The authors draw an important conclusion that the ancient ideas about law, freedom, the principle of justice, the idea of a just state system of individuals' life served as the basis for the development of modern concepts of human and citizen rights, their direct formal consolidation in the legal framework, the theory of the legal state and civil society. In the course of a comparative analysis and study of the fundamental provisions of the basic law of the Russian state in 1977, the authors come to the conclusion that many ideas of the thinkers of the XVIII-XIX centuries of Europe and Russia in one form or another were directly reflected in the modern Russian Constitution. The continuity of previous international and national regulatory acts, which reflected the fundamental provisions on the rights and freedoms of a person and a citizen, social equality, democracy, the principle of separation of powers, the rule of law and the law in the public and state regulation of a citizen’s life, contributes to the formation and development of civil society and the rule of law in the modern Russian Federation.","PeriodicalId":394596,"journal":{"name":"Bulletin of the South Ural State University series \"Law\"","volume":"61 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"126755911","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This is a difficult stage in the provision of medical services, which is a problem for both the doctor and patients due to the interaction of many different factors, including ethical and legal considerations. Obtaining informed voluntary consent is a prerequisite for the provision of medical services by organizations located in the international medical cluster. This article discusses the legislative and theoretical aspects regarding the mandatory requirements for the form and scope of patient consent to receive medical services. The foreign and domestic judicial prac-tice of disputes between medical organizations and patients is analyzed and compared. An assessment is given to the content of the information provided, the legal regulation of the relations of all participants in the process of obtaining medical services. The author con-cludes that there are some gaps in the legal regulation of information support for the quality of medical services. Based on the study, it is proposed to clarify the legislative requirements for informed consent, taking into account the types of medical care provided.","PeriodicalId":394596,"journal":{"name":"Bulletin of the South Ural State University series \"Law\"","volume":"87 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"123633104","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
