Munandar, Audyna Mayasari Muin, Hijrah Adhyanti Mirzana","doi":"10.33474/HUKENO.V5I1.9316","DOIUrl":"https://doi.org/10.33474/HUKENO.V5I1.9316","url":null,"abstract":" Penelitian ini bertujuan untuk mengetahui kebijakan hukum pidana yang menghambat penerapan status darurat kesehatan masyarakat pada saat diselenggarakan kekarantinaan kesehatan dan menganalisis sistem pemidanaan yang ideal untuk diterapkan bagi pelaku tindak pidana kekarantinaan kesehatan. Metode penelitian yang digunakan adalah penelitian hukum normatif melalui pendekatan perundang-undangan (statute approach). Hasil penelitian menunjukkan bahwa secara teoretis kebijakan hukum pidana dalam darurat kesehatan masyarakat sulit untuk diterapkan. Substansi Pasal 93 UU Kekarantinaan Kesehatan memuat 2 (dua) jenis delik, yaitu delik formil dan delik materiel. Namun, terdapat penggunaan kata yang masih abstrak di antaranya: perbuatan “menghalang-halangi” serta menempatkan “kedaruratan kesehatan” sebagai “sebab” dalam peraturan tersebut merupakan sebuah kerancuan. Seharusnya rumusan kausalitas pidana dalam sebuah produk hukum pidana dirumuskan sesuai dengan konsepsi awalnya. Oleh karena itu, rumusan delik yang abstrak atau luas akan menghasilkan ketidakpastian hukum, berpotensi tidak dapat diterapkan, dan bertentangan dengan penafsiran yang menyatakan bahwa hukum pidana harus ditafsirkan secara sempit. Merujuk pada keadaan tersebut, maka sistem pemidanaan yang ideal diterapkan ketika terjadi pelanggaran penyelenggaraan kekarantinaan kesehatan, yaitu sistem pemidanaan yang bersifat restoratif dan integratif.Kata kunci: Pandemi Covid-19, Kekarantinaan Kesehatan, Kebijakan Hukum Pidana AbstractThis study aims to determine the legal policy policies that apply Law Number 6 of 2018 concerning Health Quarantine and analyze the ideal punishment system to be applied to health quarantine crimes. The research method used, namely normative research through an invited approach (statute approach). The results show that legal policies in public health emergencies are difficult to implement. The substance of Article 93 of the Health Quarantine Law contains 2 types of offenses, namely formal offenses and material offenses. However, there is a use of the word which is still abstract beside: the act of \"obstructing\" and placing \"health emergency\" as \"cause\" in the regulation is a confusion. The formulation of criminal causality in a criminal law product should be formulated in accordance with its initial conception. Therefore, the abstract or broad formulation of offenses will provide legal uncertainty, which cannot be applied, and contradicts the interpretation which states that criminal law must be interpreted narrowly. Kedudukan Akta Konsen Roya sebagai pengganti sertipikat Hak Tanggungan yang hilang sebenarnya telah diatur dalam Undang-undang No. 4 Tahun 1996 tentang Hak Tanggungan (UUHT), yaitu dengan cara dicatat pada buku tanah Hak Tanggungan yang bersangkutan. Namun dalam praktik, kantor pertanahan tidak menerima permohonan pencoretan Hak Tanggungan yang tidak dilampiri dengan sertipikat Hak Tanggungan, sebagai gantinya maka dibuatlah akta konsen roya.Kata Kunci: akta, sertipikat, hak, tanah, notarisLaw No. 2 of 2014 concerning the Position of Notary (UUJN) does not explicitly regulate the authority of the Notary to make the Roya Concentration Deed as a substitute for the Lost Mortgage Certificate, but based on grammatical interpretation of article 15 paragraph (1) UUJN, notary authorizes to make any deed if desired by the parties concerned as long as the authority is not assigned or excluded by law. The position of the Roya Concentration Deed as a substitute for the lost Mortgage certificate has actually been regulated in Law No. 4 of 1996 concerning Mortgage Rights (UUHT), that is being recorded in the relevant Mortgage Rights land book. However, in practice, the land office does not accept applications for deletion of Mortgage Rights which are not accompanied by a certificate of Mortgage. Konsep ahli waris pengganti dalam Pasal 