To achieve this, a qualitative methodology of jurisprudential review is employed to analyze the rules and sub-rules applied by the judges in resolving these cases, contrasting them with certain foundational ideas of queer legal theories. In this analytical exercise, the text elucidates how, within the dogmatic rules devised by the ordinary labor judge, there are emancipatory opportunities that escape the binary gender paradigm. Robert Schuett was awarded a master’s degree by research in 2005 and a PhD in 2009, both in Political Science from the School of Governance and International Affairs at Durham University; the supervisor of his doctoral thesis was John C. Williams (Durham University), and his external evaluators were Chris J. Brown (London School of Economics) and Richard Little (University of Bristol). In 2007, he completed a doctoral research stay at LUISS University in Rome and, in 2010, he was a postdoctoral fellow in the Department of Psychology at the University of California, San Diego, USA. He currently lives and works in Vienna.\u0000Robert Schuett’s main areas of interest are political philosophy, international relations, and political methodology. He is particularly interested in the classical approach to political and legal theory, economics and society, ethics, and justice. This paper aims to elucidate tensions that have arisen in the social integration of the migrant population in Cali, Colombia, based on the analysis of their access to health and work rights. A methodology is proposed for the correct and efficient use of constitutional and conventional interpretation by jurisdictional operators, with special emphasis on the analysis of the obstacles or technical barriers they face when carrying out constitutional-conventional regularity examinations. This constitutional decision highlights the various routes established by jurisprudence for managing environmental displacement. However, this research aims to demonstrate that the existing protocols for addressing environmental displacement are not sufficient, especially considering that the incorporation of this special category of human migration into the Colombian legal system is necessary. Hasta ahora, la ley ha servido únicamente como una herramienta para el control social y es extremadamente inflexible, lo que hace imposible mantener adecuadamente los principios básicos de la implementación y la aplicación de la justicia. La ley debe poder evolucionar para servir como una herramienta que fomente el desarrollo social y que resulte en la satisfacción y el establecimiento del orden legal. Como resultado, el desarrollo legal debe priorizar los deseos y necesidades de la población. Este es un estudio sociolegal en el que los fenómenos sociales se interpretan como la dirección del desarrollo legal. Empleando un enfoque conceptual y analizando datos cualitativos obtenidos de la revisión de la literatura, nuestros hallazgos revelaron que las necesidades de las personas, particularmente en Indonesia, han cambiado en respuesta al establecimiento de la ley. Con el deseo de aportar sus aspiraciones en la creación de la ley y servir como sociedad participativa en el monitoreo de la forma como se lleva a cabo la aplicación de la ley, el desarrollo del pensamiento legal dentro de la sociedad se está moviendo en una dirección positiva. El desarrollo jurídico debe cambiar el paradigma que anteriormente consideraba al derecho meramente como un mecanismo de control social, como resultado de los cambios sociales. Tanto la creación de leyes como la aplicación de estas deben abrazar una sociedad participativa. El marco contextual en el cual se desarrolla esta hipótesis es la República de Colombia, donde se profirió la Sentencia T-479 de 2015. Se concluye que existen mínimamente unos compromisos morales entre el Estado y sus ciudadanos, más allá del simple mantenimiento del orden público que predica la neutralidad liberal. Así, por ejemplo, el impacto de la política pública del consumo de cigarrillos en establecimientos penitenciarios configura compromisos que deberían ser atendidos por el Estado. Para arribar al objetivo de este trabajo, se utiliza un tipo de estudio jurídico descriptivo que permite delimitar el objeto de análisis, utilizando, a través de la deducción como método, una herramienta que permita llegar a concreciones sobre el caso particular de la Sentencia T-479 de 2015.
