Traditionally, the rules of “Libro” III of the Peruvian Commercial Code have generated some uncertainty about their scope on this matter. This paper proposes an interpretation of the Commercial Code rules that allows to understand them in a coherent way, especially with the context in which they were passed. The many aspects around the liability of the owner of the ship exceed the field of mere civil liability and nowadays the obligations that the owner of the ship assumes under the public regulation constitute a very important aspect for the modern shipping company. This idea comes from a metaphor that remembers the antique masks on the Latin and Greek theatres. In Argentinian legal system, the concept of person cannot be understood without the characteristics of dignity, autonomous and being inviolable. In this context, in nowadays paradigm, person is understood specially from different roles in order to protect in the best possible way concreting rights. That leads to the fact that in economic right some individuals get special attention and special regulations in order to be more equal to the strongest part in the relationship. According to this, this paper will focus on the consumers/users and adherent’s roles. Legal protection is expressed through interpretative statements that change contractual law as it is usually conceived. It takes for granted that both parts in a contract are not equals but also treats differently those parts. To reach, the research uses the hermeneutic method, this looks for the origin, source and elements of the construction of the concept in the author. An analysis and study of the arguments and supports used by Amuchastegui to talk about solidarity in his vision as a philosopher of Law.
