia que tuvo, en ese ámbito, la ubicación de la Convención en el sistema de fuentes y la atribución a la misma del nivel de ley ordinaria. En particular, se evidencia cómo en Italia la influencia del Convenio ha comenzado a partir de las denominadas «sentencias gemelas» de 2007 de la Corte Constitucional, pues la interpretación del Constitucional permitió que se utilizara el CEDH como parámetro en los procesos de control de constitucionalidad de las leyes. Eso dio lugar a un contacto más estrecho con el TEDH y, por tanto, también a posibles casos de conflicto, que se analizan detalladamente. Se presta especial atención a la eficacia de la interpretación del CEDH por el TEDH y al tema de la eficacia de las sentencias que condenan a los Estados, indicando dos tipos de obstáculos: los de carácter procesal, es decir, el valor de la cosa juzgada y los de carácter normativo, a saber, la presencia de una ley nacional. En este segundo caso, se subraya como la solución es diferente dependiendo de si se consideran los efectos de las sentencias del TEDH respecto de la parte que resultó victoriosa en el proceso ante el TEDH o de otros sujetos que están en la misma condición sustancial, pero que no estaban presentes en el proceso que terminó con la condena. El escrito finaliza con unas breves observaciones sobre algunos acontecimientos recientes o futuros, como la entrada en vigor del Protocolo XVI del CEDH, la adhesión de la Unión Europea al CEDH y una eventual reforma del modelo de justicia constitucional italiano.The essay focuses on the level of influence that the ECHR and the European Court's case law exercise on the Italian constitutional system, revealing how important it has been to collocate the Convention in the sources of law's system and to recognize that it has the same level of ordinary statutes. It is particularly underlined how, in Italy, the ECHR influence started wit the “twins judgments” of the Constitutional Court in 2007, which helped the use of the ECHR as a parameter , of the constitutional legitimacy of statutes. This created a much closer contact with the European Court and, consequently, many possible occasions for conflicts, which are widely analyzed. Particular attention is dedicated to the importance of the European Court's interpretation of the ECHR and to the effectiveness of the condemnations of the States by the European Court, highlighting two obstacles: the ones depending on procedure law, with special reference to the value of judgments, and the ones depending on substantial law, with special reference to the existence of a national statute. In this second case, the solution is different depending if we consider the situation of a subject that is part of the trial or the one of a subject that hasn't been apart of it. {"title":"Ejecutar en España las sentencias del Tribunal Europeo de Derechos Humanos. Se comienza así señalando la cualidad sustancialmente constitucional que han adquirido el Convenio Europeo de Derechos Humanos y el Tribunal de Estrasburgo en un marco ordinamental caracterizado por la subsisidiariedad como instrumento óptimo para la garantía tanto del texto normativo como de las sentencias de su guardián. De aquí se deduce un tratamiento de estas últimas que pone el énfasis en la obligatoriedad de su cumplimiento. Éste es el sentido de la jurisprudencia del TEDH de modo que se ha podido hablar de la distorsión del carácter declarativo de sus resoluciones. Considerando el carácter constitucional del CEDH y del TEDH, y dada la necesidad de asegurar la eficacia de su doctrina para garantizar los derechos, se repara en el ordenamiento constitucional interno español entendiendo que es el derecho a la tutela judicial efectiva (ex art. 24) como derecho a la ejecución de lo juzgado el que hace necesario un procedimiento específico como el que se establece finalmente en la LO 7/2015.This paper studies the execution in Spain of the judgments of the European Court of Human Rights from the perspective of Constitutional Law, more specifically from the perspective of the European Constitutional Law. This begins by pointing out the substantially constitutional quality that both the Convention and the Court have acquired in an ordinamental framework characterized by the principle of subsidiarity as the optimal instrument for guaranteeing both the normative text and the judgments. From this we can deduce a treatment of the latter that puts the emphasis on the obligatory nature of its fulfillment. This is the meaning of the ECtHR jurisprudence so that it has been possible to speak of the distortion of the declaratory nature of its resolutions. Se realiza tanto un análisis global comparado en relación con países de nuestro entorno, como un examen cronológico de los asuntos que nos afectan. Se realiza también un estudio estadístico de los derechos más invocados y de las condenas reiteradas en relación con los derechos procesales y materiales. Resulta necesario, para acometer esta tarea, acomodar previamente la terminología empleada por el Tribunal Europeo de Derechos Humanos a nuestra dogmática de los derechos fundamentales. Se ofrece, finalmente, una síntesis básica de la doctrina jurisprudencial sobre cada uno de los derechos.The study is a joint exam of the more than a hundred ECHR Judgments condemnating the Spanish Kingdom. We make a global analysis comparing them within our nearest neighbours, while following a chronological path. Also we aim to make a statistical survey about the main rights claimed in Strasbourg, closely related to both substantive and procedural rights. We find necessary, also, to fit better the Strasbourg Case-Law terms into our national legal and fundamental rights terms. On the other hand, the European Pillar of Social Rights, with its objective of improving the positive integration of the euro system, seems to expand the content of some social rights contemplated by the EU Charter of Fundamental Rights. From an international and comparative perspective, it aims to establish that proportionality analysis is the most appropriate standard for the judicial enforcement of this right. In order to accomplish this aim, it compares and assesses the use of the standards of reasonableness, the minimum core and proportionality analysis. It shows that proportionality offers more advantages and fewer disadvantages than reasonableness and the minimum core in the circumstances of adjudication of the constitutional right to water.
