Without users consent the transfer of personal data from the website (“Fashion ID“) to Facebook is not admissable.1 An additional key finding for Facebook is that the data collection with the “Like“ button was illegal and Facebook is required to erase the respective data promptly. The ECJ did not explicitly mention this aspect due to the judgement that laid emphasis on the obligations of “Fashion ID“. But this consequence derives directly from the ratio of European data protection law. Finally, the ECJ confirmed that the consumers agencies can be granted additional rights to protect the users interest against the controller in national law. This approach tents to fail due to the fact that the consent to the privacy policy is deemed to be invalid: Firstly, the consent is not freely given when the users have no choice. Firstly, Facebook was required to notify the respective DPA of the incident within 72 hours according to Art. 33 GDPR. Secondly, Facebook adressed the hack to the Irish DPC as lead authority. According to Art. 56 GDPR the Irish DPC is the lead authority for Facebook within the EU. Facebook has its headquarters, which dertermines the purpose and means of the data processing of the Group, in Ireland. The case went through the whole proceeding of Administrative Courts in Germany. All three courts decided against the ULD. Eventually, the highest Administrative Court (Bundesverwaltungsgericht) asked the ECJ to provide a preliminary decision, whether Wirtschaftsakademie is responsible for the data processing on the fan page. The ECJ decided that Wirtschaftsakademie is responsible for the data processing as a joint controller.
