Dealing first with the problematic Withdrawal Agreement, the chapter considers difficulties associated with the Irish border, solutions to which could create challenges with respect to the UK’s standing in the World Trade Organization. It then explores the implications of exiting the EU without a formal trade agreement under which trade between the two will take place on WTO terms. From there the chapter suggests that a conventional Free Trade Agreement could resolve many of the ongoing difficulties in trade negotiations, with an interim agreement feasible in a short time. It provides an overview of the envisioned Brexit process as it impacts rights and concomitant remedies for their infringement, and links this to the core question of whether there is an inherent ‘injustice’ in uncertainty. It outlines those rights which will be lost; those which are critically at risk; those which are vulnerable; and considers whether there are alternative means of protecting rights. This chapter draws on the theoretical contributions of Carl Schmitt to suggest that the Brexit referendum was a manifestation of constituent power, the legitimacy of which undermines accepted norms of the UK’s unwritten constitution. Given the peculiarity of referendums within standard UK constitutional practice, the chapter focuses on the underappreciated power of rhetoric surrounding Brexit to justify executive actions contrary to established norms.