185 Kompilasi hukum Islam berlaku bagi semua keturunan ahli waris yang seagama serta wafat terlebih dahulu dari pewaris serta bagian dari ahli waris pengganti tidak melebihi dari bagian ahli waris yang sederajat dengan yang diganti. The understanding of inheritance law is the law governing the transfer of assets left by someone who died and the consequences for his heirs. The concept of substitute heirs in article 185 Compilation of Islamic law applies to all descendants of heirs who are in the same religion and died earlier of the heirs and the portion of the successor heirs does not exceed that of the heirs equal to those replaced. Politik perundang-undangan berkenaan dengan pembangunan materi hukum, Negara Republik Indonesia telah meletakkan dasar politk hukum agrarian nasional sebagaimana yang dimuat dalam ketentuan Pasal 33 ayat (3) Undang-Undang Dasar Negara Republik Indonesia. Adapun implikasi hukum akibat belum diterbitkannya Peraturan Pemerintah Undang-Undang Nomor 20 Tahun 2011 dalah dilema yang dialami oleh para steakholder agar diterbitkan Peraturan Pemerintah sehingga tidak menghambat diterbitkannya peraturan pelaksana selanjtnya dalam pendirian rumah susun.Kata kunci: rumah susun, peraturan pemerintah, steakholder. The need for business law in terms of technical development of flats is increasing, the construction of flats is basically intended for densely populated areas to accommodate the reduction of residential land. There is no technical explanation in Law Number 20 of 2011 concerning Flats, resulting in legal problems, namely the vacuum of norms. The method used in this study is normative juridical legal research using sources of primary, secondary and tertiary legal materials. The results in this study are: the politics of legislation is part of legal politics. The politics of legislation regarding the development of legal material, the State of the Republic of Indonesia has laid the political basis of national agrarian law as contained in the provisions of Article 33 paragraph (3) of the Constitution of the Republic of Indonesia. The legal implications of the issuance of Government Regulation No. 20 of 2011 are the dilemmas experienced by steakholders so that the Government Regulation is issued so that it does not hinder the issuance of the next implementing regulation in the establishment of flats. Sesuai dengan Pasal 10 ayat (1) Undang-Undang Pokok Agraria telah mengamanahkan terkait larangan kepemilikan atas tanah pertanian secara absentee. Dengan adanya ketentuan tersebut diharapkan para pemegang hak atas tanah pertanian dapat mengusahakan atau mengerjakan sendiri tanah yang dimilikinya sehingga tanah-tanah pertanian memang menjadi produktif dan tidak terdapat tanah pertanian yang di biarkan atau absentee. Tujuan larangan absentee agar hasil yang diperoleh dari pengusahaan tanah sebagian besar dapat dinikmati oleh masyarakat desa tempat letak tanah. Fenomena larangan tanah absentee/guntai secara nyata terjadi, tetapi tidak dilakukan sanksi yang tegas.Kata kunci: absentee, kepemilikan hak atas tanah, pertanian, sanksi. To make a fair and prosperous farming community, the government through a Land Reform program which includes a reshuffle of land ownership and control as well as legal relations concerned with land tenure. In accordance with Article 10 paragraph (1) the Basic Agrarian Law mandates Absentee prohibitions on ownership of agricultural land. With the existence of these provisions it is expected that holders of agricultural land can cultivate or work on their own land so that agricultural lands are indeed productive and there is no agricultural land that is left or Absentee. The purpose of the Absentee ban is that the results obtained from the cultivation of land can be enjoyed mostly by rural communities where the land is located. Meskipun demikian, dalam peraturanperundang-undangan telah disediakan dua carayang memungkinkan pemegang HGB yang jangka waktunya berakhir tetapmenjadi pemegang HGB, yaitu melalui perpanjanganhak dan pembaharuan hak.
