It proceeds from the premise that putting together the most valuable combinations of resources—including human capital—is of central and increasing normative importance. Structuring law to facilitate these combinations should be a primary task for property scholars working in the law and economics tradition. Doing so requires engaging with the processes through which complementary resources produce value in a modern society, recognizing how property doctrines work to put together and keep together complementary resource sets, and confronting the ways in which material inequality and unremediated injustice stand in the way of realizing valuable complementarities. Because a complementarity-based vision of property holds the potential to promote efficiency and distributive goals simultaneously, it illuminates how an integrative approach might offer policy-relevant traction toward both objectives.","PeriodicalId":301537,"journal":{"name":"LSN: Other Law & Society: Private Law - Property (Topic)","volume":"88 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2020-10-21","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"122699089","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This paper regulates the so-called renovations in lieu of rent (rehabilitacion por renta), that is to say, a tenancy contract in which the tenant does not pay the rent in money but by performing renovation works in the same rented dwelling. The purpose of this paper is to analyse the legal regime of renovations in lieu of rent and how this scheme works.,Renovations in lieu of rent, by its own nature, allow a tenant with building skills to access affordable housing. However, due to the new regulation of this tenancy contract, which is only included in Paragraph 5 of art. 17 LAU, some problems may arise from a legal perspective.,This paper approaches the compatibility of this scheme with the LAU, detects its problems and proposes legal improvements.,This paper explores the application of renovations in lieu of rent and determines whether this new scheme, according to the current regulation, may represent a true residential alternative for vulnerable people or if legislative reform is needed to promote its use.","PeriodicalId":301537,"journal":{"name":"LSN: Other Law & Society: Private Law - Property (Topic)","volume":"201 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2018-02-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"132946340","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It uses social housing allocations as a case study of the issues that arise in such explanations. There has been a number of important social theoretical examinations of social housing allocation schemes in recent years, spanning socio-legal studies. In contrast to those other studies, we argue that “cookie-cutter” theory is insufficient because they can overlook other positions and counter-factual scenarios. We draw on a sample of local authority allocation schemes to reflect on the increasing category of excluded households which we term “unhouseables” (an expression which is commonly used by housing officers) – those households which are excluded from appearing on such schemes because of their former housing deviance or some other disqualification. We offer a set of reflections grounded in our data, which focus on sustainability. Thus, rather than point to particular rationalities or the like, we point to particular housing issues as explanatory factors – including the declining stock and financial “competitiveness” of social housing management – as well as a rise in punitiveness.","PeriodicalId":301537,"journal":{"name":"LSN: Other Law & Society: Private Law - Property (Topic)","volume":"02 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2016-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"128732829","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Shiffrin’s previous rigorous, careful, and morally sensitive work spans contract law, intellectual property, and the freedoms of association and expression. Speech Matters is in line with Shiffrin’s signature move: we ought to reform our social practices and legal and political institutions to, in various ways, address or accommodate moral values—here, a stringent moral prohibition against lying, a strident principle of promissory fidelity, that is, the principle that one ought to keep one’s promises, and the general value of veracity. The book grows out of Shiffrin’s Hempel Lectures at Princeton University and honorary lectures she has given at Cornell and New York Universities. Shiffrin cotaught a seminar with the late Professor Ronald Dworkin, which discussed a prepublication draft of the book (pp. ix–x). The volume is organized into six essentially independent chapters or lectures. Chapters One, Two, and Six began as independent, stand-alone lectures; Shiffrin crafted Chapters Three, Four, and Five to further expand on the arguments of One and Six (p. 4). While the volume bears a unifying theme, Shiffrin intended the chapters to retain their independence as distinct lectures, and she welcomes readers to delve into the chapters independently of one another (p. 4). Speech Matters is, at its core, a rich discussion of moral agency and the normative values of sincerity, truth telling, promissory fidelity, and the effect they ought to bear on personal and social relations, and political and legal institutions. This Review brings forward this unifying theme and provides a critical appraisal, contrasting Shiffrin’s stridently Kantian approach with an alternative foundationally deontic, if less severe, distributive approach.","PeriodicalId":301537,"journal":{"name":"LSN: Other Law & Society: Private Law - Property (Topic)","volume":"121 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2015-06-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"131581557","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Si la propriete est certainement imprescriptible, l’imprescriptibilite doit etre distinguee de la perpetuite. La reconnaissance de proprietes non perpetuelles par le droit positif quebecois ou francais, qui sont autant d’aleas au principe d’une propriete perpetuelle, pose la question de savoir si la perpetuite de la propriete n’est pas un symbole, voire un mythe. La these defendue ici est de dire que si la propriete est, en tant que prerogative fondamentale du droit des biens, destinee a etre perpetuelle — par opposition aux droits reels demembres ou droits sur la chose d’autrui, qui doivent etre limites dans le temps pour ne pas porter atteinte a la structure du droit des biens et a la reconstitution de la propriete pleine et entiere a l’extinction du demembrement — cette perpetuite n’est toutefois pas de l’essence de la propriete, ce qui explique les cas de propriete non perpetuelle ou a terme. Outre les