Budzinowski","doi":"10.14746/ppr.2019.25.2.1","DOIUrl":"https://doi.org/10.14746/ppr.2019.25.2.1","url":null,"abstract":"The fifteenth anniversary of the inclusion of Polish agriculture in the CAP mechanisms prompts one to make summaries and comparisons and formulate evaluations of the development of the science of agricultural law in the European context. The deliberations presented in the article are an attempt to formulate a few valid reflections, focusing on the comparison of the EU agricultural acquis, the general (theoretical) agricultural (national) law issues, traditional agricultural law issues, agri-food and agri-environmental law and rural development. As it is demonstrated in the article, the distance between the Polish science of agricultural law and Western European science has significantly narrowed. The issues undertaken by Polish agricultural lawyers fall within the scope of interest of their Western European counterparts. Suchoń","doi":"10.14746/ppr.2018.23.2.1","DOIUrl":"https://doi.org/10.14746/ppr.2018.23.2.1","url":null,"abstract":"The aim of the author of the article was to determine the impact of the amendments to the legal regulations, especially those introduced by the Act of 14 April 2016 on suspending the sale of real estate from the State Treasury Agricultural Property Stock, on the forms of property development. In particular, it is to determine which of these forms dominate and to indicate the legal conditions related to their functioning. Among other things, it has been noted the sale of the property from the State Treasury Agricultural Property Stock has significantly decreased in comparison with the years 2009–2014, while the area of agricultural land being leased is growing. The amendments to the regulations have therefore strengthened the role of leasing in rural relations. Moreover, the National Agricultural Support Centre enjoys greater rights when selling agricultural property from the State Treasury Agricultural Property Stock, not only before but also after the contract of sale is finalised. {"title":"Politiche europee e nazionali di contrasto allo spreco alimentare nella produzione primaria: analisi e prospettive future","authors":"L. Costantino","doi":"10.14746/ppr.2018.23.2.10","DOIUrl":"https://doi.org/10.14746/ppr.2018.23.2.10","url":null,"abstract":"Lo scopo dell’articolo è di presentare la regolamentazione del mercato agricolo in Nicaragua e di indicare soluzioni giuridiche che potrebbero contribuire a superare una distribuzione iniqua delle risorse economiche derivanti dall’attività agricola nazionale all’interno della filiera alimentare. In particolare, si tratta di individuare scappatoie giuridiche che contribuiscono ad una distribuzione iniqua delle risorse nel regime nicaraguense di approvvigionamento per i prodotti agroalimentari e di proporre soluzioni alternative per la loro eliminazione alla luce della scienza del diritto agrario. Secondo l’autore, la principale difficoltà per il produttore agricolo nicaraguense è il processo di commercializzazione dei prodotti sul mercato dei prodotti agricoli dell’America centrale e del Nicaragua nonché carenze normative in questo ambito. Il Sistema dell’integrazione centroamericana (SICA), vincolante nella maggior parte dei paesi della regione, da un lato contiene regolazioni giuridiche complete sull’agricoltura, dall’altro non corrisponde pienamente alla struttura moderna della filiera agroalimentare. In pratica, la legislazione regionale e nazionale è soggetta a frequenti cambiamenti e non protegge in modo sufficiente il produttore agricolo in ogni fase di produzione. In particular, the functioning of the system of fees in various EU Member States has been analysed. It has been found out that despite the fact that the EU legislator has regulated the system of financing official controls of foodstuffs, most national regulations do not provide sufficiently for the proper functioning of the control system, and do not ensure that all costs incurred are recovered. Puślecki","doi":"10.14746/ppr.2018.23.2.4","DOIUrl":"https://doi.org/10.14746/ppr.2018.23.2.4","url":null,"abstract":"The purpose of this article is to define the normative form of a harvesting help contract and to resolve any doubts that may arise in its practical application. Due to the occurrence of accidents in agriculture, it is also necessary to answer the question to what extent the legal regulation of agricultural social insurance should provide protection for farmers’ helpers (assistants) against the loss of their ability to work. In conclusion, the author states that the Insurance Act regulates a new type of contract − a harvesting help contract − but the scope of its regulation raises serious doubts. The legislator has introduced a non-synthetic definition of the term and while only vaguely defining the rights and obligations of the farmer, defines in too much detail those of the helper. The analysed regulation does not provide for any specific form of the contract or its contents regarding the activities of duties performed during harvesting or the level of pay for the work provided. The protection of the helper is limited to the provision of health insurance and accident insurance benefits only. Investing in the growth of social capital refers to the postulates of implementing an integrated model of rural development, where different local actors engage and cooperate for the common good. Agricultural law also faces these challenges. The social capital of rural areas is characterised by bottom-up activities, locality and territoriality of initiatives, an integrated approach, a partnership action through local action groups, innovation in problem solving, independent management and financing of activities. The solutions provided for in this legislative act have been criticised. Consequently, as of 1 January 2018, this act has been replaced by Regulation No. 2015/2283. The aim of the deliberations presented in this article is to answer the question whether and to what extent the new solutions actually facilitate the placing of novel foods on the EU market while ensuring at the same time a high level of protection of consumers’ health, life and economic interests. In the author’s opinion, Regulation No. 2015/2283 introduces many amendments aimed at facilitating the introduction of novel foods to the EU market, which also satisfy the aboveconcerns. The systematics contained in Act No. 313 of 24 December 2004 on apiculture has been analysed. Article 3 of this Act determines the agricultural character of the apiculture activity, qualifying it as an agricultural activity in the light of Article 2135 of the Civil Code. Migratory beekeeping, also classified as a related agricultural activity, consists in the relocation of bees to different regions of the country in order to increase crop productivity. Further, Act No. 313 provides legal definitions of basic institutions related to apiculture and introduces various forms of protection and support for this activity, including those from the apiculture sector. {"title":"Prawne aspekty ochrony przed hałasem na obszarach wiejskich","authors":"Justyna Goździewicz-Biechońska","doi":"10.14746/ppr.2018.23.2.2","DOIUrl":"https://doi.org/10.14746/ppr.2018.23.2.2","url":null,"abstract":"The aim of the deliberations presented was an attempt to assess the legal system of the regulation concerning the protection of the environment against noise in rural areas, and to answer the question to what extent the current legislation takes into account the specificity of noise threats occurring in rural areas and whether it provides for an effective and adequate system of instruments for the protection of the acoustic climate of the rural environment. In the conclusion the author states that the specificity of noise prevention in rural areas has been adequately taken into account, despite a clear focus of the regulation put on noise in urban areas. The normative solutions contained in primary and secondary EU law have been analysed. It has been concluded that the specificity of agriculture and the accompanying risk require public support. The granting of aid should be properly shaped and stimulated. This is because of its universality and easy accessibility, which may reduce farmers’ efforts to take independent remedial measures when selecting legal risk management instruments.
