Namun, masih terdapat segelintir masyarakat yang masih ragu-ragu dengan perkhidmatan yang ditawarkan institusi pajak gadai Islam berbanding pajak gadai konvensional. Walaupun mempunyai kelebihan dari segi caj upah simpan yang rendah serta proses pinjaman yang mudah, penyedia perkhidmatan perlu mengambil kira dua aspek ini sebagai cabaran mereka dalam memastikan kestabilan institusi dalam menawarkan perkhidmatan ini. Justeru, kajian ini bertujuan mengenalpasti faktor caj upah simpan dan proses pinjaman mudah dalam mempengaruhi persepsi masyarakat terhadap pajak gadai Islam. Kajian yang memfokuskan kepada staf akademik KUIM sebagai responden ini bersifat kuantitatif dan menggunakan analisis regrasi serta korelasi bagi melihat perkaitan hubungan antara pemboleh ubah. Ia didirikan dalam tempoh waktu dibenarkan berdasarkan jenis produk yang dipasarkan. Makanala al-wakalah adalah prinsip dalam muamalat Islam demgan meletakkan kerjasama untuk saling memerlukan di kalangan seluruh pihak yang berkenaan dalam satu majlis perjanjian. Objektif kajian ini meneroka keupayaan tindakan pihak terbabit dalam perniagaan francais di Malaysia berdasarkan kepada ketepatan prinsip al-wakalah. Oleh itu, kajian ini mengaplikasikan metadologi kualitatif untuk mencapai objektif kajian menerusi kaedah perpustakaan berdasarkan bahan rujukan seperti tesis, jurnal dan buku. Selain itu, sesi temubual turut dilakukan bersama pihak berkepentingan dalam perniagaan francais sama ada pengusaha francais dan organisasi sokongan berkaitan. Hasil kajian mendapati prinsip al-wakalah diterapkan dalam menjayakan perniagaan francais terutama kepada aspek pendaftaran, pemasaran produk dan publisiti. Bashir","doi":"10.33102/jmifr.v17i1.257","DOIUrl":"https://doi.org/10.33102/jmifr.v17i1.257","url":null,"abstract":"The main objective of the present paper is to empirically analyze the efficiency of 26 selected Islamic banks from different countries, namely: Bahrain, Jordan, Kuwait, Malaysia, Pakistan, Qatar, Saudi Arabia and UAE. The data used covers the period of 2012‒2016. To measure the banks’ efficiency, we used the frontier-based efficiency methodology, which was especially developed in the presence of panel data. In this respect, the panel data provided us with a fruitful framework for analyzing the efficiency. Therefore, the method employed was the shadow cost frontier based on the estimation of parametric cost inefficiency and its decomposition into both technical and allocative inefficiencies. The findings showed that the Islamic banks are costinefficient. With regard to the allocative inefficiency, it can be explained by excessive use of capital relative to labor, accompanied by an overuse of financial resources in terms of labor. The present study also revealed that the financial factor is overused, relative to the physical capital. Furthermore, technical inefficiency appears to be the second source of cost inefficiency as far as the Islamic banks are concerned. In Malaysia, the issue is exacerbated by insufficient employee savings to face retirement. The majority of Malaysian employees have savings no more other than mandatory savings of the Employees Provident Fund (EPF) account. On the other hand, waqf has many roles in the country’s economic development as it helps to improve welfare of the community. This paper aims to connect the gap between pension and waqf issues through a new proposed Waqf Based Pension Model. This study uses descriptive analysis to propose a Waqf Based Pension Model. This study employs library research approach to collect secondary data from journal articles, books, reports, and websites that contain existing pension schemes and waqf. This new model improves weaknesses in the existing pension scheme using annuity-based calculations. This study finds that productive waqf assets may be used to generate greater profits. In addition, waqf funds are then allocated to build the infrastructure needed by the community such as health services, education, housing, transportation and religious facilities. {"title":"Understanding the Motivation to Invest: A Profile Analysis of Islamic Funds’ Investors","authors":"M. The experience of faith-based and socially responsible investment clearly reveals the heterogeneity of investors with divergent investment motives, and this is highly likely to be true among Islamic funds’ investors as well. For this purpose, the study surveys Investors of Islamic funds from three fund management companies in Malaysia with a total sample of 451 respondents. The profiling employs a cluster analysis of the respondents using religion, percentage invested in Islamic funds, and four potential motivations to invest. The result shows a possible segmentation of the investors into three groups, with Muslim investors being segmented into two categories, ‘committed’ and ‘pragmatic’ investors, while the third category being the ‘non-Muslim’ investors. The clusters represent a clear distinction between the three groups in terms of their commitment to Shariah principles in investment, the importance of earning halal vis-à-vis high returns, and the benefits of diversification between Islamic and conventional funds. The regulation was imposed to curb unwarranted replacement of life insurance policy and to ensure the interest of the policyholders is continuously safeguarded. The regulation specified that agents shall not receive any commission for any policy which is construed as ROP. However, the regulation has placed MTR at a great disadvantage, since most of their clients, whom previously subscribed to conventional life insurance policy wished to switch to family takaful (a shariah-compliant version of life insurance). Unfortunately, according to ROP regulation, these cases were still considered as ROP. In Malaysia, it can be noted that some progress towards enhancing Islamic estate planning has taken place, particularly in the practice of Islamic will. Islamic estate planning industry in Malaysia has grown and now offers a variety kind of products to facilitate Malaysian Muslims to manage and improve their estate planning matters. Nevertheless, the value of unclaimed and frozen assets in this country keeps growing annually. Hence, this study aims to look at the practice of making wills in Malaysia and investigate factors that influence Muslims to do it. Using a quantitative analysis, a total of 338 questionnaires were used to achieve the objective. The method of analysis employed in this study include Independent Sample T-Test, One-Way Analysis of Variance (ANOVA), Pearson and Correlation as well as Multiple Regression. The results of this study indicate that there is a significant difference between gender (male and female), educational levels and monthly income levels towards Islamic will practice. Nevertheless, only ethnicity showed no significant difference towards Islamic will practice. The correlation analysis showed a significant and positive correlation between knowledge, wealth management, institutional factor and religiosity toward Islamic will practice. The results show that knowledge and wealth management are the main variables that influence Muslims towards Islamic will practice. This explains that higher level of knowledge and wealth management among Muslims will lead to a higher practice of Islamic will. In the course of doing this, Shariah reasons for imposing ta’widh and gharamah in Islamic banking are discussed. Also, whether ta’widh and gharamah would be required for Islamic banking with reference to possible alternatives to them is also discussed. This qualitative study primarily focuses on library research and adopts case study approach for analyzing the application of ta’widh and gharamah. The jurisdiction of the study is Malaysia because the central bank of the country has made policies on the matter. The paper draws on observations made by Shariah scholars about the policies on the subject matter. This study gives an insight into the history and issues related to ta’widh and gharamah which are often kept tacit.
