Luk, Samantha Sint Nicolaas","doi":"10.52024/tseg.8458","DOIUrl":"https://doi.org/10.52024/tseg.8458","url":null,"abstract":"The Dutch Golden Age is often referred to as a prime example of Dutch tolerance with regard to the ‘open’ policies towards migration and the harmonious co-existence of migrants with their local neighbours. Considering that, before 1800, migrants made up approximately 25-60 percent of the urban communities of the early modern Dutch Republic, and that there is evidence of the rise of many stereotypes about these migrants, this rosy picture of Dutch tolerance is drawn into question. How exactly this tension between tolerance and the persistence of these stereotypes played out in the daily realities of migrants living in early modern Dutch cities remains an understudied area of research. This article identifies the overlaps between existing research in the fields of migration history, urban history and social legal history, as well as the areas in which these approaches can further supplement each other. The first section of the article looks at the annual arrest and prosecution rates for vagrancy in Antwerp and Brussels between 1880 and 1910, as well as at the daily instructions from the city authorities and police chiefs to their policemen on how to deal with vagrants and unwanted newcomers. Next, drawing on a selection of archival records of the central police divisions of Antwerp and Brussels from the 1880s, we examine if and how police controls focused on mobile groups when they dealt with vagrancy, and whether they answered the preoccupations of local authorities. In line with the findings of other scholars, we demonstrate that the notion of vagrancy was so elastic that, in both cities, many different groups were arrested and prosecuted for this offence.  Next to foreign and internal migrants, the Antwerp and Brussels police also apprehended local people, born in the city or in the surrounding province, who were not necessarily mobile and often known to them. Subsequently, migration has become increasingly important within the research field. While this has led to new findings regarding women’s participation in crime in early modern metropolises, in contrast, little is known about prosecuting patterns in smaller urban centres in predominantly rural regions. This is particularly true for less urbanized territories, such as the geographical area of the Swiss Confederation. It is often assumed that women in big cities led more mobile and independent lives than their counterparts in smaller towns. This socio-economic difference in female profiles is used as the main explanation for the disparities in gendered patterns in the registration of criminality. By analysing the records of the criminal court of seventeenth-century Protestant Bern, this article aims to contribute to the understanding of women’s crime in early modern urban territories. The findings demonstrate that smaller towns could also show high levels of female defendants. However, the city of Bern was not a place of relative freedom for women. Rather, the opposite is true: the authorities’ control, focusing on an ordered society and household, led to strong formal control of mobility and (im)morality, which had a lasting impact on the prosecution of women.
