Starting with historical research, the article shows how LGBTQIA+ asylum has been consolidated in International Law and, specifically in Brazil, as a country where there are also cases of homophobia and transphobia, LGBTQIA+ asylum is guaranteed, even if the information requested from the Federal Police and the National Committee for Refugees from Brazil do not currently indicate whether the number of concessions specifically for these groups has increased or decreased. Addressing the cliquet effect, it demonstrates the impossibility of retroaction in terms of Human Rights, preventing the denial of the granting of asylum in Brazil to this people, which is the distinctive focus of the research. If the Hindutva movement is Brahmanical, how can it be the choice of those it seeks to oppress? This article examines this conundrum. It addresses three central arguments in claims that the movement is Brahmanical, showing how these are based on arbitrary, incomplete data (such as the claim that the Sangh Parivar is against caste-based reservations), or hide conceptual contradictions (such as the argument that the Sangh’s opposition to proselytization is casteist). Furthermore, taken to their logical end, explanations for the movement’s success amongst Dalit and OBC groups raise fundamental questions for/contradictions to the received view on the caste system. La política de Guerra Fría respaldada en la Ley Helms-Burton desde 1996, comenzó en 2019 una nueva etapa de acciones acrecentadas con la activación del Título III de dicha ley, para impedir la inversión extranjera en Cuba y favorecer un cambio de régimen. Este artículo pretende argumentar el impacto del bloqueo como medida coercitiva unilateral en un contexto sociopolítico irregular que se ha extendido por más de seis décadas en el caso cubano. The baseline clearly illustrates key features of the research field suggesting that while the field of research has become more multifaceted in the course of the last two or three decades, it is nevertheless very much dominated by law scholarship and structural analysis of legal service provision. Departing from this overview of access to justice research as of today, five calls for future research on access to justice explicated in the reviewed literature is presented and discussed. I argue that future research on access to justice should: 1) Reach a clearer understanding of the problem (of access to justice), 2) consider a multidisciplinary approach, 3) support and develop evidence-based policy by committing to empirical research, 4) study a wider variety of social realities and 5) look for quality. Women’s access to judgeship was preceded by the admittance of women as public prosecutors in 2013, which is the main gate to become a judge in Kuwait. As of 2020, female prosecutors constitute 27 per cent of the total number of public prosecutors in Kuwait. The article points out drivers for change in Kuwaiti society which opened up for women’s appointment as judges. It addresses the five-year period between 2013-2020 preceding the appointment of women judges, and debates that arose when eight women judges were appointed amidst the coronavirus pandemic which broke out in March 2020. Three questions are explored: First, how and why have Kuwaiti women been appointed as judges in 2020, more than five decades after women entered the field of law studies in 1967? Secondly, what forms of opposition were voiced in public through the Kuwaiti media against appointing women as judges? La creación de la Subcomisión de género, conformada por la sociedad civil organizada, se instituyó como una medida innovadora que impulsó la incorporación transversal del enfoque de género en el Acuerdo Final de Paz (2016). Estas disposiciones han supuesto un avance en la incorporación de una justicia transicional equitativa en el país; que promueve la reparación del impacto diferencial de la violencia en las mujeres y la población LGTBI+. On such a basis, the courts of the Member State of refuge shall trust the courts of the Member State where the child was habitually resident immediately before the abduction being willing and capable to protect the EU fundamental rights of the child concerned. Therefore, they should not refrain from enforcing a certified judgment requiring the immediate return of the child, even in situations where there is a clear risk that the return is contrary to that child’s best interests. The CRPD sets out legal obligations of States Parties to ensure de jure and de facto realisation of the right to vote by persons with disabilities. How can a disability researcher analyse compliance by States Parties with the CRPD? The present article argues that for achieving a fully developed disability legal scholarship, legal studies about the implementation of the CRPD need to combine the perspectives of jurisprudence and social sciences. Based on the author’s experience in carrying out the ongoing study “Voting Matters”, this article examines an innovative theoretical and methodological framework to understand how the CRPD is implemented through law and policy, and “in practice”. This means to investigate the “CRPD-in-action”. By conceiving law as institutional normative order the institutional theory can accommodate for the rich historical and cultural diversity in the forms of law. This article analyses the three components of the institutional theory, i.e. norms, order and institutions, and gives a brief account of the types of norms that institutions bring together, their sociological dimension and the typologies of legal institutions. The notion of order is enhanced by the institutional theory to account both for claims to practical operation of the law and for the existence of conflicts, calling for institutional approaches to dispute resolution. This opening to “order and dispute” raises the question of justice and fairness of the norms and of the mechanisms of dispute resolution. Comparison of legal cultures needs to identify the legal fields that are being compared, with a view to producing a workable set of legal culture comparators for comparative purposes.
