Vaz","doi":"10.22533/AT.ED.23018281214","DOIUrl":"https://doi.org/10.22533/AT.ED.23018281214","url":null,"abstract":"Access to justice is a fundamental right provided for in the Brazilian Federal Constitution of 1988. Starting from the movements of legal assistance, diffuse rights and the consumer and the mixture of the first two, they began to be identified as a major obstacle to the Judiciary. Challenge that the National Council of Justice seeks to tackle with several alternatives, among them the implementation of the National Judicial Policy for the Appropriate Treatment of Conflicts of Interest. Based on the American proposal Multidoor Courthouse System that emphasizes the use of consensual methods, such as arbitration, conciliation, negotiation and mediation, it intends to break the paradigm that the judicial process is the only \"door\" Access to justice. The research aims to analyze the contribution of this public policy to the democratization of access to justice and the compliance capacity of the state courts of justice in the phase of implementation of the political-administrative cycle. The results of the research led to the conclusion that Brazilian state courts of justice are not fully compliant with the implementation phase of this policy. A consequência disso impacta decisivamente na formulação e implementação de quaisquer políticas públicas no Brasil. {"title":"CONFLUÊNCIAS E DISSONÂNCIAS ENTRE AS TEORIAS DA DEMOCRACIA DE SCHUMPETER E DAHL: ANÁLISE DAS CRÍTICAS E ALGUNS DE SEUS IMPACTOS","authors":"Alison Ribeiro Centeno","doi":"10.22533/at.ed.23018281219","DOIUrl":"https://doi.org/10.22533/at.ed.23018281219","url":null,"abstract":"This research aims to point agreements and frictions between Schumpeter’s minimalism concept and Dahl’s polyarchy, revising Schumpeter’s Capitalism, Socialism and Democracy (first published in 1942) and Dahl’s Polyarchy: participation and opposition (first published in 1971). The recapitulation of those theories is made comparing them and denoting the assumptions made by these two important figures in the political theory for the functioning of representative government, such as the role of voters and political parties, and their visions of democracy. This comparison is contrasted with the bases of some of the main critical reviews written about the proceduralism and polyarchy.