exemples de la propriete superficiaire et de la copropriete, la propriete spatio-temporelle, la substitution, la propriete fiduciaire, ou encore la propriete intellectuelle peuvent s’analyser comme des exemples de propriete temporaire, remettant en cause le dogme d’une propriete absolument perpetuelle. La notion de modalite de la propriete, qui renvoie a une maniere d’etre de la propriete, ne saurait a ce titre faire ecran au fait que la propriete peut ne pas etre perpetuelle. English Abstract: Is it ownership's fate to be perpetual? Ownership is imprescriptible, but imprescriptibility does not equate to perpetuity. The recognition of non-perpetual ownership in France's and Quebec's laws raises the issue of whether perpetuity of ownership is only a symbol or a myth. The argument is made here that if ownership, as a fundamental prerogative of property law, is destined to be perpetual — contrarily to dismembered real rights or rights on the property of others, that must be limited in time so as to not impair property law's structure and restoration of full ownership when a dismemberment ends — that perpetuity is not the essence of property, which explains cases of non-perpetual ownership and property with a term. Despite the examples of superficies and co-ownership, spatio-temporal ownership, substitution, fiduciary ownership and intellectual property can be conceived as cases of temporary ownership, challenging the dogma of a necessarily perpetual ownership. The notion of modality of ownership, which refers to ownership's way of being, does not screen the fact that it is possible for ownership not to be perpetual.","PeriodicalId":301537,"journal":{"name":"LSN: Other Law & Society: Private Law - Property (Topic)","volume":"90 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2015-01-29","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"132567538","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Newey J saw himself as bound by that decision because he could find no relevant distinction between the provisions of the Land Registration Act 1925, and the Land Registration Act 2002. There are however significant differences in the general system of registration that is established. In particular the different roles of section 20 LRA 1925, and section 29 LRA 2002 mean that Malory was not binding and indeed ought not to have been followed. In addition, the treatment of the priorities rules in Richall misinterprets section 29 LRA 2002. Finally, the decision by‐passes the rectification and indemnity provisions of schedules 4 and 8. Alexander","doi":"10.2139/SSRN.1941069","DOIUrl":"https://doi.org/10.2139/SSRN.1941069","url":null,"abstract":"This jurisprudential thesis argues that when an economy has grown so large that it has reached or exceeded the threshold point beyond which any further growth is ‘uneconomic’ (i.e. socially or ecologically counter-productive), property relations as expressed in law should no longer be defined and defended in order to grow the economy. Instead, property relations should be reconstructed in order to achieve more specific welfare-enhancing objectives – such as eliminating poverty, lessening inequalities, and protecting the environment – and the efficient growth of GDP or lack thereof should be treated as a by-product of secondary importance. For these reasons reference will be made to a ‘post-growth’ property system, a system whose coherency, viability, and desirability will be evaluated and ultimately defended as the central project of this thesis.After outlining the central thesis, the introduction looks more closely at the notion of economic growth (as measured by increases in GDP) and considers how its rise to dominance as the pre-eminent policy objective of governments has given modern property law a ‘pro-growth’ structure (focusing on the U.S. jurisdiction). Chapter One presents a multi-dimensional critique of growth – social, ecological, and economic – and concludes by proposing a new macro-economic framework ‘beyond growth.’ Chapter Two examines whether the macro-economic framework proposed could be advanced legally by reconfiguring property relations in advanced capitalist societies. Responding to the objection that such institutional restructuring would illegitimately interfere with established property rights, it is argued: (1) that due to the indeterminacy of property, contract, and market concepts, significant reform of a private property/market system is not a conceptual impossibility; (2) that the state is always and necessarily involved in defining property entitlements and market structures, a point that fundamentally blurs the private/public distinction which is often used to insulate the economy from state intervention; and (3) that defining those property entitlements and market structures is a normative, value-laden undertaking and therefore cannot be done in such a way that is neutral between conceptions of the good life.Having established that property law, in particular, and the legal framework of the economy, in general, are malleable creatures of legal convention, the argument of the thesis becomes explicitly engaged with questions of normativity and value. Chapter Three draws on the life and ideas of Henry Thoreau to express an anti-consumerist ethics of consumption. It is argued that Thoreau’s ethics of consumption provide a coherent and attractive normative foundation for a post-growth jurisprudence of property. Chapter Four focuses attention on theories of law reform arising out of the growing literature on law and social movements. After explaining how cultural values and practices shape law, this chapter examines the ","PeriodicalId":301537,"journal":{"name":"LSN: Other Law & Society: Private Law - Property (Topic)","volume":"98 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2011-01-22","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"121303263","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

We design a three-commodity production and exchange economy in which agents in three geographically separated villages must develop multilateral exchange networks to import a good only available abroad. For treatments, we induce two distinct institutional histories to investigate how past experience with property rights affects the evolution of specialization and exchange. We find that a history of unenforced property rights hinders our subjects' ability to develop the requisite personal social arrangements to support specialization and effectively exploit impersonal long-distance trade.","PeriodicalId":301537,"journal":{"name":"LSN: Other Law & Society: Private Law - Property (Topic)","volume":"249 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2006-10-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"116047192","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
