Mondino","doi":"10.19164/IJCLE.V26I3.861","DOIUrl":"https://doi.org/10.19164/IJCLE.V26I3.861","url":null,"abstract":"This paper shares some initial attempts to investigate the socio-legal dimensions of reflective practice in a sampling of clinical programs across several jurisdictions in Europe and elsewhere. These preliminary findings were presented at the most recent ENCLE Conference, which took place in Turin, Italy in September of 2018.  For some time now, our ‘transnational team’ -- comprised of clinical teachers from US, France, Spain and Italy -- has been exploring our common interest in researching the multiple roles reflective writing can play as a tool for assessing student learning and as an instrument for socio-legal research. During the session, the team members who were present shared and discussed some possible uses of reflective writing of various sorts, identifying their impact on learning, teaching, and research. This line of inquiry can potentially assist the clinical legal education community to reflect about the reasons for choosing particular tools for reflective practice in our clinical programs. Hodge","doi":"10.19164/ijcle.v26i2.848","DOIUrl":"https://doi.org/10.19164/ijcle.v26i2.848","url":null,"abstract":"Interpretaties over wat ‘vrije ruimte’ is, kan zijn of zou moeten zijn, lopen nogal uiteen, zo blijkt uit de interviews die TAAK voor dit onderzoek hield met een kleine twintig culturele actoren. Sommige respondenten definiëren deze ruimte als een ‘plaats’, als een fysieke ruimte, een plek in de stad, waar je naartoe kan gaan, kan zijn, waar iets plaats kan vinden. In meer abstracte zin gaat het bij sommigen over de publieke ruimte; de onbebouwde ruimte, ruimte die ideologisch leeg is of juist “restruimte” is tussen “private infrastructuren” die “het neoliberalisme ons laat”. Bij anderen is de ‘vrije ruimte’ nog verder gedematerialiseerd en gaat het om een mentale of symbolische ruimte – “de ruimte om te spreken”. Een gemeenschappelijke deler in dit pluriforme geheel aan interpretaties lijkt de spanning tussen bestuur van boven en organisatie van onder. Een aanname die veel respondenten delen, is dat er een sterke, handelende overheid nodig is om de marktdruk het hoofd te bieden. Bijna eensgezind stellen de respondenten vast dat de ‘vrije ruimte’, wat dat dan ook mag zijn, onder druk staat van de markt. De ‘vrijheid’ ervan staat blijkbaar op gespannen voet met de om zich heen grijpende commercialiteit in de hoofdstad, waarin ruimte hoofzakelijk wordt uitgedrukt in de vorm van verhandelbare vierkante meters. Zonder een remmend, beschermend beleid verdwijnen de “restruimtes” onherroepelijk, worden de leemtes gedicht, ja worden alle kwetsbare niet-commerciële activiteiten, voorzieningen en gedachten in de stad stilletjes doodgedrukt. Meer regulering is daarom noodzakelijk. Tegenover deze onder respondenten breed gedragen roep om regulering staat de eveneens breed gedragen roep om deregulering – in veel interviews wordt opmerkelijk genoeg tot beide opgeroepen. Verschillende respondenten pleiten voor “regelluw” beleid voor de ‘vrije ruimte’, in reactie op de bestuurlijke reflex om ruimtes/plekken/ leemtes te bedelven met bestemmingen, gebruiksprotocollen, vergunningsverplichtingen et cetera. Dit is, afgaande op de interviews van TAAK, de centrale paradox van de ‘vrije ruimte’-discussie die door het college is aangezwengeld: we willen een overheid die groot is en klein tegelijk, nadrukkelijk aanwezig en nadrukkelijk afwezig. Aanwezig moet de overheid zijn naar de markt toe om de laatste ‘vrije’ restruimtes te waarborgen en waar mogelijk nieuwe ruimtes te creëren. Maar anderzijds wordt van de overheid verwacht dat het de beschermde restruimtes afdraagt aan de samenleving voor invulling van onderaf; op de vloer moet de overheid dus nadrukkelijk afwezig zijn.
