The debate and the choices of the Subalpine Parliament \u0000ABSTRACT: This essay aims to reconstruct the story of the enactment of the organic law for Piedmont's Israelite Communities (n. 2325), which in 1857 the Subalpine Parliament approved at the end of a close political debate. In the aftermath of the emancipation - granted in 1848 by Charles Albert to the religious minorities, Waldensian and Israelite, present in the Kingdom of Sardinia - the leaders of the Israelite Communities asked the Savoy government to regulate by law the legal-administrative structure of the community institutions. It was only through a legislative measure, in fact, that the Israelite Communities would be able to retain the privilegia fisci, such as the right to levy taxes on their members and to collect communal taxes through tax-collecting rolls, which until then they had exercised under special pre-statutory provisions. In the recent CJEU cases it has been reaffirmed that the employer’s rules do not constitute direct discrimination; however, it has been made clear that a policy of neutrality can justify objectively a difference of treatment indirectly based on religion or belief whether it meets a “genuine need” on the part of the undertaking. This test in most cases is not very different from the one concerning the presence of the “genuine occupational requirements”. The need to seek appropriate forms of composition between the freedom of the worker and the freedom of the company may make anti-discrimination protection under the ground of “religion” weaker than that under the other grounds covered by EU anti-discrimination law; but this is a consequence of the fact that the ground of discrimination constituted by “religion or belief” has been taken by the Court in close connection with the freedom protected by Article 10 EUCFR. \u0000SOMMARIO: 1. Dalla frammentazione (relitto amaro di incertezze strategiche) a un ritorno al Lateranense IV? \u0000ABSTRACT: The essay notes a continuity, starting with the Tridentine, in the deviation from the fundamental principles of what we today call 'due process', imposed by Innocent III since the Council Lateran IV. The progressive spread of special jurisdictions seemed to express the degradation of certain principles and values of medieval common law, from which canon law was gradually moving away. The 1917 code is to be seen as the final sanction and ratification of that involutional process. The author then examines the 1983 reform, which moved between reforming timidity and curial overbearingness: the special jurisdictions were untouchable; the planned chapter on administrative tribunals was deleted in extremis. The impression is that no serious follow-up has been given to the reforms ordered by Paul VI in fulfilment of the Council mandate, starting with the Doctrinal Dicastery. In fact, the centralist innovation as codified in 1917 substantially persists. It is to this petrified block, rebuilt under the two pontificates following Pope Montini, that Pope Francis I attempts to react with innovative ideas that however appear technically imprecise, and in many ways inadequate to the actual dimensions of the Holy See's overall non-fulfilment of the conciliar mandate.
