By ratifying the CRPD states promise to adopt proactive equality norms and provide positive supports for persons with disabilities. They are also required to involve people with disabilities in the enforcement and implementation of the CRPD. It is thus a valuable tool for those advocating for the realisation of the rights of persons with disabilities that they be treated on an equal basis with others and fully included in society. McCann","doi":"10.2307/j.ctv10kmc63.13","DOIUrl":"https://doi.org/10.2307/j.ctv10kmc63.13","url":null,"abstract":"While acknowledging that the European Union (EU) has been to the fore in the promotion of international human rights standards among its own states and citizens, Chapter 7 critically assesses the role of the EU in relation to the promotion of rights and development in the Global South where many former colonies of EU states continue to be affected by the legacy of colonialism and ongoing neocolonial relationships with EU states and institutions. Despite a range of EU commitments and initiatives (indeed, half of the world’s development aid comes from there) it is argued that developmental and rights-based approaches in the Global South have often been frustrated by ideologically and self- interest driven economic policies promoted by the EU. It critically assesses the challenges posed to such protections by powerful states, geo-political considerations and the changing nature of war and conflict. It examines the operation of the International Criminal Court, the role of the UN Security Council and the geo-political manipulation of the UN by the USA and others, using the case of the Israel/Palestine conflict as but one example. It interrogates the concept of universal human rights, the processes that led to their development and the factors which influence both the development and implementation of international human rights mechanisms. It recognises the contribution of philosophical ideas about humanity, equality, democracy, social justice, etc., as well as the impact of human ‘agency’. It argues that such developments do not take place in a vacuum. It outlines existing international human rights mechanisms relevant to education as a right and critically assesses their ability to make that right a reality in a diverse world with different levels of ‘peace’, stability, conflict, cultural and socio-economic contexts. While recognising that the right to education includes all people regardless of age, the chapter mainly focuses on education as a right for children and, in particular, how the right to education for children in developing countries can be affected by violent conflict.
