Schlinek entitled The Reader. The article is problematic in nature, and the reason for interpreting the novel from a philosophical and legal perspective was the fact that the author claims that writing is for him “the second life”. In the first place, he considers himself a lawyer, a constitutionalist. The first problem concerns the situation of the accused in court and establishing the facts and narration(s), which in itself is an interesting issue for legal scholars – it concerns getting to know the facts in the process of applying the law. The second problem concerns the settlement of crimes committed by the totalitarian regime. In turn, the third problem is related to the broad sense of the punishment, the issue of the perpetrator’s identity and changing circumstances of action – changes taking place in the social system in which the perpetrator functions, as well as his own personality. Badacze tacy jak ja pracowali dawniej nad kilkoma setkami dziewiętnastowiecznych powieści, dziś bierzemy już pod uwagę tysiące, a jutro – setki tysięcy dzieł literackich. Musiało to, rzecz jasna, poważnie wpłynąć nie tylko na historię literatury (zob. Algee-Hewitt i in., 2016), lecz także na metodologię badań, ponieważ kiedy badamy korpus złożony nie z dwustu, ale z dwustu tysięcy powieści, nie robimy w zasadzie tego samego, tylko na tysiąc razy większą skalę – robimy coś zupełnie innego. Nowa skala zmienia naszą relację z przedmiotem badań, w rzeczy samej zaś z m i e n i a p r z e d m i o t b a d a ń. „Te wszystkie przedmioty, które badają dzisiaj historycy, to przedmioty rekonstruowane. Firstly, some considerations by R. A. Posner on connections of law and literature and A. Borowski’s reflections on his own loss of faith in the identity of the discipline as far as observations by M. Korytowska about the subject and organisation of studies in comparative literature are analysed. Moreover, the contents of the ACLA State of the Discipline Report (2017) are critically read and confronted with some contemporary Italian manuals of the discipline. The legal situation of comparative literature is discussed in on the background of the university ruled by corporate law. Furthermore, actual weak points of comparative literature are indicated, e.g. succumbing to pseudointellectual trends, lack of criticism of popular theories, incapacity to distinguish between important and trivial topics, weakening of research on literature for the sake of cultural studies, decline in knowledge and philological competences among scholars, regression in the interest in national literature. Gaj","doi":"10.18276/rk.2020.11-08","DOIUrl":"https://doi.org/10.18276/rk.2020.11-08","url":null,"abstract":"The article deals with the unique features of the only surviving 2nd century CE. work \u0000by Longos, i.e. stories about the love of a shepherd couple, Dafnis and Chloe. The work \u0000shows the traits both of the ancient narrative, the short story, the bucolic, and the \u0000romance as well as follows the main assumptions of an ancient choreia. However, on \u0000closer examination, it turns out that the work carries only single features – like single \u0000genes – of these literary genres.
