{"title":"أحكام احتباس الأمطار واشتداد نزولها والرياح العاصفة والصواعق ( دراسة فقهية مقارنة )","authors":"رغدة مثنى طالب, صادق خلف أيوب","doi":"10.37940/rjis.2023.1.1.1","DOIUrl":"https://doi.org/10.37940/rjis.2023.1.1.1","url":null,"abstract":"حثت الشريعة الاسلامية الغراء الى النظر والتفكر بما يحيط بنا من موجودات كونية و ما يشرع من الاحكام عند حدوث بعض الظواهر الكونية ، مثل احتباس المطر ، واشتداد نزوله ، والعواصف ونزول الصواعق ،وقد اختلفت تلك الاحكام بحسب نوع الظاهرة ، فيستحب فعل بعض الطاعات تقربا لله تعالى عند احتباس المطر كالاستغفار واخراج الصدقة و صلاة الاستسقاء والتي اجمعوا الفقهاء على مشروعيتها ،واختلفوا الفقهاء في ما يشرع من الاحكام عند اشتداد المطر فذهب بعض العلماء الى مشروعية الصلاة مع الدعاء ، أما الاخرون فقالوا بالدعاء فقط ، وفي اشتداد الرياح عبر وتحذير لذلك كان لابد من السير على خطى النبي محمد( صلى الله عليه وسلم) فيما كان يفعله ، وحصل اختلاف بين الفقهاء في حكم الصلاة عند اشتداد الرياح فمنهم من قال بالصلاة مستدلا بما ورد عنده من ادله ومنهم من قال لا يصلى عند اشتداد الرياح ، أما عند نزول الصواعق فيشرع لها طاعات خاصة هي محل اختلاف بين الفقهاء ثم تفصيلها في محلها .","PeriodicalId":345101,"journal":{"name":"Researcher Journal For Islamic Sciences","volume":"8 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"127886160","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

By arranging those terms alphabetically, relying on the wording that was mentioned in the Holy Qur’an text and not the linguistic root of the term, in order to facilitate the work of the researchers. Hence, the researchers began by referring to the linguistic definition in a brief to fulfill the term. One of the most reliable and broadest linguistic dictionaries, then the researchers supplemented the linguistic definition with the jurisprudential definition according to the four doctrines of the Sunnis and al-jama’h, in a scientific and sober manner, which is neither malicious nor boring. At the end of the research, the researcher presented the analytical study of terminology. He was a student of Al-Shams Muhammad bin Al-Mashreqi Al-Ghazi Al-Mufti, then he left for Cairo, where he took from Ibn Najim (died 970 AH), Amin al-Din Ibn Abdul-Aal (died 971 AH), and Ali bin Al-Hanai (died 979 AH), who was a judge of judges in Egypt. Allama Al-Tirtashi took knowledge from a group of scholars of his time, after which he returned to his country and became the head of the sciences and a reference in jurisprudence on the doctrine of Imam Abu Hanifa, and he was the head of the Hanafis in his time. Among his most prominent disciples was his son Saleh, who was born in 980 AH and died in 1055 AH, and he is the owner of \"zawahir aljawahir\" book .\u0000 Al-Tirtashi died in Gaza City in the year 1004 AH, leaving a large group of literature, the most important of which is the book Mu’een al-Mufti on the answer of the questioner, some of which I dealt with in this research, which is the book of division. Book of \"Alqismat \" in kitab Mu’een al-Mufti alaa jawab almustafti\".
